Re: Follow-up on Notice of Zoning Violation
Dear Gil:
As we discussed, I have reviewed Resolution No. 86-127, that modified your
Special Use permit approved by Resolution No. 86-127. After reviewing
this file, it.appears that there was no change in the location for farm
equipment parking noted on the enclosed site plan submitted with your
original request. As you will note, the farm equipment parking was
supposed to be located on the west side of the property.
Resolution No. 86-127 added a number of agricultural uses to your
agriculture -related business. Other than the additional uses, everything
approved by Resolutions No. 85-222 and No. 85-32 has remained the same.
There was no change in the locations for farm equipment parking.
Please review this information, along with the previous letter and respond
in the manner we discussed. It appears that, at a minimum, another
modification to your land use permit may be necessary. Thank you for your
prompt response.

Dear Mr. Frontella:
It has come to the attention of this office that farm equipment is parked
in areas not approved by the Special Use permit and on State Highway
right-of-way in Section 9, T6S, R92W of the 6th Principal Meridian. The
property in question is at 32597 U. S. Highway 6 & 24. As a result of
further review by this office, it was determined that farm equipment
parking was approved as a part of the Special Use permit authorized by
Resolution No. 85-32 but use of a larger area represents a violation of
the Garfield County Zoning Resolution of 1978, as amended.
Specifically, Section 3.02 of the Garfield County Zoning Resolution, as
amended, does allow for the approval of an agriculturally related business
in the A/R/RD zone district. Resolution No. 85-32 approved the
agriculturally related business for farm equipment sales and livestock
auction. The farm equipment sales was approved with the understanding
that an area as delineated on the attached map would be included as a
display area for farm equipment sales. Since the operation has exceeded
the area shown on the attached map and appears to have infringed on State
Highway right-of-way, it must be considered a violation of the County's
Zoning Resolution.
Please be advised that the provisions of the Garfield County Zoning
Resolution of 1978, as amended, and Section 30-28-124 (a) -(c) C.R.S., as
amended, provide that it is unlawful to use any building, structure, or
land in violation of any County Zoning Resolution, or amendment, duly
adopted by the Board of County Commissioners. Any person, firm, or
corporation found to have violated such zoning regulations is guilty of a
misdemeanor and, upon conviction, shall be punished by a fine of not more
than $100 or by imprisonment in the County Jail for 10 days, or by both
fine and imprisonment. Each day is considered a separate violation. The
County also has civil legal remedies available to it, including the
initiation of legal proceedings to obtain the injunction or abatement of
any unlawful use of land in violation of the County Zoning Resolution.

If some corrective action on the above noted violation is not taken within
30 days of the receipt of this letter, the Building, Sanitation and
Planning Department will turn all information over to the Garfield County
Attorney's office for legal action, if necessary. Please contact this
office should you have questions or additional information regarding this
zoning violation. Your cooperation in this matter is appreciated.
