SPECIAL USE PERMIT
(Issued to a property owned by John M. Deer & Rita Hanington)
In accordance with and pursuant to the Garfield County Zoning Resolution of 1978, as
amended, and
Resolution No. 2004 111
of the Board of County Commissioners of Garfield County, State of Colorado, hereby
authorizes, by Special Use Permit, the following use:
"ACCESSORY DWELLING UNIT"
This Special Use Permit is issued to the property owned by John M. Deer and Rita R
Harrington for a Special Use Permit on their property to be included within an existing
stable at the 7.028 acre site at 2150 County Road 109, Glenwood Springs, AKA Teller
Springs Subdivision Lot 11, and in the SW V. of the SE V. of Section I 2 and the NW V. of
the SE V. of Section 13 of Township 7 South, Range 89 West of the 6th Principle
Meridian.
The Special Use Permit is issued subject to the conditions set forth in the above
mentioned resolution, and shall be valid only during compliance with such conditions and
other applicable provisions of the Garfield County Zoning Resolution, Building Code,
Comprehensive Plan, and other regulations of the Board of County Commissioners of
Garfield County, Colorado.

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. ___ 2_0_0_4_-_11_7 ___ _
A RESOLUTION CONCERNED WITH THE SPECIAL USE PERMIT (SUP) THAT
WOULD ALLOW THE APPLICANT TO OPERATE AN ACCESSORY DWELLING
UNIT (Al)U) ON THEIR PROPERTY WITHIN AN EXISTING STABLE FOR JOHN M.
DEER AND RITA R HARRINGTON.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has
received application from John M. Deer and Rita R Harrington for a ADU on their property
included within an existing stable. at the 7.028 acre site at 2150 County Road 109, Glenwood
Springs and in Teller Springs Subdivision Lot 11, also in the SW '/. of the SE Y. of Section 12
and the NW Y. of the SE Y. of Section 13 of Township 7 South, Range 89 West of the 6th
Principle Meridian.
WHEREAS, the Special Use Permit request for a" Accessory Dwelling Unit" specifically
will allow a portion of an existing stable and tack storage building totaling 2,016 sq. ft., to be
used as an Accessory Dwelling Unit (ADU) utilizing 576 sq. ft· as descn'bed in the site plan
submitted in the application for guests, and family when visiting.
WHEREAS, the subject property is located in the AgricuJtural/Residential/Rural Density
(AIR/RD) zone district which contemplates a "Accessory Dwelling Unit" as a Special Use within
that district; and
WHEREAS, the Board held a public hearing on the 5th day of April, 2004, upon the
question of whether the above-described Speciai Use Permit should be granted or denied, at

which hearing the public and interested persons were given the opportunity to express their
opinions regarding the issuance of said Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
I. That proper publication and public notice was provided as required by law for the hearing
before the Board of County Commissioners. ·
2. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties
were heard at that hearing.
3. That the application is in compliance with the Garfield County Z.Oning Resolution of
1978, as amended.
4. For the above stated and other reasons, the proposed use is in the best interest of the
health, safety, morals, convenience, order, prosperity and welfare of the citizens of
Garfield County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
CoW1ly, Colorado, that the Special Use Permit be and hereby is approved to allow for an
Accessory Dwelling Unit at the site identified in the application, upon the following specific
conditions:
I. All representations of the applicant, either within the application or stated at the
hearing before the Board of CoW1ty Conunissioners, shall be considered
conditions of approval.
2. The ADU must be certified by a Registered Colorado Engineer or Architect that
all concealed areas of construction comply with Garfield County Building Code
Requirements.
3. That the applicant must submit a new application for a building permit for the
ADU within the Stable, allow inspections, and ultimately gain a Certificate of
Occupancy consistent with the adopted rules and regulations of Garfield County
prior to any habitation.
