APPLICANT: Charles Griffin LOCATION: A tract of land located in portions of Section 33 T5S, R92W of the 6th P.M.; 3925 CR 233, Rifle Colorado, 2 1/2 miles east of Rifle, 3/4 mile north of Hwy 6 SITE DATA: 4.01 Acres WATER: Spring/Well SEWER: ISDS ACCESS: CR 233 EXISTING/ADJACENT ZONING: A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN The subject property is classified as District C, Rural Areas in the 1984 Garfield County Comprehensive Plan. This District is characterizes as a rural area with minor environmental constraints. II. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located west of Silt and East of Rifle, north of I-70 on CR 233, Antlers Subdivisi,n (See location map pg. j ) Project Description: The proposal would allow for the movement of an existing unit and assignment of the unit as an accessory dwelling unit north of the proposed home. The ADU has a floor area of under 1500 square feet and would allow for the placement of a new unit 3,000 square feet in size. The proposed and existing units are manufactured -and meet all County requirements for these types of dwelling units. (See Pg. /(*-/7 ) III. MAJOR ISSUES AND CONCERNS A. Zoning: The proposal is a special use as indicated in Section 3.02.03, Uses, Special of the Zoning Resolution of 1978, as amended. B. Legal Access: Legal access will be provided by an access easement on the east, connecting with County Road 233. (See Pg.S ) C. Water: The applicant has a surface water right to Griffin Spring No. 3, of which the applicant has a one-third interest. The right allows for augmentation water for five (5) single family dwellings. The storage water right for the spring allows for 1.3 acre feet absolute for irrigation and for 1.3 acre feet conditional for augmentation purposes stored in Griffen Pond 1.The right allows for 20 gpm to be conditionally drawn from the spring. The condition of the right is to maintain full storage of the pond and to mitigate evaporation losses occurring during summer months which reduce flowage to the Colorado River to the detriment of appropriators downstream. (See Pg// -1 `!') D. Sewer: A proposed ISDS is to be placed north of the proposed home. E. State and Local Health Standards. No State or Local health standards are applicable to the application, with the exception of Colorado Department of Health ISDS setback standards. .. • • - e . cipa es, - • • • ' - • ting IV. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That for the above stated and other reasons, the proposed special use permit to allow for an accessory dwelling unit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. a- V. RECOMMENDATION Staff recommends APPROVAL, finding that the proposed use is in compliance with all plans, policies, resolutions and regulations as adopted and amended by Garfield County, and that the approval be granted with the following conditions: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2. That the applicant obtain written approval from a licensed engineer for placement of the septic leach field as proposed in the application site plan. 3. These soils are usually irrigated by flooding. Drop structures in irrigation ditches, grassed waterways, and minimum tillage prevent serious erosion. Irrigation water should be carefully managed to avoid piping and erosion. Cover crops or stubble mulching also help to limit ero- sion in dryfarmed areas. The native vegetation on this soil is mainly wheat - grass, needleandthread, and sagebrush. When range condition deteriorates, forbs and shrubs increase. When the range is in poor condition, undesira- ble weeds and annual plants are numerous. Properly managing grazing maintains and improves range condi- tion. Reducing brush improves the range. Seeding im- proves range in poor condition. Crested wheatgrass, western wheatgrass, and Russian wildrye are suitable for seeding. Preparing a seedbed and drilling the seed are good practices. Pheasant, mourning dove, cottontail rabbit, some mule deer, and squirrel find habitat on this soil. Community development and recreation are limited by low strength and the shrink -swell potential. Dwellings and roads can be designed to overcome these limita- tions. Community sewage systems will be needed if the population density increases. The Potts soil makes up about 60 percent of the map unit, and the Ildefonso soils makes up about 30 percent. The Potts soil is on slightly concave positions, and the Ildefonso soil is on the breaks of steeper slopes. The Potts soil is deep and well drained. STRUCTURES AND USES TO BE AUGMENTED: Including the uses described above, water from Griffin Spring No. 3 will be utilized for domestic purposes in five (5) single family residences. This Plan for Augmentation will augment the domestic use in five (5) single family dwellings. 18. WATER RIGHTS TO BE USED FOR AUGMENTATION: Applicants own one-third (1/3) of the water in the Griffin Pond No. 1. All owners of said pond will compensate the stream for the evaporation losses from Griffin Pond No. 1 when the water right described above is not in -priority for Griffin Pond No. 1. Applicants will utilize their one-third interest, less their share of evaporation losses, in said pond for the augmentation of five (5) single family dwellings. 19.
