HomeMy WebLinkAbout5.0 Resolution 2007-081I11IWid I h113/4k R HILIALISPI+1'IWWirMill 11111 Reception#: 716953 02/08/2007 04:38'.24 PM 8:1893 P-0..03 Jean Alberico 1 of 4 Rec Fee:$0.00 Doc Fee: GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, the 15th day of January A.D. 2007, there were present: John Martin Larry McCown Tresi Houpt Carolyn Dahlgren Jean Alberico Ed Green (Absent) Commissioner Chairman , Commissioner , Commissioner County Attorney , Clerk of the Board , County Manager When the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2 0 0 7- 0 8 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR AN ACCESSORY DWELLING UNIT FOR A PROPERTY OWNED BY GEORGE AND JERI SHERICK, GARFIELD COUNTY PARCEL NO# 239509100061 WHEREAS, the Board of County Commissioners of Garfield County, Colorado (-Board") has received an application from George and Jeri Sherick for a Special Use Permit ("SUP") to allow an Accessory Dwelling Unit on their property within the ARRD (Agricultural/Rural/Residential Denvisty) zone district; and WHEREAS, the Board held a public hearing on the 15th day of January, 2007, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. GARFIELD COUNTY CO that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 5:03, 5.03.021 and 9:03) the Garfield County Zoning Resolution of 1978, as amended. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit for an Accessory Dwelling Unit for a property owned by George and Jeri Sherick is hereby approved subject to compliance with all of the following specific conditions: 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless otherwise modified by the Board. 2. All Iighting associated with the ADU shall be the minimum amount necessary. All exterior lighting shall be shielded to prevent Light trespass on any adjoining property and he do , • , and facing towards the structure. The Applicant shall obtain a letter stamped by a Certified Colorado Engineer stating that the existing ISDS system is capable of processing the added demand from the ADU. The letter shall also verify that the existing ISDS is in compliance with the regulations and standards required by the Colorado Department of Public Health and Environment. 4. The applicant shall obtain any applicable Garfield County access and grading permits. (5� The Applicant shall meet all Garfield County Building Codes and Regulations. In addition, the Applicant shall obtain all necessary Building Permits prior to the issuance of a Special Use Permit. 6. The gross floor area of the accessory dwelling unit shall not exceed 1,500 square feet. 7. The accessory dwelling unit shall not be conveyed as a separate interest but may be leased. 6. The Applicant shall perform an evaluation which shall be approved by the Glenwood Spring Fire Department indicating the danger of the buildings from being destroyed by wildfire and the danger of a structure fire creating a wildfire. If a danger is found to exist, the Applicant shall, at the discretion of the Glenwood Springs Fire Department, develop a plan to mitigate the conditions favorable to the aforementioned fire dangers. The Glenwood Springs Fire Department shall approve of all fire mitigation plan implementation prior to the issuance of a Special Use Permit. 11. The Applicant shall decrease the livable floor area of the constructed ADU to 1500 square feet or smaller by increasing the size of the garage. The additional garage space (aka "workshop") shall be contiguous to the original garage space and shall not be separated by walls or any other structural dividers.
