Subject: Klein SUP request, Zone Violation
Steve,
This letter is to inform you of a possible Zoningviolation I have recently observed during a site
visit to the residence of Beverly Klein of 1777 CR 241. Ms. Klein is applying for a Special Use
Permit for the conversion of a l9l0 log cabin to an ADU (the dwelling unit on the right in the
picture below). She has constructed a new home next to the cabin and was given a final
inspection (but no C/O see attached document from Andy Schwaller) under building permit
#8577 on 10127103 (the dwelling unit on the left in the picture below).
The apparent violation (see picture below) is the traveVcamping trailer that is currently being
used as a dwelling unit. It has water and electric connected and has a TV dish attached to the
exlerior. The unit has been occupied on site for an apparent extended and ongoing period of time.
Thank you for your attention to this matter. Please update me with any information that you can
in regard to your investigations.

Re: Certificate of Occupancy--Newly Constructed House-Building Permit #8577
Dear Sirs:
I am respectfi.rlly requesting that I be granted a Certificate of Occupancy for my newly constructed home on
the above identified property on the condition that if my application for a Special Use Pemit to keep ttre
existing old house as a guest house is denied, the old house will be demolished as originally planned. I
agree to this condition
At this time, the closing date for converting the construcfion loan to a mortgage loan is scheduled for
Monday October 27 and is contingent on having the C.O. so I would appreciate your decision as quickly as
possible.

Mrs. Klein was never issued a C.O. for the building built under Permit #577. As a condition to that building
permit, the existing older house needed to be either torn down or become legal through a SUP before a C.O.
would be issued. The Building Dept. did do a final inspection which was passed on 10.27.03. The final
inspection allowed Mrs. Klein to secure her financing for the new building and issuance of a C.O. would be'delayed untilthe results of the SUP hearing are known. Copies of her letter requesting a conditionalC.O. are
provided to you for review. As we do not issue conditional C.O.s the above scenario was used.

This office has been advised that a travel trailer, located on property owned by you at the above address,
is being used as a dwelling. It is a violation of Colorado Revised Statutes 30'28-124 &. 124.5, enabling
Garheid County zoning re-solution of 1978, to use a Recreational Vehicle as a dwelling except in a legal
RVPark.
You are hereby given notice, pursuant to the above statutes and regulations, that you must compl-etely
correct the vioiations within thirty (30) days of the date this notice is received. Please be advised that
violation of the above statues is a misdemeanor crime punishable, upon conviction, by a fine of not more
than $100.00 or imprisonment for not more than ten days, or both, and that each day that the violation
continues is deemed to be a separate offense.
