At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held at the Commissioners' Meeting Room at the Garfield County Courthouse in Glenwood Springs on the 3rd day of November A.D. 1986 , there were present: Larry Schmueser (conflict of interest), Commissioner Chairman Robert Richardson , Commissioner Chairman Pro Tem F.laven J. Cerise , Commissioner • Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Chuck Deschenes , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 86-123 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION BY PUBLIC SERVICE COMPANY OF COLORADO FOR a 230,000 VOLT, ELECTIRC TRANSMISSION LINE AND ASSOCIATED FACILITIES. WHEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Public Service Company of Colorado for a Special Use permit for a 230,000 volt electric transmission line and associated facilities on the following described tract of land: Legal Description: Beginning at Public Service Company's existing. Rifle Substation located in the Southwest corner of Section 16, Township. 6 South, Range 92 West of the 6th P.M., thence Southwesterly and parallel`to the South side of the existing Cameo -Rifle 230,000 volt electric transmission across SE 1/4 SE 1/4 of Section 17; the N 1/2 NE 1/4 and the N 1/2 NW 1/4 of Section 20; the N 1/2 of Section 19 all in Township 6 South, Range 92 West, and the N 1/2 of Section 24, Township 6 South, Range 93 West to a point near the North-South centerline of said Section 24; thence Northwesterly to the Cogeneration Technology Development Corporation Substation located approximately 1700 feet east and 500 feet, south of the Northwest Corner of said Section 24. (in the State of Colorado and the County of Garfield); and WHEREAS, pursuant to required public notice, the Board held a public hearing on the 20th day of October, 1986, upon the question of whether the. above-described Special Use permit should be granted or denied: WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners; 2. That the hearing before the Board of County Commisc nerswas extensive and complete, that all pertinent facts, inters and issues were submitted and that all interested parties were heard. at that hearing; 3. That the proposed special use conforms to Section 5.03 concerning:. the Approval or Disapproval of a Petition for a Special Use, of the Garfield County Zoning Resolution; 4. That for the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. BOOK 698 PA3E4O5 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners. of Garfield County, Colorado that a Special Use permit be and hereby is authorized permitting the use of the above described tract of land for a 2.30,000 volt electric transmission line and associated facilities upon the following specific conditions: 1. That all proposals of the applicant shall be considered conditions of approval, unless stated otherwise by the Board. 2. The applicant shall have 120 days from the date of the Resolution - of Conditional Approval to meet all conditions set forth in the Resolution. The Special Use permit shall be issued when all conditions are met and shall expire 120 days after issuance unless use has commenced.
