RELATIONSHIP TO THE COMPREHENSIVE PLAN The site for the exempted lots is located in the Rural Areas District as designated by the 1984 Garfield County Comprehensive Plan's Management Districts. This District is characterized by lands constrained by a lack of municipal water and sewer service, and by areas of localized environmental constraints. DESCRIPTION OF THE PROPOSAL A. Site Description: The site is located approximately five Q|l mrles west of Silt (See location map pg 3A ) Project Description: The proposed accessory dwelling unit would be 1,280 square feet detached from the existing primary dwelling consisting of 2,108 square feet. Access will be directly offCR 216. (See Pg. 3 6 ) Itr. MAJOR ISSUES AND CONCERNS A. Zoning. The proposal meets the criteria of a.four (4) acre minimum lot size, containing a building site with slopes less than 40o/o at least two (2) aces in size, as required by Section 5.03.021, Accessory Dwelling Unit. B. Legal Access: Legal access-wilt-bo the larger parcel will access via CR 261. C. Water: The applicant has, on,site, a well with an approved augmentation plan to allow service to both units. fl D. Sewer: Both units will use a single ISDS. E. State and Local Health Standards. No State or Local health standards are applicable to the application, with the exception of Colorado Department of Health ISDS setback standards, which should be verified by an engineer, as indicated by a plat note. TV. SUGGESTED FINDINGS 1. That proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. 3. That for the above stated and other reasons, the proposed special use permit to allow for an accessory dwelling unit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. V. RECOMMENDATION Staffrecommends APPROVAL, with the following conditions of approval: 1. That all representations of the applicant, either within the application or stated at the meeting before the Board of County Commissioners, shall be considered conditions of approval. 2.
