The site shall re posted such that the notice is clearly and conspicuously visible from a public right-of-way, with notice signs provided by the Planning Department. Box 1880 Rifle, CO 81650 Situs: 1252 County Road 294 Rifle, Colorado Application Submittal Requirements: Application Item I -Plans and Specifications: Emily Griffith Center is a Residential Treatment Center and School for emotionally disturbed males ages 9 to 18 years old. The capacity of the Western Campus is 28 residents. The facility is supervised 24 hours a day by staff that doesnot reside on the premises. Various departments of social service agencies throughout the State of Colorado -Child Welfare Division refer the residents. The residents have a significant mental health and abuse history. We are requesting approval for: Increasing our capacity from 28 to 35 students. This expansion will include increasing the beds in TLC from 7 to 14 beds. There will be no change from the existing/current use of the facility. This request will change the current student capacity from 28 to 35 residents. The profile of our students will not change. The purpose of increasing our capacity is to provide more evaluation and crisis beds to our TLC staff secure unit. Program Philosophy Each child placed at Emily Griffith Center arrives with extremely diverse and individualized treatment and education needs. To provide each child the proper level of treatment and containment, and to prevent placement disruptions, as his/her needs change, we offer an intensive treatment unit, and education, which offers a high level of containment within a staffed secure setting. The TLC program provides innovative clinical and educational interventions for children in crisis, while maintaining continuity of staff relationships. Frequently during critical periods in the treatment process, children become unsafe to themselves or others. During such critical phases of care, effective outcomes can best be achieved if the child can be safely maintained within the comfort of the familiar relationships he has developed, and within the program he knows. Following an assessment by our clinical staff, a child in crisis is placed into the TLC unit for any period of time ranging from a few to hours to several weeks, to achieve specific safety and treatment objectives. Educational services, meals, recreation, and therapy are provided on the unit by staff specifically trained to assist children in crisis. The child is returned to his open program as quickly as he is assessed to be safe, and has achieved the placement objectives. The TLC program is also effective as a preventive tool, and as an assessment and observation unit. As a preventive tool, children may be placed into the program to prevent elopement, or to assist the child through an especially stressful anniversary, season, or treatment phase. As an assessment unit, TLC is effective as an entry point into the program. If unanswered questions exist as to the precise treatment needs of the child, medication stabilization, or a comprehensive psychosocial assessment is needed; a TLC placement is advised. Once the assessment/stabilization phase is completed and the treatment plan is developed, the child can be transferred into the open unit, or referred to a more appropriate treatment program. The Western Campus TLC unit will offer 14 single rooms constructed of concrete block. The unit is connected to an indoor gym, and a secured outdoor recreation area with 10 -feet high fence. The unit has delay egress doors, 3 bathrooms, group/education space, storage for personal items, and additional safety features. Children in the TLC unit may be contacted by phone or in person. There is currently and will be approximately 12 staff vehicles parked in front of the Emily Griffith Center. Emily Griffith Center owns a 15 -passenger van and a suburban. Those vehicles are also parked in front of the center. There is one food delivery to the front of the building one time per week, and two trash pick-ups per week. There will be no vehicles entering or exiting near or/at the location of the TLC Unit. Application Item 2- Water and Sewage: Water is provided by the city of Rifle. With the addition of TLC Unit beds, The Emily Griffith Center has been working with Church and Associates to analyze our septic system. Currently, we have been monitoring our water use on a daily basis and sending data weekly to Church and Associates for their review. We are sending out the resident's laundry to 4th Street Cleaners, Rifle on a daily basis. Since the laundry has been sent out, the water usage has decreased. Church and Associates and The Emily Griffith Center are confident that the center and this addition will meet the water requirements. At this time, Church and Associates are working with a Garfield County Representative to ensure that Church and Associates calculations are correct and adequate. The Emily Griffith Center has submitted an application to the City of Rifle to access the city septic system. Resolution is still pending. Cease and Desist Orders: The health officer or his/her authorized representative may issue an order to cease and desist from the use of any system which is found by the health officer not to be functioning in compliance with Article 10 of Title 25, C.R.S. or with applicable rules and regulations or is found to constitute a hazard to public health, or has not otherwise received timely repairs under the provisions of C.R.S., Section 25-10-106 (1)(j). Such an order may be issued only after a hearing which shall be conducted by the health officer not less than 48 hours after written notice thereof is given to the owner or occupant of the property on which the system is located and at which the owner or occupant may be present, with counsel, and be heard. The order shall require that the owner or occupant bring the system into compliance or eliminate the health hazard within a reasonable period of time, not to exceed thirty days, or thereafter cease and desist from the use of the system. A cease and desist order issued by the health officer shall be reviewable in the district court for the county wherein the system is located and upon a petition filed not later than ten days after the order is issued. V. Calculation of Sewage Flow and Characteristics: " A. Where gallons per day and pounds of biochemical oxygen demand (BOD5) per day can be obtained by measurement of existing conditions, such data may be used. This allows local health officials to require installation of a meter located to measure flow into the individual sewage disposal system. B. For new facilities the following "Table of Quantities and BOD5 Strength of Sewage" may be used as a guide to represent average conditions. C. Maximum flow shall be considered as 150 percent of average daily flow and shall be the basis for design purposes unless otherwise established by evidence satisfactory to the health officer. To calculate the sewage flow for dwellings and mobile homes, use a figure of two persons per bedroom. E. In no event may the system be designed for a lesser capacity than the anticipated maximum daily sewage flow or treatment requirements of the sewage or wastes in the system. F. The local health officer or his/her designated agent may, at his/her discretion, allow reduction in design flow for proven, permanently installed water conservation devices. Andy, FYI, the Fire Department doesn't have any real issues with the permit as it is pretty much the same as what they are doing already. My concern is more in how the activities are being described in the application regarding what almost sounds like a lock down area instead of an "R" occupancy. Maybe it is just how it is defined in their paperwork, but as you will see in my letter I have suggested that someone from your office and someone from here take a "field trip" to insure we are aware of what the operation is exactly and to make sure we are using the right rule book. The other item I have commented on is the fire alarm system. We have been working with Mr. Evans for quite some time on repairs and I think he gets sticker shock when he gets the prices on repairs. As I review the comments in the request, I would just like to make sure that the County and the Fire Department are on the same page with occupancy classification. After review of the request, the changes requested appear to be primarily for tate increase in the number of occupants and not a "new" request. As a result of this, the District has no significant comments on the granting of the Permit, but would submit the following comments on the facility. The District has been working with Mr. Evans on corrections to the,fire alarm system in the existing facility. It is my understanding that plans are forthcoming for approval for code compliance. With the expansion of the facility, and with questions arising from the application, the corrections to the fire alarm system must be completed in a timely manner. In review of the accompanying documentation, a significant amount of explanation of the "TLC" unit is discussed. Increasing the capacity of this "TLC" unit is the primary basis of the request. In order to insure that adequate life safety requirements are in place, I feel it appropriate that a County Building Official and a District representative visit the facility to review operations and practices both existing and proposed. More specifically, it appears that an evaluation is in order to insure that fire separation, alarm system, egress delay, and "secured" areas be evaluated to insure the safety of the residents. The Emily Griffith Center is a Residential Treatment Center and School which cares for emotionally disturbed males between the ages of 9 and 18 years old. EGC leases the -}5 acre property at 1252 County Road 294 in Rifle, Colorado (See attached project location map, Figure 1) from the owner, Bill Evans, who lives at 1212 Cooper Avenue, Glenwood Springs, Colorado. Mr. Evans has agreed to be the applicant for the site application on behalf of EGC. EGC will be financing the construction of the lift station with upfront private funds. EGC will have the financial responsibility of constructing and maintaining the lift station. Upon EGC's vacancy, maintenance responsibility will pass to the owner. EGC, in cooperation with Mr. Evans, would like to expand from its current 28 students to 35 students. The students are at the facility on a 24 hour basis. The number of staff would also increase, however the staff rotate in shifts. With the additional students and staff it is expected that the design parameters of the existing septic system will be exceeded. The feasibility of increasing the size of the leach field or decreasing the wastewater flow by outsourcing EGC's laundry has been considered. As a preferred alternative, it has been proposed that the EGO connect to the City of Rifle wastewater collection system. The City of Rifle and Garfield County have agreed to allow the EGC to connect to Rifle's system, pending site application and lift station design approval (See attached letter from Rifle City Manager, John Hier). To accomplish the connection and the 70 foot rise in elevation, a lift station and approximately 1500 feet of force main will need to be installed (Figure 2). It is anticipated that the expanded facility will have an average hydraulic flow of 3610 gpd and a peak hydraulic flow of 10,830 gpd (See the attached Table 1). Under the current setup wastewater flows through two 1000 gallon septic tanks, followed by a 3000 gallon septic tank before passing through dual automatic dosing siphons to the leach field. The proposed configuration will locate the lift station after the third septic tank. The 3000 gallon tank will remain in place and will handle overflow in the event that power to the lift station is interrupted for an extended period of time. The lift station, being located after the septic tanks, will be pumping almost entirely liquid. The BOD5 under this scenario is expected to be 8.3 Ibslday. These numbers represent approximately 0.5 % of the hydraulic and 2.5 % of the organic capacity of Rifle's current wastewater flow. The facility and lift station are located in Zone C — "Areas of Minimal Flooding", under FEMA's classification. A portion of the Flood Insurance Rate Map for that area is attached as Figure 4. DESCRIPTION OF THE PROPOSAL A. Proposed Request The Applicant requests approval of a Special Use Permit for a Group Residential Facility which includes the internal expansion of facilities and services for an additional 7 students for a maximum of 35 students at the Emily Griffith Center Western Campus building. This expansion will include increasing the beds in the Treatment Learning and Containment Unit (TLC) which also allows for additional day -treatment students. A Group Residential Facility is contemplated as a Special Use in the ARRD zone district and defined as: "A residence and other necessary building spaces that provide a community living environment and services for individuals requiring custodial care, medical treatment, or specialized social services. This term includes, but is not limited to: specialized group child care home, facility or center; residential child care facility; residential treatment center or facility; shelters from domestic violence; and/or residential treatment services for children and adolescents as ordered by the courts." The existing use on the property is characterized as a Residential Treatment Center and School operated by the Emily Griffith Center for emotionally disturbed males ages 9 to 18 years old. This use has been in place on the same property for at least the last decade. At present, the capacity of the facility has been capped at 28 residents. The facility is supervised 24 hours a day by staff that does not reside on the premises. Various departments of social service agencies throughout the State of Colorado -Child Welfare Division refer the residents. The residents have a 1 significant mental health and abuse history. This present proposal is to increase the student capacity from 28 to 35 students. This expansion will include increasing the beds in TLC from 7 to 14 beds. There will be no change from the existing/current use of the facility. T e �rofil . f our students will not change. The purpose of increasing the capacity is to prow . e more evaluation and crisis beds to the TLG staff secure unit. The program philosophy of the Emily Griffith Center as stated in the application is as follows: Each child placed at Emily Griffith Center arrives with extremely diverse and individualized treatment and education needs. To provide each child the proper level of treatment and containment, and to prevent placement disruptions, as his/her needs change, the Center offers an intensive treatment unit, and education, which offers a high level of containment within a staffed secure setting. The TLC program provides innovative clinical and educational interventions for children in crisis, while maintaining continuity of staff relationships. Frequently during critical periods in the treatment process, children become unsafe to themselves or others. During such critical phases of care, effective outcomes can best be achieved if the child can be safely maintained within the comfort of the familiar relationships he has developed, and within the program he knows. Following an assessment by our clinical staff a child in crisis is placed into the TLC unitfor any period of time ranging from a few to hours to several weeks, to achieve specific safety and treatment objectives. Educational services, meals, recreation, and therapy are provided on the unit by staff specifically trained to assist children in crisis. The child is retuned to his open program as quickly as he is assessed to be safe, and has achieved the placement objectives. The TLC program is also effective as a preventive tool, and as an assessment and observation unit. As a preventive tool, children may be placed into the program to prevent elopement, or to • assist the child through an especially stressful anniversary, season, or treatment phase. As an assessment unit, TLC is effective as an entry point into the program. If unanswered questions exist as to the precise treatment needs of the child, medication stabilization, or a comprehensive psychosocial assessment is needed; a TLC placement is advised. Once the assessment/stabilization phase is completed and the treatment plan is developed, the child can be transferred into the open unit, or referred to a more appropriate treatment program. The proposal is to expand the capacity of the existing TLC units from 7 to 14 single rooms constructed of concrete block. The unit is connected to an indoor gym, and a secured outdoor recreation area with 10 -feet high fence. The unit has delay egress doors, 3 bathrooms, group/education space, storage for personal items, and additional safety features. Children in the TLC unit may be contacted by phone or in person. There is currently and will be approximately 12 staff vehicles parked in front of the Emily Griffith Center. Emily Griffith Center owns a 12 -passenger van and a suburban. Those vehicles 2 are also parked in front of the center. There is one food delivery to the front of the building one time per week, and two trash pick-ups per week. There will be no vehicles entering or exiting near or at the location of the TLC units. B. Background / History As a matter of background, the Board originally approved a CUP request for a "school" known at the time as "Western Academy" on the subject property in 1986 which was subsequently amended in 1997 to include an expansion to the original school building. A school is defined in the zoning code as "a public or private pre-school, elementary or secondary school or college." It is understood by Staff that the primary function of the Emily Griffith Center is to educate up to a maximum of 28 students at the facility. It should also be noted that the County Department of Social Services will refer students to the Center from time to time. Most recently in December 2003, the Board approved the placement of two modular classroom / storage structures on the property as well as the construction of four horse paddocks, a riding arena, and a round pen to support the equine program. 1980: CUP to locate the First Baptist Church on the property; 1986: CUP to change uses from the church to a School for "Western Academy" which conducted a residential training and education program for up to 24 students (ages 12 — 18) for 12 months of the year with a staff of 12; 1997: 1st Amendment to the School CUP by "Western Academy" to add an addition to the existing school building to relieve crowding in the dorms but no additional students. Maximum remained at 28. Applicant demonstrated via an analysis by SGM that the actual septic use was 1950 gpd; and 2003: 2nd Amendment to the School CUP by the "Emily Griffith Center" to place two modular classroom / storage structures on the property as well as the construction of four horse paddocks, a riding arena, and a round pen to support the equine program. No increase to student enrollment. As you will recall, the Applicant presented the same request to the Board on May 10`h of this year. However, at that time, the Applicant sought a Conditional Use Permit for a "School." Staffs recommended the Board open and continue the public hearing regarding the request to expand the services and facilities of the Emily Griffith Center for a "school" so that a more detailed analysis can be presented to and verified by the County regarding the adequacy of the septic system. The Board agreed to open and continue the hearing to allow the Applicant to resolve issues raised by Staff. As a result of subsequent discussions between the Applicant and Staff, the Applicant decided to withdraw the application and re -apply to the County for a Special Use Permit for a "Group Residential Facility" which was to be a text amendment to the Zoning Resolution proposed to the Board at the same meeting. Therefore, a text amendment to the Zoning 3 Resolution will be proposed to the Board just prior to the Board's consideration of this Special Use Permit. In this way, should the Board approve the definition of a "Group Residential Facility", it would appear to be an appropriate use under which the applicant could apply rather than a "school" which is not an appropriate fit in the zoning code. B. Site Description The property is located on the mesa adjacent to and east of the Highlands East subdivision in Rifle on CR 294. The property is flat and currently contains a two story school structure (14,256 sq. ft.) with an attached single -story addition containing approximately 2,392 sq. ft. The Applicant has placed two additional modular structures (12 x 40) on the east and rear side of the school building. As mentioned earlier, the proposal for the additional 7 students will only require internal modification of the existing structure. No additional external modifications are contemplated to the structure or site design. II. REFERRAL AGENCIES / DEPARTMENTS A. City of Rifle: See Exhibit_ B. Colorado Department of Public Health and Environment Water Quality Control Division: See Exhibit III.REVIEW STANDARDS Special Uses are subject to the standards in Section 5.03 of the Zoning Resolution. Staff has provided the standards in bold italics below followed by a Staff Response. A. Section 5.03 Review Standards 1) Utilities adequate to provide water and sanitation service based on accepted engineering standards and approved by the Board of County Commissioners shall either be in place or shall be constructed in conjunction with the proposed use; Staff Finding The facility's domestic water is presently served by the City of Rifle. Wastewater is presently handled by an existing septic system. The application materials state the Applicant proposes to 4 handle increased wastewater generated from the additional students either by an additional ISDS or by connecting to the City of Rifle's wastewater treatment facility. The Applicant has applied to the City for this service but no line or service is presently in place. Instead, the applicant proposes to handle additional waste water generation with the existing system as well as reducing water usage by eliminating the "in-house" laundry service. Waste water generation has been an issue for the present use for many years; it ultimately controls the number of students that can reside at the facility. The Applicant states that they have been monitoring water use on a daily basis and sending data weekly to Church and Associates for their review. This data reflects the fact that the facility is sending out the laundry to 4th Street Cleaners in Rifle on a daily basis. Since the laundry has been sent out, the water usage has decreased. Church and Associates and The Emily Griffith Center are confident that the center and this addition will meet the [waste, sic] water requirements. [It should be noted that the original proposal to locate the Emily Griffith Center in the present facility included much discussion on how to handle wastewater. The Applicant was required to prove that a septic system (of 2000 gallons or less) could handle wastewater generated. Otherwise, a site application approval from the State would have been required.] The City of Rifle indicated that the most likely would approve an extension and tap if funded by the Applicant and if the engineering plans were approved for the line. However, the Applicant has not been approved for a tap / extension from the City of Rifle at this time. Instead, the Applicant hired an engineering firm, Church & Associates, to complete an analysis of the existing septic system to determine if additional flow could be handled. The consultants indicate (see Exhibit G) that the additional waste water flow from the 7 students could be handled by the existing system if all laundry was handled off site. More specifically, Church & Associates states that "daily water readings have been recorded at the subject property from February 27th to April 13`h 2004. The current daily average for the 28 students is 1556 gallons per day (GPD). The average water use, which is assumed to be the wastewater flow, is 55.5 GPD per student. By adding 7 students the projected total daily average would be 1945 GPD, which would maintain the facility under a Garfield County Individual Sewage Disposal (ISDS) permit." Staff finds the analysis somewhat troubling given a previous analysis conducted by Schmueser Gordon Meyer that the average daily flow for 32 students is 1950 gpd. (See Exhibit 11), The Applicant has committed to this scenario and also suggests that if laundry were handled off site, this would keep the daily flow rates down. While Staff understands the Church analysis, Staff referred the information to Colorado Department of Public Health and Environment Water Quality Control Division (See Exhibit J who reviewed the information provided the following significant remarks: While empirical flow evidence is fine fora repair, typically additional flows are calculated at the theoretical rate. There is no guarantee that additional usage will remain at the empirical rate. 5 It also appears that these residents live in this facility with no supervision. There are no calculations included for staff. It appears that additional flows for staff and additional flows for residents will push this design capacity over the 2000 gallons per day site application threshold. It is my understanding that this facility is receiving City of Rifle drinking water. I also understand that the facility wishes to open another residence on a separate parcel across the street for another 14 residents. Since this facility is growing significantly, it would be prudent to plan infrastructure for the future. The initial questions that the site application will generate include: How far is it to municipal sewer? and Why can't this facility be served? We strongly recommend that this facility hook up to the City of Rifle. At the very least, this facility will need a site application and discharge permit to groundwater. The City of Rifle has the right to comment and recommend approval or disapproval of a site application within 3 miles. Ultimately, this means that the District Engineer suspects that while the existing flow into the system may be just under the 2000 gallons a day limit, any expansion, based on the required standard for projected usage (100 gallons per person per day) will push well beyond the limitations of the 2000 gallons per day and that a site application will be required or that the facility shall need to hook into the City of Rifle's central wastewater system which is very nearby. Based on this information, the application has not demonstrated that adequate wastewater utilities are in place to handle addition flows. Again, as mentioned above, the City of Rifle indicated that the most likely would approve an extension and tap if funded by the Applicant and if the engineering plans were approved for the line. However, the Applicant has not been approved for a tap / extension from the City of Rifle at this time, Based on the foregoing, this standard has not been met. 2) Street improvements adequate to accommodate traffic volume generated by the proposed use and to provide safe, convenient access to the use shall either be in place or shall be constructed in conjunction with the proposed use; Staff Finding The school has a parking lot with a separate entrance and exit onto CR 294. The Applicant states that daily trips occur from the 10 —12 staff vehicles and a passenger van and suburban which are all accommodated in the existing parking lot. The Applicant states that the increase of 7 students to the center will require a maximum of 2 additional staff members. Staff referred the application to the Road and Bridge Department however no comments were received. The Emily Griffith Center also receives a food delivery approximately once or twice a week. Staff finds that the traffic patterns that occur as a result of the school are generally characterized by morning staff arriving and evening staff leaving with a few delivery trips which do not represent a significant measurable impact to the general traffic flow and negative impact to the County's road system. 6 3) Design of the proposed use is organized to minimize impact on and from adjacent uses of land through installation of screen fences or landscape materials on the periphery of the lot and by location of intensively utilized areas, access points, lighting and signs in such a manner as to protect established neighborhood character; Staff Finding No exterior physical changes will occur to the present site as a result of the expansion in the number of students in the program. Staff finds that due to the small size of the structures, their placement on the site in close proximity to the two story school building, the existing landscaping and trees around the property, the structures effectively blend in with the existing buildings and surrounding environment and are not easily seen from CR 294. The septic tank capacity and drain field area was determined to be adequate for 1950 GPD. Actually, the 1986 designed system was designed for an average daily flow of 3200 GPD. Church has been involved with water use monitoring at the subject property since February 27, 2004. The current daily average for the 28 students is 1385 gallons per day (GPD) as indicated by the attachment. The water use has varied from 1385 GPD to 1740 GPD. Subsequent to the 1740 GPD monitoring, laundry has been taken out instead of doing the laundry at the facility. With the taking out of Iaundry, the water use was reduced to 50 GPD per client. We believe the average water use will average 55 GPD. By adding 7 students the projected total daily average would be 1925 GPD, which would maintain the facility under a Garfield County Individual Sewage Disposal (ISDS) permit. We are able to provide a response to the first of the questions regarding septic tank capacity based upon historic flow records for the Child Care Facility itself. Regarding the second issue, we will not be able to provide you a clear answer to this issue but may be able to provide you some guidance in locating or constructing your foundation system to insure that this will not be an issue. As you are well aware, in 1986, Schmueser Gordon Meyer, Inc. provide a design of the Western Academy Child Care Facility sewage disposal system for the City of Rifle. During that design process, flow assumptions were made considering the future estimated population of the facility and tabulated state guidelines for flow calculations. In essence, it was assumed that the total population at the facility would be 32 persons with an average daily flow of 100 gallons per person per day. Utilizing this information along with standard state design criteria, the design, as presented in 1986, was required. Since 1986, the system has been in use and we have received from yourself (attached) copies of the actual records of water usage for the last two years. By utilizing this information with standard statistical analysis (i.e. throwing out highest and lowest scores and estimates) the average daily flow of water delivered to the Western Academy Child Care Facility by the City of Rifle is 2,105 gpd. Considering an average consumptive use between 5% to 10%, it is estimated that the average daily flow to the Waste Water Disposal System would be 1,950 gpd. Based upon these actual flow records, and the statistically determined 1,950 gpd, the septic tank volume considering 30 hour detention time would be 2,438 gpd. Accordingly, with the actual flow records, the absorption area provided with the existing field is more than what is actually required. Based upon this actual information, the first of your questions regarding the elimination of the 1,000 gal septic tank #1 (as identified in the 1986 SGM design) may be eliminated. All of this information assumes, of course, that no additional demand upon the system is anticipated with the expansion of the existing building. Regarding your second question, which deals with the proximity of the expansion to the second septic tank, the setback requirements of six feet from the south wall of the expansion to the septic tank are not a concern from a Department of Health standpoint. However, as you discussed, structural considerations may be a problem, given the depth of the septic tank. This information includes, but is not limited to, the following: 1. Complete construction plans for the building expansion itself. 2. Details of construction of how the existing tank was constructed in 1988, which include concrete strength, reinforcing steel strength, reinforcing type, size, diameter, and reinforcing location, 3. Exact depths of proposed foundation and geometric properties of the tank. 4. Soil properties of the bearing soils under the foundation and backfill soils for the tank. Given the extent of information required for the determination on the tank, we would recommend that the depth of the foundation for the expansion be located such that the bottom of the footing be no higher than three feet above the bottom of the septic tank. In essence, this would provide a conservative location of the footing where the loading from the footing would not impose additional stress due to building surcharge on the septic tank. We feel that the costs to make the detailed determination of the structural adequacy of the septic tank would far exceed the additional foundation costs to conservatively locate the depth of footing to not 'load" the septic tank. 1 hope that this letter has adequately answered the questions posed to Schrnueser Gordon Meyer, Inc. regarding the sewage disposal system for the Western Academy Child Care Facility. Additionally, the City requests a condition be placed on the proposed conversion of a single-family residence that requires the building be designed as a contemporary single-family residence and prohibited from having an "institutional" or "non-residential" structure design. There is no guarantee that additional usage will remain at the empirical rate. It also appears that these residents live in this facility with no supervision. There are no calculations included for staff. It appears that additional flows for staff and additional flows for residents will push this design capacity over the 2000 gallons per day site application threshold. It is my understanding that this facility is receiving City of Rifle drinking water. I also understand that the facility wishes to open another residence on a separate parcel across the street for another 14 residents. Since this facility is growing significantly, it would be prudent to plan infrastructure for the future. The initial questions that the site application will generate include: How far is it to municipal sewer? and Why can't this facility be served? We strongly recommend that this facility hook up to the City of Rifle. At the very least, this facility will need a site application and discharge permit to groundwater. The City of Rifle has the right to comment and recommend approval or disapproval of a site application within 3 miles.
