HomeMy WebLinkAboutResolution 2000-32111111111111111111111111111111111111111111111111111111 362886 05/02/2000 09:30A 81185 P282 M ALSDORF 1 of 5 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday , the 1 stday of may A.D. 2000, there were present: John Martin , Commissioner Chairman LqU McCown , Commissioner Walt Stowe Commissioner Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2000-32 A RESOLUTION CONCERNED WITH THE APPROVAL OF AN AMENDED CONDITIONAL USE PERMIT APPLICATION TO ALLOW A HOME OCCUPATION IN THE A/R/RD ZONE DISTRICT. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from David W. Hatch requesting an amendment to resolution 2000-17 concerning approval of a conditional use permit to allow a home occupation on the property. described in the attached legal description ("exhibit A"); and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a public hearing on the 17th day of April, 2000, upon the question of whether the above described amendment to the conditional use permit for basic firearm instruction should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said conditional use permit; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the Page 1 of 4 4? 1111111111111111111111111111 III 1111111111 IIIII 1111 III 562886 03/02/2000 09:30A 81185 P283 M ALSDORF 2 of 5 R 0.00 D 0.00 GARFiELD COUNTY CO following determination of fact as listed below: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners; 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting; 3. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended; 4. That for the above stated and other reasons, the proposed conditional use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the David W. Hatch Amended Conditional Use Permit is hereby approved subject to compliance with all of the following specific conditions: A. Ail items indicated in the staff report, recommended by the Board of County Commissioners, and included by the Board of County Commissioners at the public hearing as itemized below: That all representations made by the applicant in the application, and at the public hearing before the Board of County Commissioners, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. These representations include (but are not limited to): • The purpose of the permit is to offer basic firearm instruction and the buying and selling of firearms as a home occupation. All business will occur indoors. • Hours will be restricted to 1p.m. to 4 p.m. on Mondays and 6 p.m. to 9 p.m. Tuesday through Friday; • No business signs will be posted. • The number of vehicles accessing the site per week, in relation to the home occupation, will not exceed five (5) vehicle trips per week. • Firearms will not be kept in stock, but will only be ordered on an as -needed basis. 2. That all applicable requirements of the Garfield County Zoning Resolution of 1978, as amended, shall be fulfilled; 3. A copy of the instructor's current and approved federal firearms license and NRA certification will be kept on file with the County Planning Department. If, at any time, this information is not kept current and on file, the conditional use permit will be invalid; 5. The home occupation shall maintain a residential character and shall not become a retail establishment or cause a commercial impact; 6. The home occupation will involve: a) classroom type firearms instruction with five (5) or fewer students b) the firing of firearms within the indoor shooting range with five (5) or fewer students 7. The indoor shooting range shall meet all building code requirements. Written confirmation from a Garfield County Building Inspector that the shooting range meets the building code will be required prior to issuance of a conditional use permit. 8. That the applicant agrees to allow the code enforcement officer, Steve Hackett, to inspect the interior of the buildings to confirm whether or not an illegal business is being operated. No conditional use permit will be issued until written confirmation from the code enforcement officer of compliance with the regulations has been received by the Planning Department staff. 9. This approval replaces the approval of resolution 2000-17, rendering the previous approval null and void. DatedlMs i gt_ day of may , A.D. 2000.
