Dear Mr. Laurien:
pursuant to the planning Department's August 21 review of the above-referenced application,
this letter is intended to latisfy the second portion of item 2 regarding the ISDS system'
The new unit will be on a new septic system separate from the system currently in use by existing
residence. Combined, both dweliings will not exceed a daily discharge of 2,000 gallons per day'
Therefore, we request that this letter be accepted as satisfactory evidence for adequacy of the

Dear Mr. Laurien:
This firm represents Randal and Cecilia Harman. On Augus t7, 2000,Mr. and Mrs.
Harmon submitted to the Garfield County Planning Department an Application for a
Special Use Permit. The Application requested a Special Use Permit for an accessory
dwelling unit. The accessory dwelling unit will be a one bedroom, one and a half bath,
apartment located in the upper portion of an existing barn. The apartment shall not exceed
1,500 square feet in size and will likely have two occupants.
Mr. and Mrs. Harmon advised that you have concerns regarding the water supply
for the apartment and requested I address your concerns. The domestic water for the
accessory dwelling unit will be supplied from the Fender Spring and Pipeline. On
November 5,L971., in Civil Action No. 5884, the Garfield County District Court granted to
the Fender Spring and Pipeline 0.75 c.f.s. with a priority date of September 7,1959, for
domestic, municipal, irrigation, stockwatering, piscatorial,recreational and otherbeneficial
uses. Subsequently, on August 3,1973,the Water Court for Water Division No. 5 made the
Fender Spring and Pipeline absolute for 0.75 c.f.s. for irrigation, domestic, stock watering,
piscatorial, recreational and other beneficial uses. Copies of the Decrees for Civil Action No.
5884 and Case No. W-171,6 are enclosed for your reference.

The water rights decreed to the Fender Spring and Pipeline were transferred by
Robert P. Sewell and Susan B. Sewell to the Rock Creek Subdivision on May 2'1,1973. A
copy of this deed is attached.
Prior to the filing of the water rights application to make the Fender Spring and
Pipeline absolute, Robert P. and Susan B. Sewell filed Protective Covenants of the Rock
Creek Subdivision in Garfield County, Colorado. Pursuant to Section I.A. "Land Use and
Typ. of Buitding," lot owners may erect a single family dwelling together with a private
guest house or other residential out building. A copy of the Protective Covenants of Rock
Creek Subdivision is attached hereto. In other words, an accessory dwelling unit, such as
the one proposed by the Harmons, was always contemplated and the Fender Spring and
Pipeline covers water usage by the proposed accessory dwelling unit. By virtue of the
Harmons' ownership of a lot in the Rock Creek Subdivision, they are entitled to L/13th of
0.75 c.f.s. or 25.89 g.p.m. of water from the Fender Spring and Pipeline.
Given the above, it is our opinion that a legal and physical supply of water exists
for the accessory dwelling unit proposed by Mr. and Mrs. Harmon. If you have any
