REQUEST Conditional Use Permit to expand permitted uses for a
School dba the "Emily Griffith Center"

DESCRIPTION OF THE PROPOSAL
A. Proposed Request
The Applicant requests approval from the Board to expand their existing Conditional Use Permit
(CUP) for a "school" which is contemplated as a CUP in the A/R/RD zone district. The proposal
includes the internal expansion of facilities and services for an additional 7 students for a
maximum of 35 students. This expansion will include increasing the beds in the Treatment
Learning and Containment Unit (TLC) which also allows for additional day -treatment students.
Increasing the capacity to 35 would also allow female residents from the proposed 1359 program
to attend activities on the 1252 campus.
B. Background / History
As a matter of background, the Board originally approved a CUP request for a "school" known at
the time as "Western Academy" on the subject property in 1986 which was subsequently
amended in 1997 to include an expansion to the original school building. A school is defined in
the zoning code as "a public or private pre-school, elementary or seconda school or college." It
is understood by Staff that the primary function of the Emily Griffith Center is to educate up to a
maximum of 28 students at the facility. It should also be noted that the County Department of
Social Services will refer students to the Center from time to time.
Most recently in December 2003, the Board approved the placement of two modular classroom /

storage structures on the property as well as the construction of four horse paddocks, a riding
arena, and a round pen to support the equine program.
1980: CUP to locate the First Baptist Church on the property;
1986: CUP to change uses from the church to a School for "Westem Academy"
which conducted a residential training and education program for up to 24
students (ages 12 — 18) for 12 months of the year with a staff of 12;
1997: 1st Amendment to the School CUP by "Western Academy" to add an addition
to the existing school building to relieve crowding in the dorms but no
additional students. Maximum remained at 28. Applicant demonstrated via an
analysis by SGM that the actual septic use was 1950 gpd; and
2003: 2nd Amendment to the School CUP by the "Emily Griffith Center"
to place two modular classroom / storage structures on the property as well as
the• construction of four horse paddocks, a riding arena, and a round pen to
support the equine program. No increase to student enrollment.
B. Site Description
The property is located on the mesa adjacent to and east of the Highlands East subdivision in
Rifle on CR 294. The property is flat and currently contains a two story school structure (14,256
sq. ft.) with an attached single -story addition containing approximately 2,392 sq. ft. The
Applicant has placed two additional modular structures (12 x 40) on the east and rear side of the
school building. As mentioned earlier, the proposal for the additional 7 students will only require
internal modification of the existing structure. No additional external modifications are
contemplated to the structure or site design.
11. REFERRAL AGENCIES
In keeping with the terms of the Inter -Governmental Agreement (IGA) and the fact that the
property is located within Rifle's sphere of urban influence, Staff referred the request to the
Planning Director for the City of Rifle. The Application was also referred to the Road and Bridge
Department.
III.REVIEW STANDARDS
Conditional Uses are subject to the standards in Section 5,03 of the Zoning Resolution, Staff has
provided the standards in bold italics below followed by a Staff Response.

1) Utilities adequate to provide water and sanitation service based on accepted engineering
standards and approved by the Board of County Commissioners shall either be in place
or shall be constructed in conjunction with the proposed use; (A97-60)

The facility's domestic water is presently served by the City of Rifle. Wastewater is presently
handled by an existing septic system. The application materials state the Applicant proposes to
handle increased wastewater generated from the additional students either by an additional
ISDS or by connecting to the City of Rifle's wastewater treatment facility. The Applicant has
applied to the City for this service.
[It should be noted that the original proposal to locate the Emily Griffith Center in the present
facility included much discussion on how to handle wastewater. The Applicant was required to
prove that a septic system (of 2000 gallons or less) could handle wastewater generated.
Otherwise, a site application approval from the State would have been required.]
The City of Rifle indicated that the most likely would approve an extension and tap if funded
by the Applicant and if the engineering plans were approved for the line. However, the
Applicant has not been approved for a tap / extension from the City of Rifle at this time.
Instead, the Applicant hired an engineering firm, Church & Associates, to complete an
analysis of the existing septic system to determine if additional flow could be handled. The
consultants indicate (see Exhibit G) that the additional waste water flow from the 7 students
could be handled by the existing system if all laundry was handled off site.
Specifically, the letter from Church & Associates states that "daily water readings have been
recorded at the subject property from February 27th to April 13th 2004. The current daily

assumed to be the wastewater flow, is 55.5 GPD. By adding 7 students the projected total
daily average would be 1945 GPD, which would maintain the facility under a Garfield County
Individual Sewage Disposal (ISDS) permit." Staff finds the analysis somewhat troubling given
a previous analysis conducted by Schmueser Gordon Meyer that the average daily flow for 32
students is 1950 gpd. (See Exhibit H).
The Applicant has committed to this scenario and also suggests that if laundry were handled
offsite, this would keep the daily flow rates down. While Staffunderstands this to be possible,
it is impossible to monitor. Further, Staff would like to have more detailed analysis and
engineered calculations certified by Church & Associates that can also be reviewed by the
County's Engineer for accuracy. At this point, Staff in unconvinced that adding 7 students and
additional staff will not over burden the current system.
2) Street improvements adequate to accommodate traffic volume generated by the
proposed use and to provide safe, convenient access to the use shall either be in place
or shall be constructed in conjunction with the proposed use;

The school has a parking lot with a separate entrance and exit onto CR 294. The Applicant
states that daily trips occur from the 10 —12 staff vehicles and a passenger van and suburban
which are all accommodated in the existing parking lot. The Applicant states that the increase
of 7 students to the center will require a maximum of 2 additional staff members. Staff
referred the application to the Road and Bridge Department however no comments were
received. The Emily Griffith Center also receives a food delivery approximately once or twice

a week, Staff finds that the traffic patterns that occur as a result of the school are generally
characterized by morning staff arriving and evening staff leaving with a few delivery trips
which do not represent a significant impact to the general traffic flow and negative impact to
the County's road system.
3) Design of the proposed use is organized to minimize impact on and from adjacent uses
of land through installation of screen fences or landscape materials on the periphery of
the lot and by location of intensively utilized areas, accesspoints, lighting and signs in
such a manner as to protect established neighborhood character;
Staff Finding
No physical changes will occur to the present site as a result of the expansion in the number of
students in the program. Staff finds that due to the small size of the structures, their placement
on the site in close proximity to the two story school building, the existing landscaping and
trees around the property, the structures effectively blend in with the existing buildings and
surrounding environment and are not easily seen from CR 294. No new lighting or signage has
been installed with the structures and therefore does not deter from the established character of
the neighborhood.
IV. STAFF RECOMMENDATION
Staff recommends the Board of County Commissioners open and continue the public hearing
regarding the request to expand the services and facilities of the Emily Griffith Center for a
"school" on a property located at 1252 County Road 294, Garfield County so that a more detailed
analysis can be presented to and verified by the County regarding the adequacy of the septic
system,

Thank you for the additional information provided to this office on March 18, 2004 regarding the
Conditional Use Permit (CUP) application you submitted to this office in an effort to amend / expand
the operations of the existing CUP. I have reviewed the additional information and have determined
your application to be technically complete. Therefore, our department will begin reviewing the
application. Please submit 12 copies of all the information you have submitted to this office so that
we may provide copies to referral agencies as well as the Board of County Commissioners for their
review. Submit these copies no later than April 10th, 2004 or your public hearing date may be
jeopardized.
I have scheduled the request to be considered by the Board of County Commissioners on May 10th,
2004 at 1:15 PM. Please be aware, all of the noticing requirements are your responsibility; failure to
provide adequate proof of notice to the Board of County Commissioners will result in an inability to
conduct the public hearing. The noticing requirements are listed below:
1. Notice by publication, including the name of the applicant, description of the subject lot, a
description of the proposed use and nature of the hearing, and the date, time and place for the
hearing shall be given once in a newspaper of general circulation in that portion of the County in
which the subject property is located at least thirty (30) but not more than sixty (60) days prior to
the date of such nearing, ana proor or publication shall be presented at hearing by the applicant.
2. Notice by mail, containing information as described under paragraph (1) above, shall be mailed
to all owners of record as shown in the County Assessor's Office of lots within two hundred feet
(200') of the subject lot and to all owners of mineral interest in the subject property at least thirty
(30) but not more than sixty (60) days prior to such hearing time by certified return receipt mail,
and receipts shall be presented at the hearing by the applicant.

3. The site shall be posted such that the notice is clearly and conspicuously visible from a public

during the date of the hearing.

Commissioners, Garfield County, State of Colorado, to request a conditional use permit, in
connection with the following described property situated in the County of Garfield, State of

Dear Fred,
Pursuant to receipt of your letter dated March 8, 2004, we have addressed the items
requested: (Use Application —School —1252 CR 294)
I. Because the Emily Griffith Center or Susan Garcia is not the owner of the
property, you roust attach an acknowledgement from the property owner that you
may act in his/her behalf.
We have attached a letter from Mr. Bill Evans explaining that he supports and
approves the proposed expansion and Application for Use Permit. He has endorsed
the proposal as submitted by Emily Griffith Center and requests that the Building and
Planning Department approve the request and allow the project to move forward
under the supervision of Emily Griffith Center.
2. You must have the owner of the property sign the Application and the Agreement
to Pay form as well.
We have attached the Application and Agreement to Pay form signed by the owner on
behalf of the tenant, Emily Griffith Center.
3. Please provide a response to the following standard: "Design of the proposed use
is organized to minimize impact on and from adjacent uses of land through
installation of screen fences or landscape materials on the periphery of the lot
and by location of intensively utilized areas, access points, lighting and signs in

The current Emily Griffith Center Campus is located in a somewhat rural surrounding
and is fenced on 3 sides by fencing that is common to the area and other property
owners. The landscaping is also that which is common to the area, The building
itself was at one time a church and has been changed only slightly by the addition of a
couple of modular structures and equine facilities to house the equine program.

We believe the planned expansion would not dramatically change the appearance of
the facility as all proposed structural changes are internal. Scheduling of outdoor
activities is done in such a way that only small groups are engaged in outdoor activity
at any given time. Therefore, increasing the population would not increase the
number of residents engaged in outdoor activity at any one time.
We are completely open to any discussion on these matters and are sure that we
would be able to create solutions that would be mutually agreeable to all concerned
regarding privacy, security, utilization, access, lighting and signage.

1 am writing this letter on behalf of the Application for Conditional Use Permit
submitted by the Emily Griffith Center for the proposed expansion of their TLC
unit at 1252 CR 294, to be able to expand their residential program and provide
day treatanent as well.
1 have reviewed the application and proposal and am able to endorse it as the
property owner. As 1 understand it, they are wanting to add seven beds to their
current residential program, provide day treatment and coordinate some of their
campus activities with the proposed program site at 1359 CR 294.
The facility is currently under a conditional use permit for a school and is licensed
for residential and day treatment programming by the State. The planned
expansion will make it possible for them to serve more of the needs locally and
outside the area.
I support the Application and join Emily Griffith Center in asking the Building
and Planning Department to approve the application and allow the project to
move forward.

GARFIELD COUN=TY (hereinafter COUNTY) and
(hereinafter APPLICANT) agree as follows:

establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the

3. APPLICANT and COUNTY attree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain thefull extent of the costs involved in processing the
application. APPLICANT agrees to snake payment of the Base Fee, established_ for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification, by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost- for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional COUNTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COUNTY of any Land use permit, zoning amendment, or subdivision plan.

2. APPLICANT understands and a$rees that Garfield County Resolution No. 96-09, as amended,
establishes a fee schedule for each type of subdivision or land use review applications, and the guidelines for the
administration of the fee structure. .
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the fuII extent of the costs involved in processing the
application. APPLICANT agrees to make payment of the Base Fee, established„ fot the PROJECT, and to
thereafter permit additional costs to "be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4, The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined necessary by the Board of County Commissioners for the consideration of an
application or additional, COUNTY staff time or expense not covered by the Base Fee. If actual recorded, costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COUNTY to reimburse the COUNTY

APPLICATION INFORMATION
The decision to service water or sewer to properties outside of the City of Rifle is determined by the City
Council. The Council may grant service to properties that meet one or more of the following conditions;
The issuance of an outside water tap will create substantial and meaningful long term employment
opportunities for City residents and that the water is not determined to be excessive for the level of
employment produced;
• The issuance of an outside water tap is not appropriate lo annex the property at the time of request
for service, but the extension of service is logical and necessary for the orderly expansion of service
consistent with the City's Comprehensive Plan;
• The issuance of an outside water tap will enhance the operation of the water system within the City
through upgrading of water mains, looping or the addition of storage;
• There is a demonstrated significant human health hazard from existing domestic well which could be
eliminated with a City water lap, and that the water tap use will be restricted to the pre-existing
development.
In the event that a water tap is granted. the following conditions are applicable:
• All new residential development will be subject to City of Rifle development standards, including but
not limited to subdivision, public improvements and applicable Impact fees,
• All residential development to be served by City water must be served by City sewer. Interim septic
systems may be permitted in specific circumstances.
• The developer will be responsible for any capacity and storage upgrades to the water distribution
system that result from the water tap.
■ Water main extensions must meet City public works standards and cannot be less than eight inches
in diameter.
■ Long dead-end water mains must be avoided unless looping is planned in the near future.
• The density and location of the development cannot place a burden on water system repair,
maintenance and meter reading significantly higher than the user fees anticipated.
