At a meeting of the Board of County Commissioners for Garfield
County, Colorado, neld at the Garfield County Courthouse in Glenwood
Springs on Monday, the 22nd day of October A.D. 1984, there were present:

RESOLUTION NO. 84-250
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIOYJAL USE PERMIT
APPLICATION BY EUGENE AND CINDY PFALZGRAFF
WHEREAS, the Board of County.Commissioners of Garfield County,
Colorado, has received an application from Eugene and Cindy Pfalzgraff
for a Conditional Use permit for a moUile home.as a permanent.residence
and principle use of the lot.
on the following described tract of land: Lot 1, Block 4, of Unit 1 of Elk
Creek Subdivision in the NE 1/4 33ect.ion 25, Townsnip 5 South, Range 91
West, approximately one mile northwest of New Castle at 0169 Comanchero
Trail.
(in the State of Colorado and the County of Garfield); and
WHEREAS, the Board conducted a meeting on the 22nd day of October
upon the question of whether the above described Conditional Use permit
snould be granted or denied, at wnicn.meeting the public and interested
persons were given the opportunity to express.their opinions regarding the
issuance of said Conditional Use permit; and
WHEREAS, the Board on the basis of the evidence produced at the
aforementioned nearing, has made the following determination of fact:
1. That the meeting before the Garfield County Commissioners was
extensive and complete, that all pertinent facts, matters and
issues were submitted and that 311 interested parties were heard
at that meeting.
2. That the proposed conditional use conforms to Section 5.03 of the
Garfield County Zoning Regulations governing the approval or
disapproval of a petition for a Conditional Use permit for a
mobile home as a principle use of a lot.
3. That based on the number of mobile homes and land uses in the
immediate vicinity, the proposed use by the applicc,_:t is
compatible with the surrounding area.

4. That for the above stated ind other reasons, the proposed Mobile
Home Conditional Use permi: is in the best interest of the health
safety, morals, convenience, order, prosperity and welfare of the
citizens of Garfield Count;'.
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of Garfield County,
Colorado that a Conditional Use permit be and hereby is authorized
permitting the use of the above described tract of land for a mobile home
as permanent residence and principle use of a lot upon the following
specific: conditions:
1. That the use of the tract of land comply with all regulations
of Garfield County relating to the location and use of a mobile
home.
2 The applicant shall make application for the required County
building and sewage disposal permits prior to issuance of the
land use permit for the mobile home. The building, sewage
disposal and land use permits shall be issued simultaneously.
3. The individual sewage disposal syste:ti and water supply system
shall be available prior to occupancy of the mobile home.
4. Skirting around the mobile home shall be securely in place within
60 days after placement of the mobile home. No storage shall be
allowed underneath oroutside of the structure. The building
official may require tie downs in areas subject to high winds.
5. That the mobile home make, year, list price/new purchase price
and serial number be submitted to the Planning Section prior to
issuance of the Conditional Use permit.
b. The Conditional Use permit snail oe valid for a period of one
hundred twenty days from the date of issuance thereof unless
construction or Esse has commenced within this specified period,
the permit shall expire.
7. The mobile home shall be placed on permanent concrete or masonry
footers.
8. The applicants shall have 120 days from the date of the
Resolution of Approval to meet all conditions set forth in the
Resolution.
9. The mobile home shall have a minimum of 720 square feet of floor
area.
10. All representations of the applicant, either within the
application or stated at the hearing before the Board of
Commissioners, shall be considered conditions of approval.
