Colorado, held in the Commissioners'Meeting Room, Garfield County Administration Building
in Glenwood Springs on Monday, the l8th day of May A.D. 2015, there were present:

GARY AND PAT WALLACE, LOCATED AT 1065 GAGE RD. OFF OF COUNTY
ROAD 319, IN SECTION 35, T65, R93W OF THE 6m P.M., GARFIELD COUNTY

A. The Board of County Commissioners of Garf,reld County, Colorado, (Board) received
a request for an Amended Special Use Permit to allow amendments to the existing Special Use
Permit approvals for an Accessory Dwelling Unit, as further described in Exhibit A" Site Plan.

B. The Project is located on a 6.52 acre parcel of land owned by Gary and Pat Wallace.
The owncrship of this property is described in a waranty deed recorded at Reception Number
64E878 in the records of the Garfield County Clerk and Recorder and also knorvn as Parcel 3,
Craig Subdivision Exemption according to the plat thereof recorded at Reception No. 564549.
C. The subject property is located within unincorporated Garfield County in the Rural @)
zone district, approximately 3 miles south of the City of Rifle.

D. The Application was reviewed by the Board of County Commissioners in accordancc
with the provision of thc [-and Use and Development Code for an Amendment to an Approved
l,and Use Change Permit - Special Use Permit. The Special Use Permit was originally approved
by Resolution No. 2008-118.
E. The Board is authorized to approvc, deny or approve with conditions an Application
for Amendment to a land Use Change Permit - Special Use Permit resulting in issuance of an
Amended Spcial Use Permit pursuant to the Land Use and Development Code as amended.
F. The Board of County Commissioncrs opened a public hearing on the l8th day of May,
2015 for consideration of whether the proposed Amended Special Use Permit should be granted
or denied, during which hearing the public and interested persons were given the opportunity to
express their opinions regarding the request.
G. The Board of County Commissioners closed the public hearing on the 18tr day of
May,2015 to make a final decision.
H. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
l. That proper public notice was provided as required for the hearing beforc the
Board of County Commissioners.
2. The hearing before the Board of County Commissioneni was extensive and
complete, that all pertinent facts, matters and issues were submitted and that all interested
parties were heard at that meeting.
3. That for the above stated and other reasons the proposcd Amendment to the
Wallace Accessory Dwelling Unit Special Use Permit is in the best interest of the health,
safety, convenience, order, prosperity and welfare of the citizens of Garheld County.
4. That with the adoption of conditions, the application is in general conformance
with the 2030 Comprehensive Plan, as amended.
5. That with the adoptions of conditions the application has adequately met the
requirements of the Garfield County Land Use and Development Code, as amended.
RESOLUTION
NOW TIIEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield
County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of thc resolution.

B. The Amended Special Use Permit for the Wallace Accessory Dwelling Unit Special Use
Permit is hereby approved subject to compliance with the following conditions:
l. All represetrtations of the Applicant, either within the Application or stated at the hearing
before the Board of County Commissioners, shall be considered conditions of approval
unless othenrise modified by the Board.
2. All lighting associated with the ADU shall be the minimum amount necessary. Alt
exterior lighting shall be shielded to prevent light trespass on any adjoining property and
be downward facing towards the stnrcture.
3. The Applicant shall obtain any applicable Garfield County Building permits, grading
permits and access permits, including approval for a septic permit which can
accommodate the accessory dwelling unit prior to the issuance of Building Permit.
4, The Accessory Dwelling Unit shall be limited to a maximum floor area of 3,000 sq.ft. in
compliance with the current maximum size limit set forth in Section 7-701of the Garfield
County Land Use and Development Code.
5. The accessory dwelling unit shall not be conveyed as a separate interest but may be
leased.
6. The Applicant must provide to Garfield County Vegetation Management a noxious weed
map and inventory of the parcel and develop a noxious weed management plan in
respnse to finding any weeds listed on the Garfield County Noxious Weed List.
7. The Applicant shall apply for a building permit with the Garfield County Building
Department and shall comply with any conditions and requirements associarcd with said
permitting. The Building Perrrit submittals and review shall address grading, drainage,
and retaining wall design/details for the cut slope at the rear of the ADU.
8. The Applicant shall maintain in place the contract with the West Divide Water
Conseryancy District associated with the well permitting for the site and shall continue to
adhere to the conditions for both well Permit No.'s 6611l-F and228027 and refrain from
expanding or combining their uses.
9. The total number of bedrooms for the primary residence, ADU, and any future
Agricultural Employee Units shall be limited to six, unless additional capacity is added to
the OWTS pursuant to updated designs and proper permitting by the Garfield County
Building Department.
