CONDMONS OF APPROVAL
This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 4oZ-2, untess
approval of a variance has been granted by the State Board of Examiners of Water Well Construction and pump
lnstallation Contractors in accordance with Rule .tg.
Approved pursuant to CRS O7-9o-1az(2) for the expansion of use of an existing well (#1ffiT73:A canceled),
appropriating ground water tributary to the Colorado River, as an alternate point of diversion to the Avalanche
Canal and Siphon, on the condition that the well shall be operated onlv when the West Divide Water Conservancy
District's substitute water supply plan, approved by the State Engineer, is in effect and when a water allotment
contract between the well owner and the West Divide Water Conseruancy District for the release of replacement
water from Ruedi Reservoir is in effect, or under an approved plan for augmentation. WDWCD contract

The use of ground water from this well is limited to ordinary household purposes inside two (2) single family
dwellings, the irrigation of not more than 12,ooo square feet (0.28 of an acre) of home gardens and lawns, and
the watering of domestic animals, all located on a residential site of 7.95 acres described as Lot 2, Lemon Minor
Subdivision, Garfield County. AII use of this wellwill be curtailed unless the water allotment contract or a plan for
augmentation is in effect.
The maximum pumping rate shall not exceed 15 GpM.
The average annual of amount of ground water to be appropriated shall not exceed two (2) acre-feet (651,700
gallons).
A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records
of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division
Engineer upon request.
The well shall be located not more than 2OO feet from the location specified on this permit.
The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court
case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these

RULE 14 WELL TESTING
14'1 General - The provisions of this rule establish minimum standards for the testing of water wells. Every wellconstructed for the purpose of producing ground water shall be tested to determine:a. a yield test for the well; andb- the production rate of the equipment installed when the well is placed into service.
14'2 Well Yield Test - The yield of a well shall be determined as a stabilized production rate where the withdrawalrate and the drawdown do not change by more than 10 % during the last hour of the test. The test shall demonstrate thateither:a. the well is capable of producing the permitted pumping rate for the we1; orb. that the maximum yield of the well is less than the permitteO production rate.
14'3 Responsibility for Well Yield Test - Well construction contractors are responsible for performing the wellyield test and submitting the test data to the State Engineer. lf the construction contractor also insialls the productionequipment, the well yield test may be combined with the production equipment test, provided that the test meets therequirements of Rule '14-2. The construction contractor may forgo the well yield test if he can show that a licensed pumpinstaller will perform the well yield test with the permanent frooriaion equipment within 60 days of his drilling of the well.
14'4 Production Equipment Test - The production equipment installed in wells shall be tested to make sure itis functioning as designed. The test shall demonstrate the production capacity of the equipment as actually installed inthe well or that the production from the well complies with the conditions oi 11 e i"rmit, whichever is less.
14'5 Responsibility for Production Equipment Test - Pump installation contractors are responsible for testing the

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the '
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump tnstallation Rules
2 CCR 4a2-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump lnstallation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(c) for the relocation of an existing welt, permit no. 168773. The old well
must be plugged and abandoned according to the Water Well Construction and Pump lnstallation Rules within
ninety (90) days of completion of the new well. The enclosed wellabanclonment reporHorm must be compteted
affirming thd the old well was plugged and abanctoned.
4) Approved pursuant to the September 24, 1980 letter to the Garfield County Planning Department from this office
regarding the Lemon Minor Subdivision.
5) The use of ground water from this well is limited to ordinary household purposes inside one (1) single family
dwelling, the watering of domestic animals, and the irrigation of not more than one (1) acre of home gardens and
lawns.
6) The return flow from the use of this well must be through an individuat waste water disposal system of the
non-evaporative type where the water is returned to rhe same stream system in which the well is located.
7) The maximum pumping rate shall not exceed 1S GpM.
8) The average annual amount of ground water to be withdrawn shall not exceed 1.S acre-feet.

Applicant, hereby applies to the t/est Djvide water conservancy District, a political subdjvision of the stateof colorado' orqanized pursuant to and existing by vir"tue of c.R.s. 1973, s37-45-101, et seo., (heneinafter" referred to asthe "Djstrict") for an al.lotment contract/lease to beneficially and perpetually use water or waten rights owned, leased, o.hereafter acquired by the District. By execution of this contract/lease and the attached application, Applicant hereby agreesto the following terms and conditions:
l,Jater Riqhts: Applicant shall own water rights at the point of diversion herein 1 awfu1 ly enli tl i ngApplicant to divert waten, which will be supplemented and augmented by water leased herein. If Applicant intends to divertthrough a well, it' must be undenstood by Applicant that no right to divert exists until a valjd well permit is obtained fromthe Colorado Division of Water Resources.
?' 0uantitv: water applied for by the Applicant in the amount set forth above shall be djverted atApplicant's point of divension fr"om the Distr"ict's direct flow water rights, and when waten is unavailable for diversionpursuant to administration by the colorado state Engineer duning peniorls when said direct flowwater night is not in priority,the Distr"ict shall release for the use of Applicant up to said quantity in acre feet per year of storage water owned orcontrolled by the D'istrict lt is understood that any quantity allotted fnorn direct flow, stonage or othenwjse, to theApplicant by the Distrjct will be limited by the priority of the Djstr"ict's decrees and by the physical and legal availabilityof water from District's sources. Any quantity allotted will only be provided so long as water is avajlable and the Applicantfully complies with all of the terms and conditions of this contract/lease. The Distrjct and the Applicant recognize thatsome of the Djstrict's decnees may be in the name of the colorado River water conservation Distr"ict. and the ability of theDistt"ict to allot direct flow rl'ght to the Applicant may be dependent on the consent of the color"ado River water consenvationDistrict lf at an.y time the Applicant determines it requires less waten than the amount herein provided, Applicant may sonotify the District in writing. and the amount of water allotted under this contract/lease shall be reduced permanently inaccordance with such notice. Rates shall be adiusted accordingly in following waten years only.

Furthermore, theDistnict hereby expressly resenves the right to store water and to make exchange releases fnom structures that may be builtor controlled b.y the District in the future, so long as the water service to the Applicant pursuant to this agreement, isnot impat'ned by said action. In the eventthe Applicant develops and adjudicates its own augmentation plan to utiljze the waten allotted hereunden, Applicant sha1lnot be obtigated to pay any amount under Paragraph 18 be1ow. In any event, the Djstrict shall have the right to approve ordisapprove the Appljcant's augmentaticln plan and the Applicant shall provide the District copies of such plan and of al.lpleadings and othen paper"s filed with the water court in the adjudicatjon thereof.

of all water use.
l. Additional Fees and Costs: Applicant agrees to defray any expenses incurred by the District in
connectionwiththeallotmentofwaterrightsher"eunder, including, butnotlimitedto, reimbunsementof1ega1 andengineering
costs incurredinconnectionwithanywaterrightsandadjudicationnecessarytoallowApplicant'suseofsuchallottedwater
rights.
B. Assiqnment: Thjs contnact/lease shall jnure to the benefjt of the heirs, successors or assigns of
the parties heneto. Any assignment of the Applicant's rights under this contnact/lease shall be subject to, and must comply
with, such nequirements as the District may hereafter adopt regartling assignment of contract/lease rights and the assumptionof contract/lease obligations by assignees and successors. Nothing herein shall prevent successors to a pontion of
Applicant's property from applying to the Distr"ict for individual and separate allotment contracts/leases. No assiqnment
shall be recognized by the District except upon completion and filing of proper forms for change of ownership.
Upon the sale of the real property to which this contnact/1ease pentains, Applicant has a duty to make buyer
awane of this contract/lease and proper fonms for change of ownership must be completed.
9. 0ther Rules: Applicant shall be bound by the provisions of the Water Conservancy Act of Colorado;
by the rules and regulations of the Board of Directors of the Djstr"ict; and all amendments thereof and supplements thereto
and by a1l other applicable 1aw.
10. Operation and Maintenance Aqreement: Applicant shall enterinto an "0peration and Maintenance
Agneement" with the District under terms and conditions determined by the board of Directors of the Djstrjct, if and when,
the Boand of said District determines in its sole discretion that such an agreement is required. Said agneement may contain,
but shall not be limited to, pr"ovisions for additional annual monetary consideration for extension of Djstrict delivery
services and for additional administration, operation, and maintenance costs; or fon other costs to the D.istr"ict which mayarise through services made available to the Applicant.
11. Chanqe of Use: The District reserves the exclusive right to review, reappnove on d.isapprove any
proposed change in use of the water allotted hereunder. Any use other than that set for"th herein or any lease or sale of
the waten or water rights allotted hereunder without the pr.ior" wrjtten approval of the District shall be deemed to be a
material breach of this contract/lease.

16. liell Permit: IfApplicant intends to divert thr"ough a wel.l, then Appljcant must provide to District
a copy of Applicant's val.id well permit before District is obligated to de.liver any water heneunder.
17. Measuninq Device or Meter: Applicant agrees to provide at jts own expense an adequate measuring
device on meter to continuously and accurately measune at all t.imes all water diverted pursuant to the terms of Applicant.s
water night and the terms of this contr"act/lease. Applicant agrees to provide accurate readings from such device on meten
to Dlstrict upon District's request. Applicant acknowledges that failune to comply with this paragraph could result in 1ega1
action to terminate Applicant's divension of water by the State of Colorado Djvision of Water Resources.
18. Representations: By executing tht's contnact/lease, Applicant agrees that it.is not relying on any
1ega1 or engineering advice that Applicant may believe has been neceived from the District. Applicant fLrrther acknowiedges
that it has olrtained all necessary lega1 and eng.ineening advice from Appljcant's own sounces other than the Distrjct.
Applicant further acknowledges that the District makes no guarantees, warranties, or assurances whatsoever about the quantity
or quality of water available pursuant to this contract/lease. Should the District be unable to pr"ovide the water contracted
for henejn, no damages may be assessed against the Distrjct, nor may Applicant obtain a refund from the D]strict.
19. Costs of Hater Court Filinq and Auqmentation Plan: Should the District, in its own discretion,
choose to include Applicant's contract/lease henejn in a water cour"t fjling for alternate point of djversion or plan of
augmentation, then Applicant heneby agnees to pay to the Distnict, when assessed, an additional fee nepresenting the
Distt"ict's actual and reasonable costs and fees for Applicant's share of the proceedjngs.
20. Bindinq Aqreement: This agreement shall not be complete nor binding upon the District unless
attached hereto is the fonm entitied "Application and Data Form to Lease Water Fnom 14est Divide Water Consenvancy Distr.ict.'
fu11y completed by Applicant and approved by the District's engineer. Sa.id attachments shall by this neference thereto be
incorponated into the terms of this agr"eement.
21. WATNJNq: iT IS THE SOLE RTSPONSIBILITY OF THE APPLICANT TO OBTAIN A VALID WELL PERMIT OR OTHER I,JATFR
RIGHT IN ORDER TO DIVERT WATER, INCLUDING THE WATER ACQU]RED UNDER THIS CONTRACT/LEAST. IT IS THE CONTINUING DUTY OF THE

A complaint has been received by this office that alleges that a garage located on your property isbeing used as a residential dwelling. A subsequent investigation has revealed that the garage

appears to be occupied and that propane gas service, plumbing and electric service have been
connected to the building.
It is a violation of Garfield County Building and Zoning regulations to allow a garage to be use as
a dwelling.
Please be advised that the provisions of the Garfield County ZorungResolution of 197g, as
amended, and Section 30-28-124 ofthe Colorado Revised-Statut.{ as amended, provide that it is
unlawful to use any building structure, or land in violation of any county zoning iesolution duly
adopted by the Board of County Commissioners. Any person, flrrq or.o.porution found to haveviolated such zoning resolutions is guilty of a misdemeanor and, upon conviction, can be punished
by a fine of not more than $1oo.0o or by imprisonment in the County Jail for l0 days, or 6y bothfine and imprisonment. Each day can be considered a separate violation. The County also hascivil legal remedies available to it, including the initiation of legal proceedings to obtain injunction
or abatement of any unlawful use of land in violation of the County Zoningi.esolution.
