Cerise Eugene "Jim" Drinkhouse Larry Velasquez Earl Rhodes Mildred Alsdorf when the following proceedings, among ethers were had and done, to -wit: , Commissioner Chairman , Commissioner , Commissioner , County Attorney Clerk of the Board RESOLUTION NO. 82-294 A RESOLUTION CONCERNED WITH THE APPROVAL OF A'SPECIAL USE PERMIT; APPLICATION BY Development Engineering, Inc./ParahoDevelopment Corporation, WHEREAS, the Board of County Commissioners of Garfield County has received an application from Development Engineering, Inc:/Paraho Development Corporation for a special use permit for processing of natural resources;specifically, an oil shale retort facility and accessory industrial support facilities, including waste disposal site on the following described tract of land: SW SW Section 17, NW SE, S 2 SE Section 18, NW NW Section 20, T6S, R94W of the 6th P.M. in Garfield County, Colorado, WHEREAS, pursuant to required public notice, the Board conducted a public, hearing.'- on the 22nd day of November 1982, upon the question of whether the above described special use permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said special use permit; and WHEREAS, the Boar:; on the basis of the evidence produced at the aforementioned hearing has made the following determinations of fact: 1. That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners 2. That all hearingsbefore the Board of County Commissioners were extensive and • complete, that all.pertinent facts, matters and issues were submitted and that all interested parties were heard at that 'hearing. 3. That the proposed special'use conforms to Section 5.03, concerning the Approval or Disapproval of a Petition for a Special Use, of the Garfield County Zoning Resolution. 4. The proposed use is compatible with the uses existing and permitted in the district in which it is to be located, provided that certain hereinafter contained conditions be complied with. 5. That neither the impact on traffic volume and safety or on utilities, or any other impact of the special use will injurious to the established neighborhood or zone district in which the special use is to be located. NOW, THEREFORE, BE IT RESOLVED by the Commissioner of Garfield County, Colorado, that a special use permit be and hereby is authorized permitting the use of the .above described tract of land for processing of natural resources; specifically, an oil shale retort facility and accessory industrial support facilities, including a mineral waste disposal site, upon the following specific conditions: 1. That the use of the tract of land comply with all present and future regulations of Garfield County relating to processing of natural resources; specifically, an oil shale, retort facility and accessory industrial support facilities, including a mineral waste disposal site in the zone district in which the property is now or may be located; 2. That, prior to the issuance of the authorized special use permit, the above described tract of land shall be severed from any other tract of land upon which there may exist a principal use, unless such other principal use has been terminated at the time of the issuance of the special use permit. Page 2 BOCK 613 'GE8 Z 3. All proposals of the applicant shall be considered conditions of approval unless state otherwise,by the`Board of County Coirmissiners. 4. The applicant shall meet all conditions of this Special Use Permit from the County within one year of the authorization to approve and issue the permit. 5. 'i -,c,, applicant shall meet all local, state and federal agency permit requirements. A copy of these approved permits shall be submitted to the Planning Department. 6. The applicant shall demonstrate access to the site, and also make a contribution of $5,000.00 to any necessary road improvements, and participate in maintenance activities and costs for the road (a verbal agreement of access must be demonstrated within 20 days of this resolution and a written agreement must be submitted within 120 days) 7. The applicant shall submit reclamation plan, cost estimates, .and some form of security so that the estimated reclamation activities will take place upon cessation of research activities. The estimates and security will he reviewed by the Planning staff and County Attorney for adequacy and proper format. 8. This Special Use Permit shall expire on October 15, 1992 unless otherwise extended by reapplication and review of the project. 9. This Special Use Permit shall be subject to an annual review by the Board of County Commissioners.
