Re:
John and Resa Wing, the owners of Lot 360, River Valley Ranch in Garfield County wish
to construct an Accessory Dwelling Unit on their property. The property is zoned
A/R/RD (Agricultural / Residential / Rural Density) and is 47 ,54 acres in area.
We are currently in the construction phase of a single family residence and would like to
proceed onthe approval process for the ADU. Section 3.02.03 of the Garheld County
Land Use Code lists ADU's as a "special IJse", conditional upon meeting the standards
in Section 5.03.02
I will list the standards in Section 5.03.02 and then show how we will comply with those
standards:
t. The minimum lot size shall be 4 acres containing a building site with slopes less
than 40 ok at least 2 acres in size. The lot size is over 47 acres and the designated
building envelope has no steep slope areas.
2. The grossfloor areafor residential use occupancy sholl not exceed 1500 square
feet. The gross area for the residential portion of the building will not exceed
1000 square feet.
3. Approvalfrom the subdivision homeowners association and/or allowed by
covenant, if applicable. See Attachment A for covenant stating permission for
ADU.
4. Proof of a legatly adequate source of water for an additional dwelling unit. See
Attachment B letter from Colorado Division of Water Resources.
5. Compliance with the County individual sewoge disposal system regulations. See
Attachment C, OWS System for Lot 360, by Sopris Engineering, dated June 10,
2004.
6. Only leasehold interests in the dwelling units is allowed. This is understood by
the owner.
7. That all construction complies with the appropriate County building code
requiremenls. The applicants understand this and will submit fully engineered
and code complaints for building permit.

I will list the "Special Use Application Submittal Requirements" from Garfield County
and follow each item with our response.
1. Please submit, in narrative fronU the nature and character of the Special Use
requested. . .
The ADU is to be 1000 square feet of residential use, and will be attached to a
barnlgarage of approximately 2185 square feet. The owners intend to use the ADU as a
guest house for their property. The barn will be a working barn and will have three horse
stalls, tack roorrq feed room and storage, with a hay loft area on the second level. See
attached drawings.
The only vehicles accessing the ADU will be houseguests and they will be infrequent.
The single family home under construction is approximately 6500 s.f. of living space
with a partial basement and 3 car garage. Electrical service has been engineered for the
completion of both structures and has already been installed underground to a new
transformer. Natural gas, telephone and cable TV have also been routed underground to
the building site.
2. If you will be using water or will be treating wastewater in conjunction with
the proposed use, please detail the amount of water that would be used and the
type of wastewater treatment...
The ADU will have one kitchen and one bathroom and the barn will have water to serve
three horses requirements. We have arranged with the Town of Carbondale for the
domestic water use for both structures and have designed the wastewater treatment for
both structures as well. See Attachments B and C.
3. Submit a site plar/map drawn to scale that portrays the boundaries of the
subject property, all existing and proposed structures on the property, and the
County or State roadways within on mile of your property...

5. Submit a copy of the appropriate portion of a Garfield County Assessor's Map
showing all mineral rights owners ofthe subject property and public and private
landowners adjacent to your property...

I checked with the Garfield Count Assessor and obtained property profiles for all of the
adjacent landowners. See Attachment E. I was informed that there is no listing of any
severed mineral owners.
6. Submit a copy of the deed and legal description of the subject property.
See Attachment F.
7. If you are acting as an agent for the property owner, you must attach an
acknowledgement from the property owner that you may act in his/her behalf.
See Attachment G.
8. Submit a statement that specifically responds to each of the following criteria
from Section 5.03 of the Zoning Regulations.
(1) Utilities adequate to provide water and sanitation service ... shall either be in
place or shall be constructed in conjunction with the proposed use.
The water and sanitation services are currently in place for the ADU to hook up to in the
future.
(2) Street improvements adequate to accommodate traffrc volume ... shall either
be in place or shall be constructed in conjunction with the proposed use.
The driveway to the main house and ADU is currently under construction.
(3) Design of the proposed use is organized to minimize impact on ... in such a
manner as to protect established neighborhood character.
We will design our landscaping, fences and lighting to minimize the impact on
neighboring lots.

annexed. Single-family occupancy shall mean and shall be
strictly limited to occupancy of the residence by a family
comprised of (i) no more than two (2) principal adults,
(ii) the legal dependents of one or both of said principal
adults, (iii) no more than two (2) additional family members
(adults or children) who are related by blood or marriage to
said principal adults, and occasional guests' Employees who
care for the residence or who care for the children may also
occupy the residence' For purposes hereof, "related by

Grandparents, parents, brothers and sisters, aunts and uncles,

3- In addition to vehicles that are parked entirely
within an enclosed structure (regardless of whether the CRLP
Property contains an accessory dwelling unit), no more than
two (2) permitted vehicles (passenger automobiles and/or one
ton or smaller pick-up trucks) shali be parked or stored at any
given time upon either such tract. No vehicles of any kind
shall be parked in any location except on the CRLP Property
or within an approved encloscd structure as provided above.
4. AIi structures constructed on the CRLP
Property shall comply with any lighting ordinance duly
adopted by the Town then in effect.
5. No structure shall be btrilt on the CRI-P
Property except within a building envelope which shail be
approved by the Town. No residential structure shall be
built on the CRLP Property except for the two single-family
