HomeMy WebLinkAbout4.0 Resolution 2007-3511111 NI Jill MIA! 110.A..„ 45111NMI 11111 Reception#: 722944 05/09/2007 03:58:25 PM 8:1924 P:0722 Jean Alberico 1 of 3 Rec Fee:$0.00 Doc Fee: GARFIELD COUNTY CO STATE OF COLORADO ) )ss County of Garfield ) At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners` Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, the 9th day of April A.D. 2007, there was present: John Martin Larry McCown Tresi Houpt Don DeFord Jean Alberico Ed Green (Absent) , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2007-35 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT TO ALLOW AN ACCESSORY DWELLING UNIT ON A PROPERTY OWNED BY BETTY AND BRUCE COLLINS, DESCRIBED AS 5352 COUNTY ROAD 233, GARFIELD COUNTY PARCEL NO# 217905200359 WHEREAS. the Board of County Commissioners of Garfield County, Colorado ("Board"), has received an application from Bruce and Betty Collins for a Special Use Permit ("SUP") to allow an Accessory Dwelling Unit on their property within the ARRD (Agricultural/Residential/Rural Density) zone district; and WHEREAS, the Board held a public hearing on the 9th day of April, 2007, upon the question of whether the above described SUP should be granted or denied, at which hearing the 'public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. The meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. The application has met the requirements of Special Use (Sections 5:03, 5.03.021 and 9:03) the Garfield County Zoning Resolution of 1978, as amended. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado; that Use Permit for an Accessory Dwelling Unit for a Fiona Lloyd and David gg is hereby approved subject to compliance :with alloferty owned by specific conditions: _e following e 1. All representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless otherwise modified by the Board; 2. All lighting associated with the ADU shall be the minimum amount necessary. All exterior lighting shall be shielded to prevent light trespass on any adjoining property and be downward facing towards the structure; 3. The Applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended, and shall meet all building code requirements; 4. The accessory dwelling unit shall not be conveyed as a separate interest but may be leased; 5. The Applicant shall provide a Garfield County Road and Bridge Driveway Access Permit prior to the issuance of the Special Use Permit; 6. The Applicant shall provide a four-hour pump test demonstrating the ability of the existing well to provide an adequate water supply to the existing and proposed structures; 2 a:! I?
