Clerk of the Board ) )ss ) Don DeFord Mildred Alsdorf Ed Green County Manager when the following proceedings, among others were had and done, to-wit: RESOLUTION NO Ao_o4-4s A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR AN ACCESSORY DWELLING UNIT FOR PARCEL 7-E, H & B MINOR SUBDIVISION EXEMPTION LOCATED AT 245 COLINTY ROAD 335, NEW CASTLE, GARFIELD COLTNTY, COLORADO Psrcel ID : 2 1 I I -07 3 -02-0 0 3 WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application for a Special Use Permit ("SLI.P"1 for an accessory dwelling unit from Donna Meade, for a property located at 335 County Road 245 within the A/I zone district; and WHEREAS, the Board held a public hearing on the 3'u day of May, 2004, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions conceming the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners and proof thereof submitted in the record; 2. That for the above stated and other reasons, the proposed special use permit is in the best interest of the trealth, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County ZoningResolution of 1978, as amended; NOW THEREFORE, BE IT RUSOLVED by the Board of County Commissionsrs of Carfreld County, Colorado, that StlP is hereby approved subject to compliance with all of the following specific condition: 1. All representations of the applicant, either within the application or stated at the hearingbefore the Board of County Commissioners, shall be considered conditions of approval. 2. This structure / dwelling unit slhall not be occupied until a final certificate of occupancy has been issued by the Building Departmentt. Applicant shall have this completed within 120 days ofapproval by the Board. 3. All lighting associated with this structure shall be the minimum amount necessary and all exterior lighting will be directed inward and downward, towards the interior of the lot, 4. The Applicant shall obtain the appropriate ISDS permit as part ofthe building permit process to locate the manufactured home on the property. This system shall comply with the regulations and standards required by the Colorado Department of Public Health and Environment. 5. The Applicant shall upgrade the present driveway onto CR 335. The driveway wili be a minimum of 30-feet wide and not over 40-feet wide. An asphalt or concrete apron will be installed, the width of the driveway extendirrg l0 feet onto the property with a depth of 4 inches. The driveway will be attached to the paved shoulderof CR 335. The Road and BridgeDepartment will not require a driveway permit, but will requi::e a final inspection on the upgrade to the present driveway. No Special use Permit shall be issued until this has been completed.
