The property is located in the Four Mile drainage, east of the Sunlight View II PUD. Pursuant to Garfield County regulations, we request that this application, upon being determined technically complete , be presented to the Board of County Commissioners for a referral decision. Based on the nature of the proposed land use, we respectfully submit that referral to the Planning Commission is not necessary, but will abide by whatever decision the Board makes. Mrs. Zilm is out of town and requested that I assist her in the completion and submittal of this application. Print Name 10/2004 Page 4 Zilm Accessory Dwelling Unit Special Use Permit Narrative of the Proposal The subject parcel is 13.78 acres in size, owned by Charlotte Zilm. Current zoning of the parcel is AIR/RD . The parcel is developed with a two-story structure , originally constructed as an agricultural building, with a storage area in the second story . There is a small pond in the west-central portion of the property . Otherwise the parcel is substantially undeveloped. The proposal is for an Accessory Dwelling Unit (ADU) that would occupy the second floor of the existing garage structure , consistent with Section 3.02.03 and Section 5.03.21 of the Garfield County Zoning Resolution of 1978 , as amended . The upper floor storage area that would be converted into the ADU is approximately 844 square feet. All necessary building permits and inspections wi ll be obtained prior to utilizing the structure for human habitation. A separate , single family dwelling is proposed for development on the parcel , sometime in the future. It is anticipated that the ADU will be the year-round residence of a single person, or a person with a small family. The inhabitant(s) of the ADU will also be responsible for general maintenance and upkeep of the 13 . 78 acre parcel. Access and Traffic Generation The parcel is accessed directly from Laird Lane , which is a road within t e Sunlight View PUD. The access is substantially wider than the average driveway, which will be re than suffici to handle the very small amount of vehicular traffic generated by this land use. Water and Wastewater Service Domestic water and wastewater treatment will be provided by the centralized facilities of the Sunlight View II PUD. Attached to this application is a letter of service from Tony Fisher, President of the Sunlight View Water and Wastewater Company , stating the willingness and ability to serve the parcel. Acreage and Topography As noted above, the parcel is 13 .78 acres in size , substantially larger than the 4 acre requirement contained in Section 5.03.21. The existing garage structure is placed in the center of a gently -sloped area , in the west-central portion of the property. The site conforms to the slope and acreage criteria contained in Section 5.03.21(1). Other Requirements of Section S.03.21 The gross floor area of the office/storage portion of the garage structure is approximately 844 square feet and there is no proposal to increase the square footage of the inhabitable portion of the structure. The subject parcel is not within any subdivision. However, wat er and wastewater utilities will be provided by the existing. Sunlight View II facilities. As noted previously , a letter has been provided stating the ability and willingness to serve. Only leasehold interests will be allowed in the ADU .
