Commissioner Carolvn Dahloren , Deputy County Attorney Mildrcd Alsdorf Clerk of the Board Ed Green , Cor:oty Manager when the following proceedings, arnoDg others were had and done, to-wit: RESOLUTION NO. 2008_8s A RESOLUTION CONCERNED WITI{ TIM, APPROVAL OF A SPECIAL USE PER]\{IT FOR AIY ACCESSORY DWELLING UNIT FOR A PROPERTY OWNED BY JOE AND DIXrE FIOU, GARFTELD COLJNTY PARCEL NO, WHEREAS, the Board of Counfy Commissioners of Garfield County, Colorado ("Board"), has received an application from Joe and Dixie Fiou for a Special Use Permit C'SIIP") to allow an Accessory Dwelling Unit on their property within the ARRD (Agricultural Residential Rural Density) zone district; and, WHEREAS, the Board held a public hearing on the l5ft day of May,2006, upon the question of whethff the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and, WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: l. Tbat proper public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, I f.S. That for the above stated and other reasons, the proposed Special Use Pemrit is in the best interest of the healtb, safety, convenience, order, prosperity and welfare ofthe citizens of Garfield County. 4. Thatthe application is in conformance withthe Garfield County ZnfugResolutionof 1978, as amended. NOW TIIEREFORE, BE IT RESOL!'ED by the Board of County Commissioners of Garfield County, Colorado, that Sp€cial Use Permit for an Accessory Dwelling Unit for a property owned by Joe and Dixie Fiou is hereby approved subject to compliance with all of the following specific conditions: l. All representations of the applican! eitber within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless otherwise modified by the Board. 2. All lighting associated with the ADU shall be the minimr:m amormt necessary. All exterior ligbting shall be shielded to prevent light trespass on any adjoining property and be downward facing towards the stucture- 3. The Applicant shall obtain the appropriate ISDS permit as part of the building permit process for the ADU. This system shall comply with the regulations and standards required by the Colorado Department of Public Health and Environment. 4. The applicant shall obtain any applicable Garfield County access and grading permits 5. The Applicant shall meet all requirements ofthe Garlietd County Zoning Resolution of 1978, as amended, and shall meet all building code requirements 6. The gross floor area ofthe accessory dwelling unit shall not exceed 1,500 square feet 7. The accessory dwelling unit shalt not be conveyed as a separate interest but may bc leased. 8.
