Mackl ev _ _ , Commissioner Rlmar (Ruckay) Arhaney , Commissioner nen DFFcrd , County Attorney Mildred Alsdorf �__, Clerk of the Board rhiick DescheneG —, County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 91-004 A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE PERMIT APPLICATION BY FRANK HARDRICK. WHEREAS, the Board of County Commissioners of Garfield County, -�- Colorado, has received application from Frank Hardrick for a home occupation on the following described tract of land: A tract of lard, situated on Lot 1 of Section 9 in Township 6 South, Range 92 West of -the 6th P.M., Jying northerly of the northerly right- of-way line of U.S. Highway No. 6 and 24 and easterly of a county road as constructed and in place, described as follows: Beginning at a point on the northerly right-of-way line of said highway, whence an iron post with. a brass cap properly marked and set for the witness corner to the Northwest corner of said Section 9 bears N. 85 25155"W. 333.47 feet, thence N. 84 3614611W. 1330.49 feet ( in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public meeting on the 26th day of November, 1990, upon the question of whether the above-described Conditional Use Permit should be granted or denied, at which meeting the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Conditional use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned meeting, has made the following determination of fact: 1. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 2. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. 3. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. BOOK 796 pACE846 NOW, THEREFORE, BE IT '.tESOLVED by the Board of County Commissioners of "Garfield County, Colorr.�ILdo, that the Conditional Use Permit be and hereby is authorized permitting the use of the above described tract of land for a home school upclrn the following specific conditions: 1. All, proposals of the applicant shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. 2. The applicant shall have 120 days from date of conditional approval to meet all conditions of approval. The Conditional Use Permit shall expire 120 days after issuance, unless construction or use has commenced. 3. Noise levels shall not exceed those maximum levels allowed by state statute. 4. All storage of snow machines, exclusive of those personal machines owned by the applicant, shall be stored inside the garage or within an adequately screened enclosure, either of evergreen vegetation or fencing. IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said County, at Glenwood Springs, this day of A. _D. 19 _ County Clerk and ex -officio Clerk of the Board of County Commissioners noK 796 FAcES47 CONDITIONAL USE PERMIT Frank Hardrick In accordance with and pursuant to the provisions c;.t the Garfield County Zoning Resolution of 1979, as amended, and Resolution No. of the Board of County Commissioners of Garfield County, Colorado, hereby authorizes, by Conditional Use Permit, the following activity: A home occupation on the following described tract of land in Garfield County, Colorado : A \tract of land situated on Lot 1 of Section 9 in Township 6 South, Range 92 West of the 6th P.M., lying northerly of the northerly right-of-way line of U.S. Highway No. 6 and 24 and easterly of a county road as constructed and in place, described as follows : Beginning at a point on the northerly right-of-way line of said highway, whence an iron post with a brass cap properly marked and set for the witness corner to the Northwest corner of said Section 9 bears N. 85 2515511W. 333.47 feet, thence N. 84 3614611W. 1330.49 feet. The within Conditional use Permit is 'issued subject to the --- conditions set forth in the above-mentioned resolution, and shall be valid only during compliance with such conditions and other applicable provisions of the Garfield County Zoning Resolution, Subdivision Regulations, Building Code, and other regulations of the Board of County Commissioners of Garfield County. NOTE: This permit shall expire 120 days after issuance unless construction or use has commenced within that time period or unless the Garfield County Board of County Commissioners has issued an extension of this permit prior to it's expiration date.
