DEER AND RITA R HARRINGTON. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from John M. Deer and Rita R Harrington for a ADU on their property included within an existing stable. at the 7.028 acre site at 2150 County Road 109, Glenwood Springs and in Teller Springs Subdivision Lot 11, also in the SW •;. of the SE Y. of Section 12 and the NW Y. of the SE Y. of Section 13 of Township 7 South, Range 89 West of the 6 111 Principle Meridian. WHEREAS, the Special Use Permit request for a "Accessory Dwelling Unit" specifically will allow a portion of an existing stable and tack storage building totaling 2,016 sq. ft., to be used as an Accessory Dwelling Unit (ADU) utilizing 576 sq. ft as descn'bed in the site plan submitted in the application for guests, and family when visiting. WHEREAS, the subject property is located in the Agricultural/Residential/Rural Density (AIR/RD) zone district which contemplates a "Accessory Dwelling Unit" as a Special Use within that district; and WHEREAS, the Board held a public hearing on the 5lh day of April, 2004, upon the question of whether ihe above-described Speciai Use Permit should be granted or denied, at John Deer and Rita Harriog1on. SUP-ADU 11115/04 1111111111111111111111111111111111111111111111111111111 663709 11/18/2004 03:32P 81640 P875 M ALSOORF 2 of 3 R 0.00 0 0.00 GARFIELD COUNTY CO which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fuct: I . That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. · 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent fuels, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County .ZOning Resolution of 1978, as amended. 4. For the above stated and other reasom, the proposed use is in the best interest of the heahh, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County ComnUssioners of Garfield County, Colorado, that the Special Use Permit be and hereby is approved to allow for an Accessory Dwelling Unit at the site identified in the application, upon the following specific conditions: l. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. The ADU must be certified by a Registered Colorado Engineer or Architect that all concealed areas of construction comply with Garfield County Building Code Requirements. 3.
