LEGAL DESCRIPTION TRACT 22, AMENDED FINAL PLAT, TRACTS 5, 11, 12, 21, 22, 27, 28, 37, 38 & 43, ANTLERS ORCHARD DEVELOPMENT COMPANY, SECTION 6, TOWNSHIP 6 SOUTH RANGE 92 WEST OF THE 6"' P.M., GARFIELD COUNTY. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Donald Smith, concerned with a Accessory Dwelling Special Use Permit to allow for the construction of an Accessory Dwelling Unit; WHEREAS, the Board held a public hearing on the 5th day of June, 2000, upon the question of whether the above-described Accessory Dwelling Unit Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: r =7 0 1111111 1111 HMI 11111111 11111111 311111 1111 1111101 565243 06/21/2000 12:25P 81193 P694 M ALSDORF 2 of 3 R 0.00 D 0.00 GARFIELD COUNTY CO 1. That proper posting and public notice was provided as required by law for the hearing before the Board of County Commissioners. 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed Special Use Permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended, NOW, THEREFORE, BE IT RESOLVED >?i3 the Board of County Commissioners of Garfield County, Colorado, that the Accessory Dwelling Unit Special Use Permit be and hereby is approved to allow for the construction of an Accessory Dwelling Unit, upon the following specific conditions: 1. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval. 2. Section 5.03.21 of the Garfield County Zoning Resolution, 1978, as amended be complied with. 3. Prior to the issuance of a Special Use Permit and any building permits for the Special Use, the applicant must demonstrate the following for the well on-site: That a four (4) hour pump test be performed on the well to be used; \Z,./ A well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; The results of the four (4) hour pump test indicating the pumping rate in gallons per minute and information showing drawdown and recharge; A written opinion of the person conducting the well test that this well should be i - adequate to supply water to the number of proposed lots; A An assumption of an average of no less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day; 6. The water quality tested by an independent testing laboratory and meet State guidelines concerning bacteria a nitrates.) 4. Any violation of the terms, interpretations or agreements made or represented to Garfield County by the applicant pertaining to or included in this special use permit, shall be considered a breach of the terms of conditions and the applicant shall cease and desist all activities and may be subject to revocation of the special use permit.
