HomeMy WebLinkAbout3.0 Conditions of ApprovalChevron Communication Facilities Conditions of Approval 1. That all representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval unless explicitly altered by the Board. 2. That the operation of the facility be done in accordance with all applicable federal, state, and local regulations governing the operation of this type of facility. The facilities will be operated in accordance with Garfield County and FCC Regulations. 3. That the Applicant shall comply with the fire protection provisions included in the rules and regulations of the Colorado Oil and Gas Conservation Commission (COGCC) and the International Fire Code as the Code pertains to the operation of this facility. The facilities will be designed and operated under the rules and regulations of the Colorado Oil & Gas Conservation Commission and the International Fire Code as such regulations pertain to the operations of the facility. 4. Prior to the issuance of a Special Use Permit, the Applicant shall submit the following items to the County Vegetation Manager for approval prior to the issuance of a Special Use Permit. a. The Applicant shall provide a calculation and map indicating the amount of surface to be disturbed by the construction and operation of the four (4) proposed communication facilities. JZ,3rvo See attached Total Disturbance Calculation b. The Applicant shall provide Garfield County with a $4000 per acre revegetation security based on a 10-15 year timeframe. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Reclamation Standards in the Garfield County Weed Management Plan. It is the responsibility of the Applicant to contact the County, upon successful revegetation establishment, to request an inspection for bond release consideration. 4 / 1-75`. 2/ c. The Applicant shall provide a site rehabilitation plan that details the removal of equipment and associated infrastructure. The plan shall provide for revegetation of the site and associated roads once the facility is no longer in use. See attached Rehabilitation Plan, d. The Applicant shall provide a Soil Management Plan which is to include provisions for salvaging on-site topsoil, a timetable for eliminating topsoil and/or aggregate piles, and a plan that provides for soil cover if any disturbances or stockpiles will sit exposed for a period of 90 days or more. See attached Soil Management and Revegetation Plan. 5, Emission of heat, glare, radiation and fumes: every use shall be so operated that it does not emit heat, glare, radiation or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. Flaring of gases, aircraft warning signals, reflective painting of storage tanks, or other such operations which may be required by law as safety or air pollution control measures shall be exempted from this provision. The towers will not create heat, radiation or fumes. The finish of the towers is matted and should not create any glare. 6. if applicable, the Applicant shall provide a copy of the appropriate bond supplied to the Colorado Oil and Gas Conservation Commission (COGCC) intended to guarantee reclamation of the Communication Facility sites once the life of the Communication Facilities has ended prior to the issuance ofa Special Use Permit. If the COGCC does not require reclamation and revegetation bonding, the applicant shall work with County Staff to establish a bond appropriate to guarantee reclamation and revegetation of the four (4) Communication Facilities. The towers do not fall under COGCC regulations and therefore any bonds associated with activities regulated by the COGCC will not apply. 7. That all proper building permits are obtained for the structures associated with the operation of the Communication Facilities. The county building department has advised that towers and related equipment do not need a building permit. The towers will comply with the National Electrical Code as the code pertains to the design, construction and operation of the towers. 8. Written confirmation from the Federal Communication Commission indicating that these facilities are within all specified federal guidelines. This conftrmation shall be submitted prior to the issuance of the Special Use Permit. See attached documents from the FCC's website. 9. The communication facilities must be available for future co -location and the denial of a landowner/lessor co -location on a site shall be based on technical reasons, not on competitive interests. Any co -Location will be considered on technical merits. Rehabilitation Plan Chevron U.S.A. Inc. will utilize the following procedures to reclaim the sites at each of it tower locations. Tower Removal and Surface Reclamation 1. Remove all radio equipment, batteries and battery equipment from tower. 2. Dismantle the tower. 3. Break up pad and remove. 4. Excavate a portion of the dirt from beside the tower foundation and tip the foundation on its side and bury at 2' to 3' below ground level. 5. Remove tower, equipment and pad material from location, and reuse, salvage or dispose in a licensed landfill. 6. In the disturbed area redistribute and recontour top soil . 7. Broadcast the disturbed area with a county approved seed mix. 8. Cover disturbed area with either weed free mulch or a seed blanket. 9. Monitor disturbed areas for noxious weeds and treat as needed until the disturbed areas are revegetated. 10. Notify the County Vegetation when revegetation has occurred and schedule an inspection. Inc. will institute the following procedures to manage the soil and institute revegetation at each of it tower locations. Prepare Site 1. From the main road to the location flat blade an access path approximately 8' wide. In a spot close to the base flat blade a turn around for vehicle 8'x 20'. 1. At the tower site, layout 10' x 10' pad site. 2. Clear pad site of all vegetation down to bare soil. 3. Bag the cleared vegetation and dispose of the material in a licensed land fill. Construct Tower Base 1. In the center of the cleared area, auger or dig by hand a 2' x 5' hole. 2. Rake and scatter evenly the earth removed from the hole around the 10' x 10' pad site. 3. Compact the soil within the 10' x 10' pad site. 4. Set tower base into hole. 5. Mix and pour cement into hole to complete tower base. Pad Construction 1. Unload pad material into pad site. 2. Level pad material and compact. Post Construction 1. In the areas cleared for access utilize erosion control measures as specified in Chevron's Storm Water Management Plan. 2. Replant the access areas with a county approved seed mix. 3. Monitor locations and treat for noxious weeds. 4.
