At a reguiar meeting of the tsoarci of County Commissioners for Garfieici County, Coiorario,
held in the Commissioners'Meeting Room, Garfield County Courthouse, in Glenwood Springs on,
Monday, the lOth day of December A.D. 2007, there were present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 2007 -132
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE
PERMIT FOR AN ACCESSORY DWELLING UNIT FOR A PROPERTY OWNED BY
TI{E ROARING FORK PURCHASE TRUST LOCATED AT A PROPERTY
DESCRIBED AS LOT 3 OF THE PREHM RANCH EXEMPTION (1612 COUNTY
ROAD 163), GARFIELD COUNTY
PARCEL NO# 2 I 85 34 I 02003
WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"),
has received an application from the Roaring Fork Purchase Trust for a Special Use Permit ("SUP")
to allow an Accessory Dwelling Unit on their property within the ARRD (Agricultural Residential
Rural Density) zone district; and,
WHEREAS, the Board held a public hearing on the 10'h day of Decemb er,2007 , upon the
question of whether the above described SUP should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions concerning the
approval of said special use permit; and,
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact as listed below:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.

2. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested pafiies were heard at
that meeting.
3. That for the above stated and oiher reasoiis. the proposecl Speciai Use Permit is in the best
interest of the health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That the application is in conformance with the Garfield County ZoningResolution of
1978, as amended.
5. That the application is in conformance with the Garfield County Comprehensive plan of
2000.
6. That the subject property is identified within the Comprehensive Plan of 2000 as being
within an area of a High Water Table and subsequently within the Septic Constraint designation.
NOW TTIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that Special Use Permit for an Accessory Dwelling Unit for a property owned by
the Roaring Fork Purchase Trust is hereby approved subject to compliance with all of the following
specific conditions:

All representations of the Applicant, either within the application or stated at the hearing
before the Board of County Commissioners, shall be considered conditions of approval
unless otherwise modified by the Board.
All lighting associated with the ADU shall be the minimum amount necessary. All
exterior lighting shall be shieided to prevent light trespass on any adjoining property and
be downward facing towards the structure.
The Applicant shall obtain any applicable Garfield County building permits, grading
permits and access permits.
The Applicant shall meet all requirements of the Garfield County ZoningResolution of
1978, as amended, and shall meet all building code requirements.
The gross floor area of the accessory dwelling unit shall not exceed 1,500 square feet.
The accessory dwelling unit shall not be conveyed as a separate interest but may be
leased.
Since the subject property is within the Septic Constraint designation in the

Comprehensive Plan of 2000 and in orrler to maintain compliance with ISDS Permit
Number 3705, the Accessory Dwelling lJnit shall be limited to one (1) bedroom.
