Application Requirements: These items must be submitted with the application
1] Plans and specifications for the proposed use including the hours of operation, the amount of vehicles
accessing the site on a daily, weekly and/or monthly basis, and the size of any existing or proposed
structures that will be utilized in conjunction with the proposed use. Please submit this information
in narrative form and be specific.
2] If you will be using water or will be treating wastewater in conjunction with the proposed use, please
detail the amount of water that would be used and the type of wastewater treatment. If you will be
utilizing well water, please attach a copy of the appropriate well permit and any other legal water
supply information, including a water allotment contract or an approved water augmentation plan.
3] A map drawn to scale portraying your property, all structures on the property, and the County or State
roadways within one (1) mile of your property. If you are proposing a new or expanded access onto
a County or State roadway, submit a driveway or highway access permit.
4] A vicinity map, showing slope of your property, for which a U.S.G.S. 1:24,000 scale quadrangle map
will suffice.
5] A copy of the appropriate portion of a Garfield County Assessor's Map showing all public and private
landowners adjacent to your property. Include a list of all property owners and their addresses.
6] Attach a copy of the deed and a legal description of the property. If you are acting as an agent for the
property owner, you must attach an acknowledgment from the property owner that you may act in
his/her behalf.
7] For all applications pertaining to airports, the oil and gas industry, power generation and/or
transmission industry, or any other classified industrial operation, you must submit an impact
statement consistent with the requirements of Sections 5.03, paragraphs I thru 3; 5.03.07, inclusive;
and 5.03.08, inclusive.
The consideration of this proposed Special Use will require at least one (I) public hearing, for which public
notice must be provided. The Planning Department will mail you information concerning this hearing(s),
approximately 30 days prior to the scheduled hearing. You will then be required to notify, by certified return
receipt mail, all adjacent landowners and publish the notice provided by the Planning Department, in a
newspaper of general circulation. Both these notices must be mailed/published at least 15 days prior to the
public hearing. The applicant shall bear the cost of mailing and publication and proof of mailing and
publication must be submitted at the time of the public hearing.

coordinating the processing of the application. I have reviewed it for completeness and have
found that the submittal lacks the following:
• A copy of the well permit (only a change in ownership was provided, not the actual well
permit).
• A copy of any other legal supply information such as an approved water augmentation plan.
• A copy of an approved driveway permit from the Garfield County Road & Bridge
Department if you are planning a new access onto a County Road.
I have enclosed a copy of the application for your information. Once I receive this information, I
will arrange a time with the Board of County Commissioners for a public hearing and will be

Dear Debra,
This letter is to inform you that your request for a special use permit will be heard before the
Board of County Commissioners at 1:15 p.m., on Monday, September 10, 2001, in the Garfield
County Courthouse, Commissioners Hearing Room, Suite 301, 109 8t' St. , Glenwood Springs.
Prior to the hearing you will receive a staff report and an agenda which will indicate
approximately in what order your hearing will take place.
Enclosed with this letter is a public notice form that must be published once in a newspaper of
general circulation in the area and sent by certified return receipt mail to all property owners
adjacent to the property in question at least fifteen (15) days but not more than thirty (30) days
prior to the date of the hearing, this includes public lands. We suggest sending the notice earlier
than the required fifteen (15) days, to insure the return of the green return -receipt and be advised
that the date of the hearing can not be considered as one of the fifteen (15) days prior to the
hearing. You must provide the proof of publication and the green and white certified mail
receipts as evidence at the hearing, or the hearing will have to be rescheduled.
Failure to complete the above stated noticing requirements will require re -noticing for a future
hearing. It is your responsibility to ensure the legal description you provided to this office,
included in this notice, is accurate. If you have any questions about the public notice process,
please contact this office.

TAKE NOTICE that Debra Englehardt has applied to the Board of County Commissioners, Garfield
County, State of Colorado, to request a special use permit, pursuant to Section 3.02.03 the Garfield
County Zoning Resolution of 1978, as amended, in connection with the following described property
situated in the County of Garfield, State of Colorado; to -wit:

The special use permit would allow an accessory dwelling unit to be located on the property.
All persons affected by the proposed special use are invited to appear and state their views, protests
or support. If you can not appear personally at such hearing, then you are urged to state your views
by letter, as the Board of County Commissioners will give consideration to the comments of
surrounding property owners and others affected in deciding whether to grant or deny the request
for the special use.
The public hearing on the application has been set for the 10th day of September, 2001, at 1:15 p.m.,
in the County Commissioners Chambers, Garfield County Courthouse, Suite 301, 109 8th Street,
Glenwood Springs, Colorado.
The application may be reviewed at the County Courthouse, 109 8th Street, Suite 303, Garfield

Wanting to put a modular home on my property for my parents they don't drive but
probably 1 vehicle will be driven on the property a day the one planned on is a 1203 ap-
prox. sq. ft 28x44 see floor plan.
Working with a engineer Paul at Resources and Russell George attorney for augmen-
tation so that we can hook to our existing well .
We will be installing a leach field and septic.

The Modular will be skirted with block with stucco on outside and be sitting on a
footer with concrete and concrete pad in middle with tie downs in place

This well shall be used in such a way as to cause no material injury to existing water rights_ The issuance of this permit
does not assure the applicant that no injury will occur to another vested water right or preclude another owner of a vested
water right from seeking relief in a civil court action.
The construction of this well shall be in compliance with the Water Well Construction Rules 2 CCR 402-2, unless approval
of a variance has been granted by the State Board of Examiners of Water Well Construction and Pump Installation
Contractors in accordance with Rule 18.
Approved pursuant to CRS 37-90-137(2) on the condition that this well is operated in accordance with the Debra Kay
Engelhardt Augmentation Plan approved by the Division 5 Water Court in case no. 2000CW10. If this well is not operated in
accordance with the terms of said decree, it will be subject to administration including orders to cease diverting water.
Approved for the expansion of use of an existing well, permit no. 112035 (cancelled). This well is known as the
Engelhardt Well.
5) The use of ground water from this well is limited to ordinary household purposes inside two (2) single family dwellings,
irrigation of 2,000 Square feet of lawns and gardens, and the watering of two head of livestock.
3) The maximum pumping rate of this well shall not exceed 15 GPM.
7) The annual withdrawal of ground water from this well shall not exceed 0.934 acre-foot.
8) The return flow from the use of this well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case
number(s). as appropriate. The owner shall take necessary means and precautions to preserve these markings.
10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of oli
diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon
request
11) This well shall be located not more than 200 feet from the location specified on this permit.

FINDINGS OF FACT, RULING OF REFEREE AND DECREE OF COURT
Debra Kay Engelhardt ("Applicant") filed an Application for Underground Water
Right, Storage Water Right and Plan for Augmentation on January 28, 2000. In accordance
with C.R.S. § 37-92-203(7), the Water Judge referred the subject Application to the Water
Referee for Water Division No. 5, State of Colorado.
The Referee has made such investigations as are necessary to determine whether or
not the statements in the Application are true, has become fully advised with respect to the
subject matter of the Application, and has consulted with the Division Engineer for Water
Division No. 5. He hereby makes the following determinations and ruling as the Referee
in this matter.
FINDINGS OF FACT
1. The statements in the Application are true.
2. Debra Kay Engelhardt is the Applicant herein.
3. Neither the subject water rights nor their sources are located within a designated
groundwater basin.
4. No Statements of Opposition were filed in this matter and the time for filling
Statements of Opposition has expired.

5. Claim for Underground Watsr_ fight. Applicant claims an underground water
right as follows:
a. Name of Structure: Engelhardt Well
b. Legal description of Well: A well located in the NW%NE%, Section 34,
'Township 6 South, Range 92 West, 6th P.M. at a point 900 feet from the North
line and 2,200 feet from the East line of said Section 34.
c. Source: Alluvial formation tributary to Dry Hollow Creek, tributary to the
Colorado River.
cl. Depth: 160 feet.
e. Date of appropriation: September 9, 1999
f. How appropriation was initiated: By use of well for domestic purposes and by
formation of intent to expand the uses of the well.
g. Date water applied to beneficial use: September 9, 1999
h. Amount claimed and uses: 0.033 c.f.s. (15 g.p.m.), absolute for ordinary
household purposes inside .one single family dwelling, and .conditional for
ordinary household purposes inside a second single family dwelling, irrigation
of 2,000 square feet of lawns and gardens, and stockwatering for two head of
livestock.
i. Delayed impacts: Delayed impacts from the well are addressed in Exhibit A-1
and A-2_
j. Annual Diversions: Total annual diversions are limited to 0.934 A.F. with
depletions of 0.243 A.F.
k. Remarks: Irrigation over 2,000 square feet will come from direct surface
diversions.
6. Claim for Storage- Water Rigilt. The Applicant claims a storage water right as
follows:
a. Name of Reservoir: Engelhardt Pond
b. Legal Description: Location of Damn: the centerline of the dam is in the
NW%4NEJ, Section 34, Township 6 South, Range 92 West, 6' 1.M_, at a point
800 feet from the North line and 2,250 feet from the East line of said Section 34.

7. Plan for Augmentation. Applicant claims a plan for augmentation as follows:
a. Name of structure to be augmented: Engelhardt Well.
b. Are there other water rights diverted from this structure? No
e. Previous decree for water right to be used for augmentation: Engelhardt pond
as described herein.
d. %listoric use: The pond has been historically used for stockwater, wildlife
propagation and fire protection. A map of ail structures and property
boundary is attached as Exhibit C
e. Statement of plan for augmentation: This plan for augmentation augments
consumptive use depletions from the Engelhardt well claimed herein. Total
demand and consumptive use amounts are contained in Table 1. The
Engelhardt well will divert water under its own water right while in priority.
During the winter season or during the snowmen runoff period when no call
exists on Dry Hollow Creek below the subject Engelhardt well and Engelhardt

pond nor on the Colorado River at Cameo, water available in the unnamed
tributary to Dry Hollow Creek will be stored in the Engelhardt pond. During
periods of a call on the Engelhardt well either from Dry Hollow Creek or the
Colorado River, water will be released from Engelhardt pond in accordance
with the schedule in Table 2.
When implemented, the augmentation plan described above will protect senior
downstream water rights from injury resulting from out -of -priority diversions at the
Engelhardt well.
RULING OF REFEREE AND DECREE OF COURT
The Referee has examined the information submitted by the Applicant and has
become advised with respect to the subject matter of the Application.
He Rules as follows:
1. The foregoing Findings are incorporated herein and made part of the Ruling of
Referee.
2. The Court has exclusive jurisdiction over the subject matter of these proceedings
pursuant to C.R.S. § 37-92-203, and over all persons or entities affected thereby,
whether or not they have appeared.
3. The Application for Underground Water Right, Storage Water Right and Plan for
Augmentation proposed by Applicant is such as is contemplated by law. If
implemented and administered in accordance with this decree, the Underground
Water Right, Storage Water Right and Plan for Augmentation described herein will
provide water to the Applicant without adversely affecting the owners or users of
vested water rights or decreed conditional water rights. The plan for augmentation
described herein may be lawfully decreed by this Court.
4. The State and Division Engineer may lawfully be required under the terms of this
ruling to:

a. Administer the plan for augmentation in the manner set forth herein.
b. Refrain from curtailing out -of -priority diversions of the Applicant's augmented
water rights when the depletions are offset by the operation of the plan for
augmentation approved herein.
5. The Referee rules that the Underground water Right, Storage Water Right and Plan
for Augmentation described herein are approved.
6. Pursuant to C.R.S. § 37-92-305(8), the State Engineer shall curtail all out -of -priority
diversions, the depletions from which are not so replaced as to prevent injury to
vested water rights.
7. The Applicant shall install measuring devices, provide accounting, and supply
calculations regarding the timing of depletions as required by the Division Engineer
for the operation of this plan. The Applicant shall also file an annual report with the
Division Engineer by November 15th of each year summarizing diversions and
replacements made under this plan.
8. Should Applicant's property be subdivided, Applicant shall establish a homeowners'
association that shall be responsible for ensuring the teuns and conditions of this
decree are met.
9. In consideration of the specific findings and conclusions made herein and in
conformance with C.R.S. § 37-92-304(6)(1990), as amended, the approval of the plan
for augmentation decreed herein shall be subject to reconsideration by the Water
Judge on the questions of injury to the vested water rights of others for a period of
five (5) calendar years after the augmentation plan becomes operational. If no
petition for reconsideration is filed within those five (5) years, retention of jurisdiction
for this purpose shall automatically expire.
10. Until the conditional water rights awarded herein are made absolute or otherwise
disposed of, Applicant shall file an Application for Finding of Reasonable Diligence
in every sixth calendar year after the calendar year in which the conditional rights are

SPECIAL PROVISIONS FOR EXCAVATION OF ROAD SURFACE AND INSTALLATION

1) ANY OVERSIZED MATERIAL (LARGER THAN 10 INCHES IN DIAMETER), THAT
IS NOT UTILIZED IN BACKFILL WILL BE HAULED OFF BY PERMITTEE. FURTHER,
ANY FROZEN MATERIAL WILL BE REMOVED FROM SITE BY PERMITTEE.
2) WHEN A PAVED OR CHIPPED SURFACE IS CUT, IT IS TO BE REPLACED WITH
A MINIMUM THREE INCH (3") HOTMIX ASPHALT PATCH. A TEMPORARY PATCH WITH
COLD MIX ASPHALT WOULD BE ALLOWED. WHICH WOULD BE REPLACED WITH HOTMIX
ASPHALT WHEN THE WEATHER OR AVAILABILITY OF MATERIALS ALLOWS THE WORK
TO BE COMPLETED. AN ASPHALT OR CHIPPED SURFACE CUT WOULD REQUIRE THE
ROAD TO BE STRAIGHT CUT AND SQUARED BY MEANS OF A PAVEMENT CUTTER OR
SAW. A CHIPPED SURFACE CUT WILL REQUIRE A SEAL COAT OF THE PATCH WHICH
WILL BE FULL WIDTH OR HALF WIDTH OF ROADWAY WHEN TRENCHES RUN WITH THE
ROAD. FOR TRENCHES ACROSS THE ROAD, THE EDGES OF THE SEAL COAT WILL.
OVERLAP THE EXISTING EDGE. ALL SEALCOATS WILL OVERLAP EDGES BY A TWO
FOOT MINIMUM TO INSURE AN ADEQUATE SEAL OVER THE UNDISTURBED PORTION
OF THE ROADWAY IN THE VICINITY OF THE EXCAVATION. ASPHALT HOTMIX OR
COLD PATCHES WILL BE COMPLETED IN A MAXIMUM OF FIVE WORKING DAYS,
WEATHER PERMITTING.
3) WHEN POSSIBLE ALL INSTALLATIONS SHOULD AVOID THE TOP EDGE OF A FILL SLOPE.
4) INSTALLATIONS IN DRAINAGES SUBJECT TO FLASH FLOODING, WILL HAVE A MINIMUM
BURY OF 4 FEET DEEPER THAN NORMAL FLOW LINE AT NEAREST ABUTMENT. WINGWALL,
OR CULVERT.
5) INSTALLATIONS AT CULVERT CROSSINGS WILL BE BURIED BENEATH THE CULVERT
WITH A MINIMUM SEPARATION OF 18 INCHES BETWEEN INSTALLATION AND THE
BOTTOM OF THE CULVERT.
6) OPEN TRENCHES ADJACENT TO THE TRAVELED ROADWAY SHALL BE BACKFILLED
DAILY TO WITHIN 100' OF THE WORKING AREA OF THE TRENCH. AND SHALL BE
BARRICADED WITH WARNING DEVICES AFTER OARK. A 3 FT. HIGH ORANGE PLASTIC
FENCE WILL BE INSTALLED DAILY TO KEEP LIVESTOCK OUT OF THE OPEN TRENCH
AFTER HOURS.
7) IN AREAS BEING DISTURBED WHERE VEGETATION IS ESTABLISHED. RESEEDING WITH
A MIXTURE EITHER BY BROADCASTING, DRILLING, AND MULCHING WITH SEED MIXTURES
SUITABLE TO THE CLIMATIC CONDITIONS OR EXISTING VEGETATION WILL BE
PERFORMED. USE ONLY CERTIFIED WEED—FREE SEED. NOXIOUS WEED CONTROL
WILL BE ONGOING ALONG WITH REVEGETATION.
8) THE PERMITTEE SHOULT CH CK THE R—O—W OF SURROUNDING LANDOWNERS

FIFTH: The Applicant shall assume responsibility for the removal or
clearance of snow, ice or sleet upon any portion of the driveway ap-
proach(es) even though deposited on the driveway(s) in the course of
the County snow removal operations.
SIXTH: In the event it becomes necessary to remove any right-of-way
fence, the posts on either side of the entrance shall be securely
braced before the fence is cut to prevent any slacking of the remain-
ing fence, and all posts and wire removed shall be turned over to the
District Road Supervisor of the Board of County Commissioners.
SEVENTH: No revisions or additions shall be made to the driveway(s)
or its appurtenances on the right-of-way without the written permis-
sion of the Board of County Commissioners.

SPECIFICATIONS
1. A driveway approach is understood to be that portion of the high-
way right-of-way between the pavement edge and the property line which
is designed and used for the interchange of traffic between the road-
way pavement and the abutting property.
2. At any intersection, a driveway shall be restricted for a suf-
ficient distance from the intersection to preserve the normal and safe
movement of traffic. (It is recommended for rural residence entrances
that a minimum intersection clearance of 50 feet be provided and for
rural commercial entrances a minimum of 100 feet be provided.)
3. All entrances and exits shall be so located and constructed that
vehicles approaching or using them will be able to obtain adequate
sight distance in both directions along the highway in order to maneuver
safely and without interfering with highway traffic.
4. The Applicant shall not be permitted to erect any sign or display
material, either fixed or movable, on or extending over any portion
of the highway right-of-way.
5. Generally, no more than one approach shall be allowed any parcel
or property the frontage of which is less than one hundred (100) feet.
Additional entrances or exits for parcels or property havino a frontaae
in excess of one hundred (100) feet shall be permitted only after
showina of actual convenience and necessity.
6. All driveways shall be so located that the flared portion adjacent
to the traveled way will not encroach upon adjoining property.
7. No commercial driveway shall have a width greater than thirty (30)
feet measured at right angles to the centerline of the driveway, except
as increased by permissible radii. No noncommercial driveway shall
have a. width greater than twenty (20) feet measured at right angles to
the centerline of the driveway, except as increased by permissible radii.
8. The axis of an approach to the road may be at a right angle to the
centerline of the highway and of any angle between ninety (90) degrees
and sixty (60) degrees but shall not be less than sixty (60) degrees.
Adjustment will be made according to the type of traffic to be served
and other physical conditions.
9. The construction of parking or servicing areas on the highway
right-of-way is specifically prohibited. Off -the -road parking facil-
ities should be provided by commercial establishments for customers
vehicles.
10. The grade of entrance and exit shall slope downward and away from
the road surface at the same rate as the normal shoulder slope and for
a distance equal to the width of the shoulder but in no case less than
twenty (20) feet from the pavement edge. Approach grades are restricted
to not more than 10 percent (107.).
11. All driveways and approaches shall be so constructed that they
shall not interfere with the drainage system of the street or highway.
The Applicant will be required to provide, at his own expense. drain-
age structures at entrances and exits which will become an integral
part of the existing drainage system. The dimensions of all drainage
structures must be approved by the Board of County Commissioners or
their representative prior to installation.
NOTE: This permit shall be made available at the site where and when work is
being done. A work sketch or drawing of the proposed driveway(s) must accompany
application. No permit will be issued without drawing, blueprint, or sketch.

1, DEBRA ENGELHARDT (herein called "Applicant"), hereby reauests
Permission and authority from the Board of County Commissioners to construct a
driveway approach(es) on the right-of-way of Garfield County Road Number 326
adjacent to Applicant's property located on the EAST side of the road, a
distance of 1/10 mile(s) from INT CR 331 & CR 326 for the purpose of
obtaining access to DRIVEWAY PERMIT

Applicant submits herewith for the consideration and approval
of the Board of County Commissioners, a sketch of the proposed instal-
lation showing all necessary specification detail including (1) front-
age of lot along road, (2) distance from centerline of road to
property line, (3) number of driveways requested, (4) width of pro-
posed driveway(s) and angle of approach, (5) distance from driveway
to road intersection, if any, (6) size and shape of area separating
driveways if more than one approach, and (7) setback distance of
building(s) and other structures or improvements.
GENERAL PROVISIONS
FIRST: The Applicant represents all parties in interest, and affirms
that the driveway approach(es) is to be constructed by him for the
bona fide purpose of securing access to his property and not for the
purpose of doing business or servicing vehicles on the road richt-of-way.
SECOND: The Applicant shall furnish all labor and materials, perform
all work, and pay all costs in connection with the construction of the
driveway(s) and its appurtenances on the right-of-way. All work shall
be completed within 30 days of the Permit date.
THIRD: The type of construction shall be as designated and/or approved
by the Board of County Commissioners or their representative, and all
materials used shall be of satisfactory quality and subject to inspec-
tion and approval of the Board of County Commissioners or their
representative.
FOURTH: The traveling public shall be protected during the instal-
lation with proper warning signs and signals and the Board of County
commissioners and their duly appointed agents and employees shall be
held harmless against any action for personal injury or property
damage sustained by reason of the exercise of the Permit.
