At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in
Glenwood Springs on, Monday, the 15'h day of December A.O. 2003, there were present:

when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 2004-04
A RESOLUTION CONCERNED WITH THE APPROVAL OF A CONDITIONAL USE
PERMIT FOR A SCHOOL FOR THE EMILY GRIFFITH CENTER FOR A PROPERTY
LOCATED AT 1252 COUNTY ROAD 294
WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"),
has received an application from Bill Evans, represented b y Susan Garcia, Program Director for the
Emily Griffith Center, to amend an existing conditional use permit ("CUP") for a school to allow for
the placement of two (12' x 40') modular structures and an equine program support facilit ies to the
existing school operations on the property; and
WHEREAS, the Board of County Commissioners originally approved a CUP for a school as
r equest ed by Community Based Services, Inc./ "Western Academy" on the subject property in 1986
which is memorialized in Resolution 86-73 and was subsequently amended in 1997 via Resolutions
97-84 and 97-100; and
WHEREAS, the subject property is located in the NRIRD zone district which contemplates
a school as a conditional use in that district, contains approximately 4.92 acres , and is legally
described as a parcel of land in the NW \4 of the SE ~ and the SW \4 of the SE ~ of Section 10,
Township 6 South, Range 93 West of the 61l> P . M; and
WHEREAS, the Board held a public hearing on the 15th day of December, 2003, upon the
question of whether the above described CUP should be granted or denied, at which hearing the
public and interested persons were given the opportunity to express their opinions concerning the

approval of said special use pennit; and

WHEREAS, it was established that the CUP runs with the land and is issued to the property
owner, Bill Evans; and
WHEREAS, the Board on the basis of sub stantial competent evidence produced at the
aforementioned hearing, has made the following detennination of fact as li sted below:
1. Proper posting and public notice was provided as required for the meeting before the
Board of County Commissioners.
2. The meeting before the Board of County Commissioners was extensive and complete,
that all pertinent facts, matters and iss ue s were submitted and that all interested parties
were h eard at that meeting.
3. The above stated and other reasons, the proposed conditional use permit has been
determined to be in the best interest of the health, safety, morals, convenience, order,
prosperity and welfare of the citizens of Garfield County.
4. The application has met the requirements of Conditional Use (Sections 5:03) the Garfield
County Zoning Resolution of 1978, as amended.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that Conditional Use Permit is hereby approved, subject to compliance with all of
the following specific conditions:
I. That all representations made by the Applicant in the application, a nd at the public
hearing before the Board of County Commissioners, shall be conditions of approval,
unless specifically altered by the Board of County Commissioners.
2. This permit granted is for this specific use only as presently described. In the event any
representations made in the application for which this permit is granted change and arc
no lo nger consistent with the representations in this application, the applicant shall be
required to submit a new permit application to the county addressing the changes.
3. All exterior lighting will be the mini1 num amount necessary and all exterior lighting will
be directed inward and downward towards the interior of the site, except that provisions
may be made to allow for safety lighting that goes beyond the property boundaries.
