Home My WebLink About3.0 Resolution 2005-07STATE OF COLORADO County of Garfield uniii nisi nuui ilii II 1111 1111111 II 111111111 1111 666854 01/11/2005 02:13P B1655 P221 M ALSDORF 1 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO ) )ss At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Plaza Building, in Glenwood Springs on Monday, the 3rd day of January, 2005, there were present: John Martin Larry McCown Tresi Houpt Don DeFord Mildred Alsdorf Ed Green , Commissioner Chaiinian , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2005-07 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT FOR A GROUP RESIDENTIAL FACILITY FOR CHILDREN AND YOUTH FOR A PROPERTY LOCATED AT 1252 COUNTY ROAD 294 Parcel ID: 2177-104-00-005 WHEREAS, the Board of County Commissioners of Garfield County, Colorado ("Board"), received an application for a Special Use Permit from William Evans for a Group Residential Facility for Children and Youth for a property located at 1252 County Road 294 (the Property); WHEREAS, the Property is located in the A/R/RD (Agricultural / Residential / Rural Density) zone district which designates a Group Residential Facility for Children and Youth as a Special Use in that zone district pursuant to Section 2.02.283 of the Zoning Resolution of 1978, as amended and which is defined here as: "A residence and other necessary building spaces providing a community living environment and services for minor children and youth, seventeen (17) and younger (unless Court-ordered for continued placement between the ages of 18 and 21), who require custodial care, clinical treatment, or specialized out -of -home and educational services, whether court-ordered or privately placed. Such a facility may be staff -secure for placement of youth, but may not be a locked facility. A Group Residential Facility for Children and Youth shall not be considered a corrections facility as defined in Section 2.02.156 of the Zoning Resolution" WHEREAS, the Group Residential Facility for Children and Youth on the Property specifically includes the internal expansion of facilities and services for an additional 7 students for a maximum of 35 students at the Emily Griffith. Center Western Campus building. This will also require an additional Staff of 8 which includes teachers and therapists over a 24-hour period and which expansion includes increasing the number of beds in the Treatment Learning and Containment Unit (TLC) which also allows for additional day -treatment students. WHEREAS, the Board opened and continued a public hearing on the 19th day of July, 2004, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board closed the public hearing on the 3`d day of January, 2005, upon the question of whether the above described SUP should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval of said special use permit; and WHEREAS, the Board of County Commissioners, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of facts: 1. That the public hearings before the Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 2. Proper posting and public notice was provided as required for the meeting before the Board of County Commissioners. 3. The application has met the requirements of a Special Use (Sections 2.02.283, 3.02.03, 5.03, 5.03.023 and 9:03) the Garfield County Zoning Resolution of 1978, as amended. 4. The above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit for a Group Residential Facility for Children and Youth is hereby approved subject to compliance with all of the following specific conditions: 11111111 1111 666854 01/11/2005 02:13P B1655 P223 M ALSDORF 3 of 4 R 0.00 D 0.00 GARFIELD COUNTY CO 1) That all representations by the Applicant made in the application and during the public hearings before the Board of County Commissioners be considered conditions of approval unless specifically modified by the Board. 2) That the Applicant shall provide a letter to the County from the Colorado Department of Public Health and Environment (CDPHE) which states that a lift station has been approved and a letter from the City of Rifle that indicates that the Applicant has successfully connected to the City's wastewater Collection system. 3) That the Applicant continues to meet with the Residential Advisory Group once a month to address neighborhood issues. 4) That the Applicant obtains a "road cut peunit" from the County Road and Bridge Department to locate the proposed sewer line in the right-of-way of County Road 294 which will extend from the subject property to 7th Street in the City of Rifle. This permit shall be obtained prior to the issuance of the Special Use Permit. Dated this 10th day of January, A.D. 2005.
