D. 19..Qa ...... , there were present: L r.r.y V 3. $quaz , Commissioner Chairman :.�.,..:.Caris.e , Commissioner .....:; Commissioner Earl , County Attorney I1..1.1.c1r.ed...Al aP.X:E , Clerk of the Board when the following proceedings, among others were had and done, to -writ: :RESOLUTION NO. 84 1.08 RESOLUTION CONCERNED WITH THE DENIAL OF A SPECIAL USE PERMIT APPLICATION .BY RIFLE BROADCASTING CO. FOR :.RADIO STP.TION•TOWERS WHEREAS, Rifle Broadcasting Co. has filed an application with the Board of County Commissioners of Garfield County for approval" of a specialuse permit for the erection of communications towers and radio transmitter facilities upon a Parcel of land located in the unincorporated area of Garfield County., Colorado; and WHEREAS, A public hearing was held by this Board on May 21, 1984 concerning the application , of Rifle Broadcasting, Co. for a special use permit; and WHEREAS, based upon the evidence, sworn testimony, exhibits, comments from the Garfield County Department of Development," the Garfield County Planning Commission, . and comments from all interested parties, this Board- finds as follows: 1. That proper publication and public notice was provided, as required by law, for the hearing before the Board; 2. That the hearing before the Board was extensive and complete, that all pertinent facts, matters and issues were submitted, and that all interested parties were heard at the hearing; 3. That the Garfield County Planning Commission has recommended to this Board that the requested special use permit be denied as the proposed -communications towers and transmitter surrounding neighborhood, which is primarily agricultural and residential in nature; 4. That the effected neighborhood consists of that area of Garfield County within a one mile radius of the applicant` -s proposed special use. The established " character of the neighborhood is residential and agrarian in nature; 5. That the visual impact of the proposed communications towers and transmitter facilities will be injurious tothe established character of the neighborhood. The communications` towers will be constructed in such a manner as to be visible both •during the day and at night from the surrounding neighborhood. The -proposed communications > towers will interfere with the scenic beauty and views otherwise available to the residents of the surrounding neighborhood; 6. That the erection of the proposed communications towers and transmitter facilities are inconsistent with the established character of the neighborhood and may have an adverse effect on the values of residential properties in the area; BOOK 651 FIGE276 7. Tht thee is substantial competent evidence in the record' of the public` -hearing before the Board that for the ,above stated and other reasons the proposed special use is riot in- the best- interest of the health, safety, morals, convenience,, order, prosperity, ,and welfare ` of the citizens of Garfield County, Colorado. NOW, THEREFORE, BE TT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the application of Rifle Broadcasting, Co. .for a special use permit to erect communications towers and transmitter facilities in the unincorporated- area of Garfield County, Colorado, be and the same is hereby denied. for the following reasons: 1. There was substantial competent evidence presented, on the record, at the public hearing on the application that the proposed special uses would have a negative visual impact on the established character of the surrounding neighborhood; and 2.- The nature- of the proposed special use, communications towers to be over three hundred and fifty feet in, height, -and related•transmitter- facilities is such that the (negative impacts on the surrounding neighborhood cannot be migated by the imposition of conditions on the proposed use.
