At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in
Glenwood Springs on Monday, the 12th day of December, 2005, A. D. there were present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 2006-08
A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT
FOR AN ACCESSORY DWELLING UNIT FOR A PROPERTY LOCATED AT 4730
COUNTY ROAD 335, GARFIELD COUNTY, COLORADO.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"),
has received an application for a Special Use Permit ("SUP") for an accessory dwelling unit
("ADU'') from Lynn and Patrick Dwyer, for a property located at 4730 County Road 335 within the
AJR/RD wne district; and
WHEREAS, the Board held a public hearing on the 12th day of December, 2005 A.D., upon
the question of whether the above described SUP should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions concerning the
approval of said special use permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact as listed below:
I. That proper public notice was provided as required for the hearing before the Board
of County Commissioners and proof thereof submitted in the record;
2. That the hearing before the Board of County Commissioners was extensive and
complete, that sufficient pertinent facts, matters and issues were submitted and that
all interested parties were heard at that meeting;

e. A written opinion of the person conducting the well test that this well should be
adequate to supply water to the number of proposed dwelling units;
f. An assumption of an average of no less than 3.5 people per dwelling unit, using 100
gallons of water per person, per day;
g. The water quality is tested by an independent testing laboratory and meets State
guidelines concerning bacteria and nitrates.
9. That prior to issuance of the Special Use Permit, the Applicant shall legally deed the
property into three separate parcels. Therefore allowing the ~subject parcel" of this
application to have one (1) principle residence and one (1) ADU.
