The subject property is approximately 17.7 acres in size and is zoned Agricultural Residential Rural Density (ARRD). The location of the property is depicted in Figure 1 (Vicinity Map). The Garfield County land use code identifies accessory dwelling units as special review use in the AARD zone district when specific approval has not been granted as part of any subdivision or other approval pursuant to a public hearing. In this case, the West Rimledge Subdivision was finally approved in July of 1999 but no approval was granted for accessory dwelling units at that time. The option to pursue such units in the future was not prohibited when the subdivision was approved and, in fact, the protective covenants for the West Rimledge Subdivision state that accessory dwelling units are permitted on any lot within the subdivision subject to the provisions of the Garfield County zoning, subdivision and building regulations. The proposed structure is depicted on Figures 2 and 3. The accessory dwelling unit will contain two bedrooms, two baths, kitchen and living area. Currently, the structure is planned to contain 993.5 square feet. However, the Applicant is seeking approval to allow the structure to be expanded to 1,500 square feet as provided in the Garfield County Zoning Regulations. The additional square footage can be accommodated on the subject property with no additional impact. If the additional square footage is utilized, the on-site sewage disposal system would be sized accordingly. Figure 2 is a floor plan of the structure and shows the layout of the accessory dwelling unit. The structure will also include a deck and exterior stairway, which will be used to access the second floor unit. The deck is approximately 385 square feet in size. The exterior materials and design of the structure are intended to match the existing house, photographs of which are included with this application as Exhibit 1. Elevation drawings of the proposed structure have also been included (Figure 3). These drawings illustrate the rustic character of the structure. The building is designed to a height of 27 feet to the peak of the ridge. The structure is proposed to be located approximately 65 feet east of the existing residence. The proposed building site is a small clearing in stand of mature pinion juniper. The project will require the removal of a few trees to accommodate the structure and the access driveway. Care has been taken to site the building and driveway to avoid the larger, more mature trees. The structure will be accessed by a new driveway, the location of which is depicted in the Site Plan (Figure 4). The access drive will enter the property from the east and will cross a corner of Lot Three. An easement for this purpose has been executed and recorded. A copy of the document describing the easement and showing the alignment is attached as Exhibit 2. A portion of this proposed drive (from the main road up to the edge of Lot 2) has been roughed in and is in place. Water for the accessory dwelling unit will be provided from the existing well serving the main residence. The location of the well is depicted on the Site Plan. The alignment of the new water line serving the accessory dwelling unit has not been determined yet but care will be taken to ensure that no trees are damaged or removed when this line is installed. The well permit for this well (Well Permit No. 49665-F) allows it to be used for one single-family residence plus one detached caretaker unit and the irrigation of not more than 1,500 square feet of home gardens and lawns (Exhibit 3). The maximum pumping rate is limited to 15 gallons per minute. The well was drilled in 1991 by Shelton Drilling and the pump was installed by Aqua Tec. Results of the pump test and drinking water analysis, which were conducted in 1991, are provided as Exhibits 4 and 5. Wastewater for the accessory dwelling will be handled by the existing on-site septic system. The location of this system is depicted on the Site Plan. The current system includes a 1000 -gallon tank and roughly 240 feet of infiltrator leach lines. The existing sewage disposal system was installed when the original house was constructed. Exhibit 6 is a copy of the individual sewage disposal permit for the system. This permit shows that a percolation rate test was done in August of 1991 and the soil was found to percolate at a rate of 14 minutes per inch. The capacity of the existing system s adequate to handle the existing house but according to Gary Carmichael, the contractor who installed the existing system, the system will need to be expanded to accommodate the proposed accessory dwelling unit. Designs for this expansion and the alignment of the pipeline serving the proposed accessory dwelling unit will be provided at building permit application. This well has been permitted for use in one single-family residence plus one detached caretaker dwelling unit. The well permit is attached. The well was tested on October 28, 1997and was found to have adequate supply for four homes, assuming 4 persons per dwelling. We have attached a letter prepared by Tom Platzer of Aqua Tec, the company that installed the pump and conducted the well test, confirming this finding (Exhibit 7). Also attached is a Drinking Water Analysis report that was prepared in 1991 when the well was installed (Exhibit 5). There are two more well permits that have been issued for this Subdivision. These wells have not yet been drilled but they are intended to provide water for Lots 1, 3 and 4. The well permits for these wells are also attached (Exhibit 8). One of the wells is permitted for a location on Lot 1, while the other is permitted for a location between Lots 3 and 4. 5) Compliance with the County individual sewage disposal system regulations or proof of a legal ability to connect to an approved central sewage treatment facility. Response: Wastewater from the proposed accessory dwelling unit is intended to be handled via an expansion of the existing on-site individual sewage disposal system. This system was installed when the main house was constructed and is located below the main subdivision road. The Applicant intends to submit an application for an ISDS permit from the County for expansion to this system at or before building permit application. The system expansion has not been designed at this time. A soil percolation test was conducted in the area of the existing sewage disposal system when that system was installed. At that time, a percolation rate of 14 minutes per inch was recorded (Exhibit 6). Assuming similar soils exist in the adjacent area, where the system expansion would be constructed, a standard system should be adequate to handle the additional wastewater from the proposed unit. 6) Only leasehold interests in the dwelling units is allowed. Response: The Applicant intends to use the unit for guests and family and accepts this restriction. 7) That all construction complies with the appropriate County building code requirements.. Response: The Applicant is aware of this requirement and will demonstrate compliance with all applicable building codes as part of the building permit application. The Applicant has retained the services of a local architect to design the building and assist in the building permit process. General Requirements for Conditional and Special Uses (Section 5.03) The Garfield County Code requires compliance with three broad criteria in addition to the specific criteria reviewed above. One of these criteria addresses utilities, which have already been discussed above. The remaining two criteria are addressed as follows: 2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use. Response: The proposed unit will be occupied intermittently and will have little impact on the existing road system. If occupied on a year-round basis, the unit would generate between 7 and 10 trips per day Hammes Accessory Dwelling Unit 9 Special Review Application - 4/9/2001 according to the Institute of Transportation Engineer's Trip Generation Manual. Even assuming this number of trips, the existing road system is more than adequate to handle this additional traffic. Traffic from the West Rimledge Subdivision is routed to the east along an existing subdivision road, which connects to County Road 100 approximately 1.5 miles north of Highway 82. Most trips originating on the property will be heading to and from Highway 82. The existing subdivision road has a gravel surface and is in excellent condition. This road was required to be improved as part of the subdivision approval in 1999 in order to ensure adequate access for residential development on the four lots contained in the subdivision. These improvements included surfacing the road and making minor improvements to the road between the subdivision and County Road 100. In addition, the County required that the subdivision road be connected to the existing road in the Wooden Deer Subdivision to provide emergency access to County Road 103 to the west. These improvements have all been completed. The road through the Wooden Deer Subdivision is gated and is only used for emergency access. 2) Design of the proposed use is organized to minimize impact on the from adjacent uses of land through installation of screen fences of landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect the established neighborhood charater. Response: The proposed accessory dwelling unit is located in an area of the property that is well screeded from all surrounding properties. No other strcutures have been built within the Subdiviosn and there are no strcutres on any adacent property outside of the Subdiviosn that are in close proximity to the proposed building site on the subject property. Exhibit 9 is a series of four photographs taken from the proposed buidling site and looking in all four directions. The unit may be slightly visible from points outside the subdivision. The roof of the existing house is slightly visibile from Highway 82, though you must be looking for the strcuture to see it. The propposed structure is considerably smaller and is located further into the trees. Visual impacts from the proposed structure will be minimal. The structure should also not be mostly, if not totally, screened from any nearby property outside of the West Rimledge Subdivision. The structure will be slightly visible through the trees from the building envelope on the adjacent lot (Lot 3) to the east of the subject property. The owners of this lot have been made aware of the Applicant's intent to contruct this unit and have no objection. In fact, they provided the access easement to allow the construction of the driveway for this unit across their property as shown on the Site Plan. The proposed accessory dwelling unit will create no other significant impacts. Parking Requirements (5.01.01) The Garfield County land use code requires one off-street parking space per 600 square feet of floor area or one space per dwelling unit whichever is greater. Under this provision, one parking space is required for the proposed unit. The proposed structure includes a three -stall garage that will be used to accommodate parking for the proposed unit. Also, while there is ample off-street parking adjacent to the main house, there is no covered parking on the property. Therefore, this garage will also be used to store the Applicant's vehicles when they are away for long periods of time. Since there will rarely be visitors on the property when the family is not present the proposed garage spaces can serve both purposes. Hammes Accessory Dwelling Unit 10 Special ReviewApplication - 4/9/2001 Setback Requirements (3.02.06 & 5.05) The Code requires a 50 -foot front yard setback, 25 -foot rear yard setback and 10 -foot side yard setback. The location of the proposed structure exceeds all of these requirements. The structure is set back 130 feet from the subdivision road, 130 feet from the south property line and 135 feet from the east property line. None of the supplementary setback regulations contained in Section 5.05 are applicable to this property. Summary We believe we have demonstrated compliance with all applicable standards and criteria required for approval of an accessory dwelling unit in Garfield County. The following findgs have been demonstrated in this application: 1) The proposed unit is located on a lot which is eight times larger than the minimum lot size allowed in the zone district; 2) The proposed unit will be minimally visisble, if visible at all, from any property outside of the West Rimledge Subdivision; 3) Adequate water and sewage diposal can be provided for the proposed unit with no additional impact on surrounding properties; 4) All setback and other area and bulk requirements of the zoning regulations are met or exceed in this proposal; 5) Adequate parking is provided in association with the proposed unit; 6) Traffic from the proposed unit is minimal and the existing road system, as improved in accordance with the subdivision approvals, is more than adequate to handle the additional trips; We, therefore, request special review approval to allow construction of a 1,500 square -foot accessory dwelling on Lot 2 of the West Rimledge Sudivision. HAMMES and LENORE L. HAMMES ("Declarants"). RECITALS A. Declarants are the owners of Lot 2 and Lot 3, West Rimledge Subdivision ("Lot 2" or "Lot 3", as the case may be), according to the Final Plat thereof recorded October 5, 1999 in the Garfield County real estate records as Reception No, 553272. B. Lot 3 and Lot 2 are adjacent to one another so that the westerly boundary line of Lot 3 forms the easterly boundary line of Lot 2. C. Declarants hereby acknowledge that in order to properly construct a driveway to any improvement to be constructed within the building envelope on Lot 3, a "switchback" from the driveway constructed within the Driveway Easement described in Section 1, above, will be necessary. A properly constructed driveway switchback of the Lot 3 driveway may encroach onto Lot 2.
