to measure the amount of watcr dclivered to such owner's parcel, and in such event the costs and
expense of maintaining the well, pump and related equipment shall be divided on thc basi" of
volume of water receivcd and so metertd.
+. Operuional Cmts. The ctxts of operation the pump and other equipment shall bc
borne by the owners of each parcel in the same proportion as maintenance expenses as prr:vided
in the previous section.
5. Totes. In the event the existence of this common springr and structures on the
Griffin parc€l should hertinafter increasc the asscssed value of Tracr 52, Parcel 3, and thereby result
in increased property tax, the owncns of the remaining parcels shall equally share in the increased
real properry tax resulting from the existcnce of said well on that parcel.
6. Dismnnection From \aiater Supply. In the event the owner of one or mone of the
above describ€d parcels desires to discontinue thc ux,of the water from the above describcd rryater
system, the owner may disconnect from said water qnstem and upon disconnecting and grving
written notice of such disconnection to the owner or owners of the remaining parcels shall be
relieved of any funher rcsponsibility to pay the costs of said maintenance of said system; provi&d,
however, that such disconnecting owner will remain fully liable for his or hcr share of any
maintenance expenses ino"rrred before such disconnection, and such disconnecting owner shdl not
thereafter be allowed to reconnect to the wiir.er system without having first obtained the writterr
consent of the remaining owners.
7. Water Supply hessurt. In onder to insure rearcnable comparable pnessures to each
pild, the water lines to the respective parcels may be required to be of non uniform diamcter. In
the event thc water produced from said well or spring becomes inadequate to zupply dl of the
demands for water therefrom, the parties utilizing such water shall proportionately reduce thcir
consumption until th"y t . each consuming a rearcnably equal amount of watcr rvhich can
adequately be produced from said well and sprin& in the proportions set forth above. The owners
may elect to drill a new well, or take such other remedial action as is neccssary to improve the
production and distribution of the lr?ter from the common sy$em.
8. Interest May llot Be Sesggd. No pa.-ty hereto shall have any right to sell, assign,
transfer or ciispose of any fractional interest in and to the well, spring, its water, and water righg
and distribution qrstem, except in connection of the transfer of one of the parcels described abovc.
The interest in the spring and the water righu appurtcnant to the paroel, and thr:se obligations, murt
be conveyed with such parcel. In the event that the deed conveying said par.::el is silent, i.t will be
assumed that the interest in the spring and distribution system set out in this agrcement is an
alrpurtenance passing with title to the real property.
