in the Commissioners'Meeting Room, Garfield County Courthouse, in Glenwood Springs on --Mgnday,

A RESOLUTION CONCERNED WITH THE APPROVAL OF A ACCESSORY DWELLING UMT
SPECIAL USE PERMIT APPLICATION FOR RANDAL AND CECILIA HARMON.
LEGAL DESCRIPTION
LOT 13, ROCK CREEK SUBDTVISION. 0574 CRYSTAL RTVER ROAD, CARBONDALE, COLORADO.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from Randal and Cecilia Harmorq concerned with a Accessory Dwelltng SpeciaL Use Permit
to allow for the construction of an Accessory Dwelling Unit;
WHEREAS, the Board held a public hearing on the 13th day of November, 2000, upon the question
of whether the above-described Accessory Dwelling Unit Special Use Permit should be granted or denied,
at which hearing the public and interested persons were given the opportunity to express their opinions
regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
l. That proper public notice was provided as required by law for the hearing before the Board
of County Commissioners.

2. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that hearing.
3. That for the above stated and other reasons, the proposed Special Use Permit is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield CountY.
4. That the application is in conformance with the Garfield County ZorungResolution of 1978,
as amended-
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Accessory Dwelling Unit Special Use Permit be and hereby is approved to allow
for the construction of an Accessory Dwelling Unit, upon the following speciflrc conditions:
l. That all representations of the applicant, either within the application or stated at the hearing
before the-Board of County Commissioners, shall be considered conditions of approval.
2. Section 5.03.21of the Garfield County ZoningResolution,lgTS, as amended, be complied
with by the applicant.
3. The two conditions in the letter dated J:u/ry 29,2000, from the Rock Creek Homeowner's
Association, included in the application submittal, which state:
I) Per the Protective Covenants of Rock Creek Subdivision, Item I (A), states that No
lands within said Subdivision shall be occupiedfor or usedfor any commercial or
business purpose.
2) Approval is subject to your acquiring all necessary permits, approvals and
inspections (including septic) required by Garfield County',
must be complied with by the applicant.
4. The requirement of the September 8, 2000, leffer from the Rock Creek Homeowner's
Associaiiorg which states, "Their requested accessory dwelling unit will be furnished water
from our water system provided that they have obtained all required permits from all
applicable agencies.", bolding added for emphasis, must be complied wittt by the applicant.
5. Any violation of the terms, interpretations or agleements made or represented to Garfield
County by the applicant pertaining to or included in this Special Use Permit, shall be
considered a breach of the terms of conditions and the applicant shall cease and desist all
activities and may be subject to revocation of the Special Use Permit.
