Cerise Don DeFord Mildred Alsdorf Chuck Deschenes the following proceedings, , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator among others were had and done, to -wit: RESOLUTION NO. 86-127 A RESOLUTION CONCERNED WITH THE A MODIFICATION OF A SPECIAL USE PERMIT APPLICATION BY GIL FRONTELLA AND JON JULIUS. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received an application from Gil Frontella and Jon Julius for a Special Use permit for an agriculture related business to include farm equipment sales, bulk fuel storage/delivery and pumps, sale of feed, seed, fertilizer and other agricultural related products, service and a veterinary clinic, on the following described atractoeping ofeland: See Exhibit "A" WHEREAS, pursuant to required public notice, the Board conducted a public hearing on November 10, 1986, upon the question of whether the above-described Special Use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use permit; and, WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and required for the hearing Commissioners. public notice was provided as before the Board of County 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed Special Use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado that the Special Use permit be and hereby is authorized permitting the use of the above described tract of land for an agriculture related business to include farm equipment sales, bulk fuel storage/delivery and pumps, sale of feed, seed, fertilizer and other agricultural related products, farm bookkeeping and a veterinary clinic: • • 1. That the applicant provide a copy of an approved State Highway access permit for the proposed uses. 2. That a stop sign be placed at the point of highway access. 3. Bulk fuel storage facilities will comply with all state and local fire code requirements and that any fuel storage tanks laying horizontally with the ends pointing north and south. 4. That a list containing the type and amount of fuels, herbicides and other chemicals stored on the property will be submitted to the Garfield County Emergency Preparedness Coordinator. Subject to an easement for ingress and egress purpose, being 30 feet in width in which the centerline is described as follows: Beginning at a point on the southerly right-of-way of U.S. Highway 6 and 24, whence the Southeast Corner of Section 4 bears North 77033'18" East 2329.48 feet; thence North 04°39'00" East 283.10 feet to the point of termination.
