Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on, Monday, the 8t' day of December A.D. 2008, there were present

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 2010- 05
A RESOLUTION CONCERNED WITH THE APPROVAL OF ASPECIAL USE
PERMIT FOR AN ACCESSORY DWELLING UNIT FOR A PROPERTY
OWNED BY RON PERAU AND LOCATED AT 1963 COUTY ROAD 210, GARFIELD
COUNTY
PARCEL NO 112177-024-00-194
Recitals
1. The Board of County Commissioners of Garfield County, Colorado (the Board), has received
an application from Ron Peron for a Special Use Permit (SUP) to allow an Accessory
Dwelling Unit on their property; and
2. The Property contains 39.175 -acre is practically located east of the City of Rifle at 1963,
County Road 210 within the ARRD (Agricultural Residential Rural Density) zone district
and legally described on a Warranty Deed recorded at Reception no. 674949 in Book1690
and Page 545; and
3. On December 8, 2008, the Board of County Commissioners (the Board) opened a public
hearing upon the question of whether the SUP Application should be granted, granted with
conditions, or denied at which hearing the public and interested persons were given the
opportunity to express their opinions regarding the issuance of said Application;
4. The Board of County Commissioners closed the public hearing on the December 8, 2009 to
make afetal decision;

Resolution
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that
1. The forgoing Recitals are incorporated by this reference as part of the Resolution.
2. Special Use Permit for an Accessory Dwelling Unit for a property owned by Ron Perau
shall be approved subject to compliance with all of the following specific findings and
conditions:
A. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
B. That the hearing before the Board of County Commissioners was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at that meeting.
C. That for the above stated and other reasons, the proposed Special Use Permit is in
the best interest of the health, safety, convenience, order, prosperity and welfare
of the citizens of Garfield County.
D. That the application is in conformance with the Garfield County Zoning
Resolution of 1978, as amended.
E. All representations of the applicant, either within the application or stated at the
hearing before the Board of County Commissioners, shall be considered
conditions of approval unless otherwise modified by the Board.
R All lighting associated with the ADU shall be the minimum amount necessary.
All exterior lighting shall be shielded to prevent light trespass on any adjoining
property and be downward facing towards the stmcture.
G. The applicant shall obtain any applicable Garfield County building permits,
grading permits and access permits, including approval for a septic permit which
can accommodate the accessory dwelling unit prior to the issuance of Building
Perna
H. The gross floor area of the accessory dwelling unit shall not exceed 1,500 square
feet.
I. The accessory dwelling unit shall not be conveyed as a separate interest, but may
be leased.

J. No Special Use Permit shall be issued and no occupation of the ADU shall be
permitted by the County until the applicant can furnish legal proof that the spring
can provide legal and physically adequate water for the ADU on the property.
