At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in
the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday, the
8.54 day of March A.D-2002, there were present:

whenthe following proceedings, arnong others were had and done, to-wit:

A RESOLUTION CONCERNED WITH TFTE APPROVAL OF A SPECIAL USE PERMIT FOR TED &
MARYLOU MARTIN AND JULIE KUPER TO ALLOW FOR AN ACCESSORY DWELLING UNIT IN
THE A/R/RD ZONE DISTzuCT.
WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received
application from Ted and Marylou Martin and Julie Kuper concemed with a Special Use Permit to allow an
accessory dwelling unit on property located at3919 County Road 233, Rifle, CO, Garfield County;
WHEREAS, the Board held a public hearing on the 4th day of February 2002 upon the question of
whether the above-described Special Use Permit should be granted or denied, at which hearing the public
and interested persons were given the opportunity to express their opinions regarding the issuance of said
Special Use Permit; and
WHEREAS, the Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determination of fact:
1. That proper public notice was provided as required for the hearing before the Board of
County Commissioners.
2. That the hearing before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.

That the application is in compliance with the Garfield County Zoning Resolution of 1978, as
amended.
That for the above stated and other reasons, the proposed Special Use Permit to allow for an
accessory dwelling unit is in the best interest of the health, safety, morals, convenience,
order, prosperity and welfare of the citizens of Garfield County.
NOW, TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that the Special Use Permit be and hereby is approved to allow for an accessory dwelling
unit, upon the following specific conditions:
1. That all representations of the applicant, either within the application or stated at the hearing
before the Board of County Commissioners, shall be considered conditions of approval.
2. That all requirements of Section 5.A3.21ofthe Garfield County ZonrngResolution of 1978,
as a:nended, will be complied with by the applicant. Including the requirement that only
'leasehold interests will be allowed for the accessory dwelling trnit.
3. A11 of the proposed construction will have to meet the Garfreld County Building Code
requirements for the type of construction.
4. A new ISDS permit will be obtained as part of the buitding permit process for the accessory
dwelling unit.
5. Prior to the issuance of the Special Use Permit, the water quatity will be tested by an
approved testing laboratory and meet State guidelines concerning bacteri4 nitrates and
suspended solids and the documentation will be provided to the Planning Department.
6. Prior to isslrance of the Special Use Permit, the applicants will install a 1000 gallon water
storage tank that is connected to the domestic water supply for the houses.
7. AIl conditions of approval must be met within one year of the date of approval of the
appiication. If conditions are not met within one year, the approval will be void.
