HomeMy WebLinkAboutResolution 96-058497967 B-990 P-865 09/04/96 02:15P PG 1 OF 3 REC OOC NOT MHDRED ALSOORF GARFIELD COUNIT CLERK AND RECORDER 0.00 STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on MQNpoy , the Jx:aof SEPTEMBER A.D. 19 96 , there were present: Marian Smith , Commissioner Chairman Elmer (Bucky) Arbaney , Commissioner Arnold Mack:ley absent , Commissioner Don Deibrd , County A:ttomey MUdred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 96-058 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY STEPHEN F. WELLER WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from STEPHEN F. WELLER for a home occupation on the following described tract of land: Located on Lot l, Herc:zeg Subdivision Exemption plat as recorded 1/21/87, Reception No. 378331 (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public meeting on the 19th day of August, 1996, upon the question of whether the above-described Conditional Use Permit should be granted or denied, at which meeting the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Conditional Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned meeting, has made the following determination of fact: l. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. ~s 497967 B-990 P-866 09/04/96 02:15P PG 2 OF 3 2. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Conditional Use Pennit be and hereby is authorized pennitting the use of the above described tract of land for a home occupation upon the following specific conditions: 1. All representations of the applicant, either contained in the application or stated in the public meetings, shall be considered conditions of approval unless otherwise stated. 2. Any expansion or modification of the home occupation. above or beyond the representations within the application, shall require the applicant to file a new Conditional Use Pennit application. 3. That the hours of operation are limited to 7 am to 7 p.m., Monday through Friday, and when necessary, 8 a.m. to 5 p.m. on Saturdays. 4. The CUP permit is only valid for the current owner under which the application was presented. Subsequent owners will have to apply for a CUP to continue a home occupation on the property.
