This letter is in reference to a letter that Tamara Pregl, Garfield County Planner sent to
you back on May 5, 2003 related to the Board of County Commissioners approving your )
request of a Special Use for an Accessory Dwelling unit on your property. ?
The Special Use was approved with conditions which have to be met before the actual
Special Use Permit can be issued. There were four conditions of approval and it appears
that we are still waiting for information related to the second condition. That condition
reads "prior to issuance of the actual Special Use Permit, the Applicant shall provide a
four (4) hour pump test on the existing well. The well shall at a minimum provide 100
gallons of water per person, per day assuming an average of no less than 3.5 people per
dwelling and Applicant shall provide a water quality test for the existing well.
Please provide our office with the above information so we can issue the actual Special
Use Permit and close out this file. No building permit can be issued until the special use
permit is issued.
Your prompt attention in this matter is appreciated. If you have any questions please give
us a call. I have included a copy of Tamara's original letter for your review.

As you are aware, at the public hearing this afternoon, the Board of County Commissioners moved to
approve the Special Use Permit application to change the status of the existing residence to an accessory
dwelling unit, subject to the following conditions:
1. All representations of the applicant, either within the application or stated at the hearing before the
Board of County Commissioners, shall be considered conditions of approval.
2. Prior to the issuance of the actual Special Use Permit, the Applicant shall:
a. Provide a four (4) hour pump test on the existing well. The well shall at a minimum provide
100 gallons of water per person, per day assuming an average of no less than 3.5 people per
dwelling.
b. Provide a water quality test for the existing well.
3. Only leasehold interests in the ADU shall be allowed. The unit may not be sold separately.
4. Any changes to the Special Use Permit [under the name Gleason] granted by the Board of County
Commissioners to the property in 1999, for the storage area to allow recreational vehicle storage,
will require a new Special Use Permit.
Once condition #2 above has been met, the special use permit can be issued. No building permit will be
issued until the special use permit is issued. Please do not hesitate to contact me if you have any questions.
I have scheduled the Resolution of approval before the Board of County Commissioners on Monday, May
12, 2003, at 8:15 a.m. in the Garfield County Plaza Building, Commissioners Hearing Room, Suite 100,

a ADU on the property based on Goggle 2009. 2179-929-300-610. Probably did
not drill a new well.

RE: Kimball Mountain Logging Special Use Permit
Dear Ken,
As you know, the Board of County Commissioners reviewed the logging progress report submitted
in the above -referenced matter. Based on information obtained by this Department and reviewed by
the Board, Garfield County has incurred costs for clean-up of damage attributable to the logging
operation.
According to the Road and Bridge Department, costs for clean-up are estimated to total $1647.41.
Per your agreement with the Board of County Commissioners and King Lloyd, Road and Bridge
Department Director, clean-up costs will be billed to you for payment. Upon payment, please obtain
receipts and submit copies to this Department demonstrating your compliance with these conditions.
Additionally, the Board requires information concerning the efficiency of your proposed erosion
control plan. As you implement these methods, please update the County with information
demonstrating compliance with the erosion control measures detailed within the logging plan.
Thank you for your assistance in this matter. I will soon be reviewing the recently -submitted Special
Use Perini . . 'lication materials and will contact you concerning the application as soon as possible.

RE: Colorado Timber and Land Logging Application
Dear Shirley,
Pursuant to our conversation of December 18, I am sending the information you requested. The
subject lands are zoned R/L - Resource Lands and, as you will see, extraction is allowed as a
Conditional Use within three of the four sub -classifications and as a Special Use within the fourth
classification (gentle slopes and lower valley floor). It appears that the lands you have designated for
logging, by definition - extraction, are within the scope of a conditional use permit. However, the
areas designated for helicopter delivery, loading and trucking appear to be classified gentle slopes and
lower valley floor, wherein, extraction requires a special use permit.
This situation creates an interpretative dilemma in that there are different regulatory requirements for
each type of permit. Although I did advise that a conditional use permit should be the direction you
proceed, the special use permit would be more inclusive, yet it requires the submittal of additional
information and, by definition, is subject to denial. Conditional uses have been interpreted to not
being subject to denial, but may be approved with conditions.
My advice is to apply for the appropriate permits for the subject lands. In other words, seek a
conditional use permit for the plateau/escarpment/talus slopes lands and a special use permit for the
gentle slopes and lower valley floor areas. These permits could be heard concurrently and would be
subject to the $525 fee, since a portion of the permitting request does fall under the special use
domain.

RE: Special Use Permit Application

Dear Shirley:
The Garfield County Planning Department has completed its initial review of the above -referenced
application and has determined the application to be incomplete. The following items should either
be addressed in more detail, are confusing, or are missing entirely:
1] The conditional approval of logging within Section 7, T7S, R100W of the 6th P.M. requires
the submittal of a report detailing harvesting activities, to date, and compliance with all other
approval conditions. This report must be submitted prior to additional acreage being
permitted for harvesting. The Board of County Commissioners must review this report in a
public forum. See condition #6 of Resolution 97-85, attached.
2] Variously throughout the application you provide different descriptions of land that would
be subject to logging. These descriptions must be consistent. See the application itself, the
Timber Harvesting Plan title page, and page 1, and the map of proposed "Timbered Areas."
3] The Timber Harvesting Plan refers consistently to County Road 205, which is southwest of
the subject lands. I suspect you are actually referring to County Road 204. Please verify
which road would be utilized and amend the Plan.
4] Is this type of logging (helicopter) still considered to be experimental?
5] The Plan mentions a total removal of up to 60% of the timber; however, the helicopter
landing information suggests 70% removal. Which is accurate?
6] Attach any other information that may be useful in describing the proposed activity.
Upon further review, the subject lands are zoned Resource Lands (R/L), which allows extraction as
a conditional use. As such, a conditional review requires a base fee of $250 and, as an industrial

operation, 10 copies of the application must be submitted. Please include the noted items and submit
the required number of copies.
The previous, conditional approval requires a report be submitted, as detailed in Item #1 above, prior
to consideration of expansion of the logging permit. In interpretation of this condition, this must be
satisfied before the County Commissioners can consider this application. The application is being
returned to you, due to the noted deficiencies, and will not receive further consideration until these
items are addressed. If you feel this letter is in error, or if you decide to proceed without addressing
these items, please resubmit the application.
