Glenwood Springs, Co.81501 Greetings Board of County Commissioners, The last time Gary and I stood before you was in 2008 to request permission to apply for a permit for an ADU on our5'52 acres located in Garfield county. You generously agreed to allow us to apply for the ADU permit. At that time ourplans were to place a modular on the northern area of the property along side'the neighboring property. lt wasunfortunate that our plans were sidelined due to conditions beyond our control, i.e., lack of work and the unforeseen sale of the proposed modular to another party. our back up plan is now under renovation and it will require that theBoard of County commissioners understand our plight and our need to move forward. Today we come before you and ask that you consider allowing us a modification of the original location and size ofthe proposed ADU. Because this property is the last property on a dead end road without through traffic, we feel thenew location for the ADU would in no way impact neighboring properties. While investigating the possibilities of the having the existing recreational cabin modified as the ADU we encounterthe need to have an egress window of 4'x4'installed in order to follow the Garfield county building code requirements.with that we will ask that you allow us a modification of the original size allowance from 1so0 sq. ft. the new allowance of up to 3000 sq. ft. to help us accommodate this code requirement. This well originated L/2/96 as a monitoring hole, MH 27L68. I see that a well permit was apptied for L / L2/ 20OO, perm it #ZZtg48. We have a third share interest in this well. I is registered under the name Wallace.The infrastructure for this approved sub division had never happened and the utility easement wasnever utilized' The existing well is deeded to this property but the pre existing water/power line wasnot properly installed and encroached our property. The state electrical .orp.ny informed us that thatline was illegal and had to be removed. we were then required to have a vault instailed on this propertyin order to accommoda_te the states requirements and we became the owners of the water bill.without the proper well installation with a water pressure and holding tanks, meters etc. - the waterwas not available for us. we did haul water from town for 3 years while our neighbors had water - whichwe were paying the bill for. The well was not a large producer and we had attempted to remedy theissue with several well dregings (at our own expense) and in the end we found that the welljust didn,tproduce and was falling in on it's self. If Applicant intends to divert through a well, it must be understood by Applicant that no right to divert exists until a valid well permit is obtained from the Colorado Division of Wder Resources. 2. Ouantity: Water applied for by the Applicant in the amount set forth above shall be diverted at Applicanfs point of diversion from tre District's direcl flow water rights, and when water is unavailable for diversion pursuant to administdion by the C-olorado State Engineer during periods when said direct flow water right is not in priority, the District shall release for the use ofApplicant up to said quantity in acre feet W y911r of storage water owned or conholled by the Distict It is understood that any qualtity allofied from direct flow, storage or othowise, to the Applicant by the Distict will b€ limited by the priority of the Disticfs decrees and by the physical and legal availability ofwater from Districfs sour@s. Releases from other facilities available to Distict shall be subject to the contasts, laws, rules, and regulations goveming releases therefrom. Furttrermore, the Dishict hereby elEressty reserves the right to store wder and to make exchange releases from stmctur€s that may be built or controlled by the District in the future, so long as the water service to the Applicant pursrant to this agreement, is not impaired by said action. Any quantity of the Applicanfs allocdionnotdeliveredtoorusedbyApplicantbytheendofeachwderyear(Octoberl),shallreverttothewatersuppliesoftheDistrict Such reversion shall not e,ntifle Applicantto any refirnd of payment made for such wder. Water service provided by the District shall be limited to the amount of water available in priority at the original point of diversion ofthe Districfs applicable water right, and neither the Distrist, nor those entitled to utiliz€ the Districfs decrees, may call on any gtdEt amount d nEw or alternale points of diversion. The District shall request the Cotorado Division of Water Resources to estimate any conv€yanoe losses betrreenthe original point and any alternde point and such estimate shall be deducted from this amount in each case. Wder service provided by the Distriot for properties locded within the Bluestone and Silt Water Conservancy Dishicts is provided pursuant to Agreements with said Districts. Altemate Point of Diversion and Plan of Auernentation: Decrees for dtemate points of diversion of the Disticfs wder rights or storage wder may be required in order for Applicant to use the wder service conternplated hereunder. The District reseryes the right to review and approve any conditions which msy be afiached to judicial approval of said altemde point of diversion as contemplaed or necessary to serve Applicanfs facilities or lands. APPlicant acknowledges and agre€s rhat it shall tre solely responsible for the procedures and legal engineering costs necessary for any changes in wder rights cont€mplated hereln, and firther agrees to inderrnify the Disrict from any costs or losses rclded thsr€to. C.ontract Pa.vmsnt Non-refirndable, one time arlminisEdive charge, in the amouat deterrfnd by the Board of Dirpctors of the District from time to tim€, shall be submitted with the applicdion for consideration by the Disaict. 2 Annual payment for the water service described herein shall be deterrnined by the Board of Directors ofthe District. The initial annual payment shall be made in firll, within thirty (30) days after the dale of notice to the Applicant thaf the initial payment is due. Said notice will advise the Applicang among other things, ofthe water delivery year to which the initial payment shall apply and the price which is applicable to that year. Other Rules: Applicant shall be bound by the provisions of the Water Conservancy Act of Colorado; by the rules and regulations of the Board of Directors of the District; and all amendments thereof and supplements thereto and by all othcr applicable larr,. 10. Ooeration and Maintenance Aseement Applicant shall enter into an "Operation and Maintenance Agreement" with the District under terms and conditions determined by the board of Directors of the District, if and wherU the Board of said District determines in its sole discretion tha such an agreement is required. Said agreement may contain, but shall not be limited to, provisions for additional annual monetary considerdion for extsnsion ofDistrict delivery services and for additional administration, operdion, and maintenance costs; or for other costs to the District which may arise through sernices madc available to the Applicant. 1 I . Chanee of Use: The Disrict reserves the exclusive right to review, re-approve or disapprove any proposed ctrange in use of the water allotred hereunder. Any usc other than that set forttr herein or any lease or sale of the wder or water rights allotted hereunder without the prior written approval of the Distict shall be deemed to be a material breach of this Contract. 12. Use and Place of Use: Applicant agrees to use the water in ttre manner and on the property described in fie documents submitted to the District at the time this Contract is executed, or in any operation and maintenance agreement provided by Applicant. Any use 6f[s1 than as set forth thereon or any lease or sale ofthe water or wdsr rights herein, other than as permitted in paragraph E abovg shall be deemed to be a material breach of this agreemert. 13. Title: It is understood and agreed that nothing herein shall be interp'reted to give the Applicant any eguitable or legal fee title intercst in or to any wder or water rights referred to herein. 14- Conservation: Applicant shall use commonly ar*eptdconservdion practices with respect to the water and water rights hereia and hereby agrees to be bound by any conservation plan adopted hereaftcr by the District for use ofDistrict owned or controlled water or wder rights. 15. Restrictions: Applicant shall restict actual diversiotrs to not exceed the contact amount for ordinary household purposes, the wdering of domestic livestoclq fire protectioq and the inigation of lawn and garden as specified in the Appticdion. Applicant shall also comply with aII restrictions and limitations set fortlr in the well pernrit obtained from the Colorado Division of Water Resources. Wdering of livestock shall be restricted to Appticanfs domestic animals not to be used for commercial purposes nnless Applicant obtains 4pprorral from the Colorado Division of Water Resources for commercial use/livestock wdering pmvided x5d in no event shall actual diversions exceed the amount of wder provided by this ConbacL Violdion ofthis paragraph 15 shall be deemed to be a maerial breach of this Contract. 16. Applicant acknowledges that failure to comply with this paragraph could result in legal action to terminate Applicanfs diversion of water by the State of Colorado Division of Water Resources.
