HomeMy WebLinkAbout3.0 Resolution 2003-73inlrr nur llltnlll ut lllltttltlllLfit'lttlt ttlt bieago og/tg/zoo3 03:45P Bl52o P375 I'l RLSDoRF 1 of 4 R O.@o O O.OO GRRFIELD C0UNTY c0 1',- STATE OF COLORADO County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, heldin the Commissioners'Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, the 8'o day of September A.D. 2003, there were present: John Martin -, Commissioner Chairman Larry McCown , Commissioner Trdsi Houpt , Commissioner Don DeFord , CountY AttorneY Mildred Alsdorf , Clerk of the Board F.d Green _, County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO. 2OO3-73 A RESOLUTION CONCERNED WITII THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR A}{ ACCESSORY DWELLING UNIT FOR JEFF AND STEPIIANIE RIPP WIIEREAS, the Board of County Commissioners of Garfield County, Colorado (,,Board"), has received an applicatiofl from Jeff and Stephanie Ripp, for a special use permit (,,SUp,,; for an Accessory Dwelling Unit at 4715 County Road 233, Rifle, Colorado within the A/R/RD zone district; and WHEREAS, the Board held a public hearing on the 8* day of September, 2003, upon the question of whether ihe above described SUP should be granted or denied, at which hearing the p.rU6. and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WIIEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. Z. That for the above stated and other reasons, the proposed Special Use Permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application has met the requirements of Special Use (Sections 5:03 and 9:03) in the Garfield County Zontng Resolution of 1978. 5. That the applicant has met the requirements of an Accessory Dwelling Unit (Section 5.03.21) in the Garfield County Zoning Resolution of 1978. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that Special Use Permit for an Accessory Dwelling Unit is hereby approved, subject to compliance with all of the following specific conditions: 1. A11 representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. Only leasehold interests in the ADU shall be allowed. The unit may not be sold separately. 3. The use of cistern as a source of domestic water shall not be a permitted.
