Debra Kay Englehardt 4280 County Road 331, Silt, CO 81652. Located south of Silt near the Chipperfield Estates Subdivision. Approximately 5 acres Private Drive to Chipperfield Lane (CR 326) Well ISDS A/R/RD I. RELATIONSHIP TO THE COMPREHENSIVE PLAN According to the Garfield County Comprehensive Plan of 2000, this site lies in an existing subdivision. There is no suggested density. II. DESCRIPTION OF THE PROPOSAL A. Site & Project Description: An existing wood frame house currently occupies the western end of the approximately five (5) acre site. The existing house is served by a driveway to County Road 331 (Dry Hollow). Dry Hollow Creek bisects the property. The applicant proposes to place a 1,383 square foot second dwelling unit on the eastern portion of the property for aging relatives. The new modular unit would be served by a driveway to County Road 326 (Chipperfield Lane). A new gravel driveway has already been installed. III. MAJOR ISSUES AND CONCERNS A. Conditional and Special Uses: Special Uses are subject to the standards set forth 1 off in Section 5.03 of the Zoning Resolution. This section states that utilities adequate to provide water and sanitation service, street improvements, and design of the proposed use to minimize impact through various means shall be provided. Impacts are generally expected to be minimal due to the large lot size. These issues are discussed in detail in the body of this report. B. Zoning: While Dry Hollow Creek is not covered by FEMA maps, the applicant should be aware of any flooding potential and position the building out of harm's way. At a minimum, the accessory dwelling unit must be placed at least thirty (30') feet from the high water mark of the creek (section 5.05.02). An accessory dwelling unit is a special use in the A/R/RD zone district pursuant to Section 3.02.03 of the Zoning Resolution of 1978, as amended. It must meet the standards set forth in Section 5.03.021, as follows: (1) The minimum lot size shall be four (4) acres containing a building site with slopes less than 40% at least two (2) acres in size. (2) The gross floor area for residential use occupancy shall not exceed 1500 sq. ft. (3) Approval from the subdivision homeowners association and/or allowed by covenant if applicable. (4) Proof of a legally adequate source of water for an additional dwelling unit. (5) Compliance with the County individual sewage disposal system regulations or proof of a legal ability to connect to an approved central sewage treatment facility. (6) Only leasehold interests in the dwelling units is allowed The relatively flat lot exceeds the minimum lot size standard and the a.d.u. is within the maximum square footage limitation of 1,500 square feet. Th�� application lacks written approval from the Homeowners' Associatiorfa14o ing an a.d.u. The existing well will supply water and a new Individual Sewage Disposal System (ISDS) will handle wastewater. The applicant should understand that the a.d.u. may be leased but may not be conveyed as a separate interest in the future. C. Access: The proposed access is a recently installed driveway from Chipperfield Lane. The application includes a copy of an approved driveway permit from the Road and Bridge Department. Based on this information, the proposed access appears to be both legally and physically adequate. D. Water: The existing house was served by the Englehardt well, permit 11112035, drilled to a depth of 160 feet. The applicant has obtained permission to expand 2 4 the use of the well and thus permit #055921 has replaced the original well permit. The applicant appears to have the necessary legal water rights. The new well permit allows for domestic water use within a maximum of two (2) single family dwellings, irrigation of not more than 2,000 square feet of lawn and garden, and the watering of two head of livestock. The well must be operated in accordance with the terms of the decree. According to the augmentation plan, the Englehardt well will divert water under its own water right while in priority. During periods when no call exists (winter and snowmelt runoff) water available in a unnamed tributary to Dry Hollow Creek will be stored in the Engelhardt pond, which has a total capacity of 1.5 acre feet. During periods of call (on either Dry Hollow Creek or the Colorado River) water will be released from the Englehardt pond. The application does not contain a copy of a pump test or water quality test, as is commonly required. This information will need to be provided prior to issuance of a special use permit. E. Sewer: Both the primary and accessory dwelling units are/will be served by individual sewage disposal systems. The applicant shall meet the Colorado Department of Public Health ISDS standards. No other State and Local health standards are applicable to the application. IV. SUGGESTED FINDINGS 1. That proper public notice was provided as required for the hearing before the Board of County Commissioners, 2. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that meeting. That for the above stated and other reasons, the proposed special use permit is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application is in conformance with the Garfield County Zoning Resolution of 1978, as amended. V. That all representations of the applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval; 2. That the applicant shall meet all requirements of the Garfield County Zoning Resolution of 1978, as amended, (including but not limited to the live stream setback) and shall meet all building code requirements; That all State and Local health standards be met and that the applicant acquire an adequate ISDS permit at the building permit stage; 3. That the gross floor area of the accessory dwelling unit shall not exceed 1,500 square feet; That the accessory dwelling unit shall not be conveyed as a separate interest but may be leased; 4. That it is the applicant's responsibility to comply with any applicable covenants or Homeowners' Association rules; The special use permit will not be issued until proof of written approval of the accessory dwelling unit by the Homeowners Association, or proof that no covenants are applicable, be submitted to the Planning Department; 5. That, prior to issuance of the special use permit, that the following information be provided: 1. That a four (4) hour pump test be performed on the well to be used; 2. A well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; 3. The results of the four (4) hour pump test indicating the pumping rate in gallons per minute and information showing drawdown and recharge; 4. A written opinion of the person conducting the well test that this well should be adequate to supply water to two (2) dwelling units; \"Szp 5. An assumption of an average of no less than 3.5 people per dwelling unit, `' using 100 gallons of water per person, per day; 5. The water quality be tested by an independent testing laboratory and meet State guidelines concerning bacteria and nitrates. 6. That this approval shall be valid until 9/10/02. A driveway approach is understood to be that portion of the high- way right-of-way between the pavement edge and the property line which is designed and used for the interchange of traffic between the road- way pavement and the abutting property. 2. At any intersection, a driveway shall be restricted for a suf- ficient distance from the intersection to preserve the normal and safe movement of traffic. (It is recommended for rural residence entrances that a minimum intersection clearance of 50 feet be provided and for rural commercial entrances a minimum of 100 feet be provided.) 3. All entrances and exits shall be so located and constructed that vehicles approaching or using them will be able to obtain adequate sight distance in both directions along the highway in order to maneuver safely and without interfering with highway traffic. 4. The Applicant shall not be permitted to erect any sign or display material, either fixed or movable, on or extending over any portion of the highway right-of-way. 5. Generally, no more than one approach shall be allowed any parcel or property the frontage of which is less than one hundred (100) feet. Additional entrances or exits for parcels or property having a frontage in excess of one hundred (100) feet shall be permitted only after showing of actual convenience and necessity. 6. All driveways shall be so located that the flared portion adjacent to the traveled way will not encroach upon adjoining property. 7. No commercial driveway shall have a width greater than thirty (30) feet measured at right angles to the centerline of the driveway, except as increased by permissible radii. No noncommercial driveway shall have a width greater than twenty (20) feet measured at right angles to the centerline of the driveway, except as increased by permissible radii. 8. The axis of an approach to the road may be at a right angle to the centerline of the highway and of any angle between ninety (90) degrees and sixty (60) degrees but shall not be less than sixty (60) degrees. Adjustment will be made according to the type of traffic to be served and other physical conditions. 9. The construction of parking or servicing areas on the highway right-of-way is specifically prohibited. Off -the -road parking facil- ities should be provided by commercial establishments for customers' vehicles. 10. The grade of entrance and exit shall slope downward and away from the road surface at the same rate as the normal shoulder slope and for a distance equal to the width of the shoulder but in no case less than twenty (20) feet from the pavement edge. Approach grades are restricted to not more than 10 percent (10%). 11. All driveways and approaches shall be so constructed that they shall not interfere with the drainage system of the street or highway. The Applicant will be required to provide, at his own expense. drain- age structures at entrances and exits which will become an intearal part of the existing drainage system. The dimensions of all drainage structures must be approved by the Board of County Commissioners or their representative prior to installation. NOTE: This permit shall be made available at the site where and when work is being done. A work sketch or drawing of the proposed driveway(s) must accompany application. During periods of a call on the Engelhardt well either from Dry Hollow Creek or the Colorado River, water will be released from Engelhardt pond in accordance with the schedule in Table 2. When implemented, the augmentation plan described above will protect senior downstream water rights from injury resulting from out -of -priority diversions at the Engelhardt well. RULING OF REFEREE AND DECREE OF COURT The Referee has examined the information submitted by the Applicant and has become advised with respect to the subject matter of the Application. He Rules as follows: 1. The foregoing Findings are incorporated herein and made part of the Ruling of Referee. 2. The Court has exclusive jurisdiction over the subject matter of these proceedings pursuant to C.R.S. § 37-92-203, and over all persons or entities affected thereby, whether or not they have appeared. 3. The Application for Underground Water Right, Storage Water Right and Plan for Augmentation proposed by Applicant is such as is contemplated by law. If implemented and administered in accordance with this decree, the Underground Water Right, Storage Water Right and Plan for Augmentation described herein will provide water to the Applicant without adversely affecting the owners or users of vested water rights or decreed conditional water rights. The plan for augmentation described herein may be lawfully decreed by this Court. 4. The Referee rules that the Underground water Right, Storage Water Right and Flan for Augmentation described herein are approved. 6. Pursuant to C.R.S. § 37-92-305(8), the State Engineer shall curtail all out -of -priority diversions, the depletions from which are not so replaced as to prevent injury to vested water rights. 7. The Applicant shall install measuring devices, provide accounting, and supply calculations regarding the timing of depletions as required by the Division Engineer for the operation of this plan. The Applicant shall also file an annual report with the Division Engineer by November 15th of each year summarizing diversions and replacements made under this plan. 8. Should Applicant's property be subdivided, Applicant shall establish a homeowners' association that shall be responsible for ensuring the terms and conditions of this decree are met. 9. In consideration of the specific findings and conclusions made herein and in conformance with C.R.S. § 37-92-304(6)(1990), as amended, the approval of the plan for augmentation decreed herein shall be subject to reconsideration by the Water Judge on the questions of injury to the vested water rights of others for a period of five (5) calendar years after the augmentation plan becomes operational. If no petition for reconsiderafion is filed within those five (5) years, retention of jurisdiction for this purpose shall automatically expire. 10. We observed the following data: Static Water Level: Pump Setting: Total Well Depth: Well Production: Pumping Level: 20 feet (before pumping) 150 Feet 160 Feet 8+ Gallons Per Minute 54 Feet The test was preformed utilizing the existing pump that is in the well that was tested. It is our professional opinion that this well produces an amount greater that 8 gallons per minute and that this well is more than adequate to furnish water for two dwellings.
