The property is located at 1065 Gage Rd.,
approximately 3 miles south of the City of Rifle
off of County Road 319. lt is located in
Section 35, TOS, R93 W.
The property is zoned Rural (R)
PROJECT INFORMATION AND STAFF COMMENTS
I. GENERAL PROJECT DESCRIPTION
The Applicant is requesting an amendment to the Conditions of approval, contained in
Resolution No. 2008-118 to amend the ADU size limit of 1,500 sq. ft. in Condition #4,
increasing it to the current 3,000 sq.ft. size limit for lots 4 acres or greater pursuant to
the size allowance in the Land Use and Development Code. The request also includes
an amended site plan to allow a revised location for the ADU.
The ADU was previously permitted but the ADU as constructed did not match the
conditions of approval. A notice of violation was issued by County Code Enforcement.
The ADU is approximately 1 ,900 sq.ft. plus a sun room of 168 sq.ft. and is located
toward the west end of the property adjacent to the primarily residence and a storage
building in a different location than originally approved.
All services have been extended to the new location including the access driveway.
Pursuant to the existing approvals the unit is served by an existing well and onsite
waste water treatment system. The Applicant has provided documentation to confirm
the infrastructure is consistent with the existing approvals and conditions and adequate
legally to serue the use. The Applicant's lot was created by the Craig Subdivision
Exemption and is also known as Parcel 3 on said exemption plat.

II. LOCATION . SITE DESCRIPTION
The property is fully developed with residential uses and accessory structures. lt has
moderate slopes within the developed portion of the lot with steeper natural grades
along the western portion of the site. The property has yard and garden areas along
with some pasture and areas with undisturbed native vegetation. No significant
hazards or site concerns were noted in the previous Special Use Permit approvals or in
the current application. There are no live streams on the property.
III. PUBLIC COMMENTS AND REFFERAL AGENCY COMMENTS
Public Notice was provided for the Board's public hearing in accordance with the Land
Use and Development Code. No public comments have been received at this time.
Comments from referral agencies and County Departments are summarized below and
attached as Exhibits.
1. Garfield County Consulting Engineer, Chris Hale, Mountain Cross Engineering
provided comments on the following topics:o Clarification as to the number of units on the propertyo lnformation on the adequacy of the OWTS

o Water system and water rights informationo Any grading or drainage issues at the proposed relocated ADU site.
2. Colorado River Fire Rescue District: Orrin Moon, Fire tVlarshall: Provided
comments indicating that they had conducted a site visit and reviewed the
application and that they had no requirements or concerns with the proposed ADU
at this location.
3. Colorado Division of Water Resources: lvan Franco, Water Resources Engineer
provided comments summarized as follows:o Noted the uses and history of well permitting on the property.o Noted the property is serued by an existing onsite well subject to a contract with
the West Divide Water Conservancy District and a 113 share in an existing
exempt domestic well located adjacent to the property.. The Division indicated that the Applicant should continue to adhere to the
conditions for both well Permit No.'s 661 1 1-F and 228027 and refrain from
expanding or combining their uses. The office had no objection to the proposed
application.
!V. STAFF COMMENTS AND ANALYSIS
Staff review of the Application has focused on the amendment requests, applicable
provisions of the Land Use and Development Code, and compliance with existing
conditions and representations.
Sections 7-101, 102, & 103
Compatibility
Zone District Regulations, Comprehensive PIan &
1. The Application has previous been permitted with appropriate findings that the
use is in compliance with applicable zoning resolutions and the Comprehensive Plan.
2. The relocated site for the ADU demonstrates compliance with zoning standards
including setbacks.
3. The new location has reduced impacts and visibility from adjoining residential
property to the north. Previous mitigation (tree planting for screening) wilt no longer be
appropriate. The proposed location is adjacent to the primary dwelling and
demonstrates improved compatibility with adjacent land uses.
4. No change to the overall density as previously approved would result from the,current request. The Applicant has indicated that future plans may include an
agricultura! employee unit within the existing storage structure. They have provided an
affidavit associated with that potential but indicate the unit has not been created.

5. The Applicant has been advised that Building Permit Applications and review for
the existing structure will be required to confirm that it has been properly constructed
pursuant to Building Code Requirements.
Section 7-104 Source of Water
6. No changes to the water seruice for the ADU are proposed. As part of the
Application submittal and staff review, the applicant has provided updated
documentation confirming the legal source of water for the use and the appropriate
permitting with the Division of Water Resources. A condition of approval should
require that the Applicant keep current the contract with the West Divide Water
Conservancy District consistent with the Division of Water Resources referral
comments.
Section 7-105 Water and Waste Water Systems
7. The Applicant has applied for appropriate County Permits for the expanded
OWTS. The system is engineered and designed to include use by the primary dwelling
and the ADU for up to a tota! of six bedrooms. lnstallation of the system has been
completed and it has been inspected by the County.

Section 7-106 Public Utilities
8. Section 7-105 Public Utilities: The site is currently severed by all necessary
public utilities. Building permit review may require state electrical inspection of the
ADU.
Section 7-107 Access and Roadways
9. No changes to the access roadway and driveway are proposed.
Section 7-108 Use of Land Subject to Natural Hazards
10. The site was previously approved for the ADU and while a new location is
proposed it is generally located in the developed area of the site below areas with
steeper slopes. The ADU construction reflects a minor cut slope with a paftial rock
retaining wall at the rear of the structure. The building permit review should address
any requirements for the retaining wall design and related drainage. No other
significant hazards were identified in the original review and approvals for the Special
Use Permit.
Section 7-109 Fire Protection
11. Referral comments from the Colorado River Fire and Rescue including a site
visit did not identify any concerns with the ADU proposal.

Section 2-201 Agricultural Lands
12. No impacts are anticipated on agricultural operations in the area based on the
existing approvals, relocation of the unit away from a pasture area, and existing fences.
Section 202- Wildlife Habitat Areas
13. No impacts are anticipated based on the existing approvals and the relocated
ADU location adjacent to existing residences and previously disturbed areas.
Section 7-2Og Protection of Waterbodies
14. No live streams are located on the site and the relocation of the ADU does not
create any new impacts to waterbodies.
Section 7-204 Drainage and Erosion
15. The building permit review should require that any drainage and erosion issues
typical for single family residential construction be addressed.
Section 7-2OS Environmental Quality, 7-2OG Wildfire Hazards, 7-2OG Natural and
Geologic Hazards
16. No environmental concerns have been noted and the OWTS has been properly
permitted and engineered. No fire protection issues were noted by the Colorado River
Fire Rescue in their referral comments. Natural hazards are addressed in Section 7-
108 Staff Comments.

Standards.
17. The ADU design is typical for a residential structure and consistent with other
buildings on the property. The Site Plan reflects ample parking areas and room for
snow storage as needed. Landscaping requirements by code are not applicable to
ADU's. Lighting is addressed by an existing condition of approval. Trail and walkways
are generally not applicable based on the rural and agricultural character of the area.
Section 7-701
18. The Application was previously approved, however, it reflects compliance with
the current ADU standards contained in Section 7-701, including lot size and unit size
standards. Also, by condition of approval the unit will be required to comply with all
building code requirements.

Existing Approvals
19. The Special Use Permit was approved by Resolution No.2008-118 and the
Special Use Permit issued on January 5, 2009. The existing conditions of approva! are
attached as an exhibit. Continued compliance with all conditions of approval should be
required with exceptions as follows:
The Applicant has requested modification of Condition #4 to eliminate the
current 1,500 sq.ft. size maximum and replace it with compliance with the
current code maximum of 3,000 sq.ft. for lots greater than 4 acres.
Condition #5 requiring planting of tress for a vegetative screen can be
eliminated based on the relocated site for the ADU. lt is now approximately 400
ft. from the north property line with terrain, existing vegetation, and the Watlace
primary residence located between the ADU and the property line.
SUGGESTED FINDINGS
1. That proper public notice was provided as required for the hearing before the
Board of County Commissioners.
2. The hearing before the Board of County Commissioners was extensive and
complete, that all peftinent facts, matters and issues were submitted and that all
interested pafties were heard at that meeting.
3. That for the above stated and other reasons the proposed Amendment to the
Wallace Accessory Dwelling Unit Special Use Permit is in the best interest of the
health, safety, convenience, order, prosperity and welfare of the citizens of Garfield
County.
4. That with the adoption of conditions, the application is in generat conformance
with the 2030 Comprehensive Plan, as amended.
5. That with the adoptions of conditions the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as amended.
VI. RECOMMENDATION
The following recommended conditions of approval are provided for the Board of
County Commissioners consideration.
That all representations made by the Applicant in the application shall be
conditions of approval, unless specifically altered by the Board of County
Commissioners.
2. All previous conditions of approval contained in Resolution 2004-1 18 shatl remain
in effect with the exception as follows:

a. Condition #4 shall be amended to read: The Accessory Dwelling Unit shall be
limited to a maximum floor area of 3,000 sq.ft. in compliance with the current
maximum size limit set forth in Section 7-701 of the Garfield County Land Use
and Development Code.
b. Condition #6 shall be deleted as the vegetative screen is no longer appropriate
based on the relocation of the ADU.
ADDITIONAL CONDITIONS
The Applicant shall apply for a building permit with the Gadield County Building
Department and shall comply with any conditions and requirements associated
with said permitting. The Building Permit submittals and review shall address
grading, drainage, and retaining wall design/details for the cut slope at the rear of
the ADU.
The Applicant shall maintain in place the contract with the West Divide Water
Conservancy District associated with the well permitting for the site and shal!
continue to adhere to the conditions for both well Permit No.'s 66111-F and
228027 and refrain from expanding or combining their uses.
The total number of bedrooms for the primary residence, ADU, and any future
Agricultural Employee Units shall be limited to six, unless additional capacity is
added to the OWTS pursuant to updated designs and proper permitting by the
Gadield County Building Depafiment.

This office has reviewed the referral from-Garfield County for the Wallace Accessory Dwelling Unit. Theapplicant proposes to amend the size and location of a prwiously approved Accessory Dwelling Unit permit for1065 Gage Road in Rifle' A single family dwelling currently exists at the site and no changes to its use areproposed' The applicant does not propose to create a new lot or change the size of the existing lot. The applicantproposes to continue supplying water tothe site through one existinglron-"*"*pt, on-lot weliand an existingnearby exempt well. waste water from the site will ue-tranatea throrigh an existing on-lot septic system.
This office has record of one existing w{t]o9rya on the property with permit No. 66l l l-F. The permit wasissued on August 9,2007 pursuant 6 c.R.s. 37-90-137(2) anda well Completion Report indicates the well wasconstructed on February 14,2008. use of groundwater from the well is limiied to ordinary household purposesinside one single family dwelling, the imigition of not more than 6,000 square feet of home gardens and lawns,and the watering of five head domestic animals. All use of this well will be curtailed unless the water allotmentcontract or a plan for augmentation is in effect, wDwcD contract # oToTlgcpw(a).
