Please read the contract carefully if you have not already done so, but please especially note paragraph 2 concerning availability of water. West Divide obtains its augmentation water from a number of sources and operates its water supply program pursuant to a Temporary Substitute Supply Plan ("TSSP") approved annually by the State Engineer's Office. TSSPs are common for water conservancy disti icts and West Divide has operated pursuant to a TSSP for several years with no significant reliability issues. Federal policy relating to endangered species, environmental concerns, and forces of nature are always such that no source of water can be guaranteed during any season or from year to year. West Divide continues to make good -faith efforts to obtain alternative long-term supplies in an effort to make reliable and predictable the water supply anticipated by your contract with us. For most years, we expect to be successful in these efforts. This water allotment contract may require you to obtain a well permit from the State Engineer's office. Once your well is drilled you are required to install a measuring device and submit a meter reading to West Divide, upon request. Non-compliance with measuring and reporting requirements are grounds for cancellation of your water allotment contract with West Divide. This could result in action by the State Engineer which could prevent your further use of your well. Sincerely yours, Janet Maddock Enclosure cc Division No. 5 Water Resources w/assignment Kerry D. Currently it has a one bedroom house on it. We are requesting a Special Use Permit to construct a 1500 sq ft ADU for my mother, who will be 75 this year and who presently lives on Garfield Creek. It will be her only residence and she has one car. The ADU will have a guest bedroom, which may be used once a year. Utilities: The site chosen for the ADU is within 300' of an electricity pole. We have a septic permit (see supporting documentation) that has the capacity for 5 bedrooms. Currently there is one on it, and the ADU will add two more. The well has been augmented with West Divide Creek water (see supporting documentation). The propane tank will be buried. Street Improvements: The entrance driveway to the property is already considerably larger than it needs to be Design: The 10 acre property is generally flat, with a pinion and juniper covered rocky hill on the eastern boundary. We propose to nestle the house into this hill amongst the trees. It is a log home designed to blend with the other new construction that can be seen 'behind' the property to the east and north. We intend to plant more trees to provide screening to the east and shade from the south and west.
