Dear Matthew and Sylvia;
This letter is provided to you as the authorized representative of the owners of a parcel
of land located a|7225 CR 312 in unincorporated Gadield County. The application,
submitted on November 18, 2016, requests a Land Use Change Permit for a Community
Meeting Facility to hold public events pursuant to Section 4-103 of the 2013 Land Use
and Development Code, as amended (LUDC). The submittal documents were reviewed
for technical completeness and Community Development has the following questions and
comments regarding submittal of required information:
1. Ownership of the property is listed as Douglas G. Ringer Revocable Trust, Brenda
Nell Ringer Revocable Trust, Sylvia M. Ringer and Matthew M. Ringer. The
application lists only Sylvia and Matthew as owners. The application only has one
signature on it from Matthew but all owners must sign. Please remember to submit
recorded Statements of Authority for the two trusts - these documents will include
the name of the person authorized to act on behalf of the trusts.
2. The applicant is required to submit names and mailing addresses of all properties
located within 200' of the subject propefty (the 280-acre ranch). An Assessor map
indicating the properties within 200' must accompany this list. This information is
available online or in-person from the Assessor's Depaftment.
3. Names and mailing addresses of mineral owners is required to be submitted.
4. Section 4'203 D. of the 2013 Land Use and Development Code, as amended lists
the requirements of a site plan. These requirements include the following, all of
which should be shown on one map:
a. The area of the proposed use, by dimensions, including the structure and
parking areas;
b. Boundary lines and dimensions of the subject project area;

c. Topographic contours;
d. Significant on-site features;
Existing and proposed roads and parking areas by location and dimension;
lrrigation ditches and/or fencing;
Easements;
Existing improvements on the property;
Location and size of existing and proposed leachfields;
Source and capacity of water supply including location and size of well and

A landscape plan is required, this plan is a graphic and explanation of the proposed
vegetation and revegetation that will occur on the site. A statement that grass,
trees and shrubs will be planted on the perimeter of the structure is insufficient to
qualify as a landscape plan.
A Basic Traffic Analysis is required. The information you provided does not
discuss the potential traffic generated by the proposed use, nor a determination of
whether the proposed traffic will cause impacts to the roadway. This analysis must
be performed by a qualified individual, typically an engineer.
The Water Supply Plan states that Well Permit #303451 will be utilized to provide
water for the proposed use on the propefty, and to provide water for fire-fighting
purposes as well. Please provide information related to the following:
a. A copy of the well permit.
b. lt appears that this well is not permitted to serve the proposed commercial use
on the property, but instead is limited to service up to 3 single family dwelling
units and 1 acre of irrigation. Are you planning to amend the permit to allow for
the proposed use?
c. ls this well constructed? lf so, where is it located and how will water be
distributed to the proposed public events structure?
A well pump test to determine if the well is sufficient.
ls any water storage provided or proposed to be provided?
Water quality testing compliant with CDPHE standards for a transient or non-
transient water supply, whichever definition this proposal would meet.
8. The Wastewater Management Plan is required to demonstrate that the site is
suitable for an OWTS. No soils information was provided and no information was
submitted with regard to existing OWTS on the site. Based upon national
standards the number of restrooms provided for such an operation ranges from 1
restroom per 25 attendees to 1 restroom per 50 attendees. The County has
required that other facilities provide based upon the standard of 1 per 50. This
means that certain events will required additional restrooms that may be provided

via porta-potties. Please provide information from a local supplier regarding
contracting for this seruice.
9. What sofi of facilities are proposed to be located within the structure? A kitchen?
Other improvements? Please provide floor plans.
10.The Applicant is required to respond to the standards contained in Article 7,
Divisions 1, 2 and 3. This would include a requirement for additional information
related to the following:
a. Section 7-1O7 requires that access to the site be both safe and adequate for
the proposed traffic generated. lnsufficient information has been provided with
regard to the width and sudace of the proposed access road.
b. Parking standards are based upon square footage of the proposed facility,
however there is no information in the application about the size of the barn
structure.
c. Both Lighting and Noise are issues with proposals of these types, particularly
in very rural areas such as proposed. Please provide additional information on
how the both the lighting and noise issues will be addressed so that adjacent
properties are not adversely impacted by the proposal.
d. Discussion of fire protection is necessary - will the well water be available for
fire-fighting purposes? Willthere be fire extinguishers, etc. in the structure?
11. Please format your proposal based upon the submittal requirements contained in
the Pre-application Conference Summary form. This would require that ceftain
documents be grouped together and in order based upon the code requirements.
For your convenience I have attached the application submittal requirements and
the format for the submittal documents.
Please let me know if you would like to meet to discuss any of the items included in this
letter, if so we can set up a meeting in this regard. Be aware that Section 4-101 B (2)
provides an Applicant 60 days to correct the deficiencies of the application.

Hi Kathy,
You asked me to review the above application for legal ability to proceed. I reviewed the following:
Ownership-deed provided. 4 owners. Two trusts and two individuals.
Application. lncomplete. All 4 owners need to sign and be named as owners.
Authority-incomplete. The two trusts each need a trust certification letter from an attorney who reviewed each trust
to state that the trust is still valid, the state of incorporation, the date of creation and the current trustee(s) of each
trust. lfthereareco-trustees,theattorneyneedstocertifywhetherbothtrusteesareneededtoactonbehalfofeach
trust or if each co-trustee can act independently. Upon receipt of the trust certification letters from a lawyer, we will
know who is authorized to act on behalf of each trust. That trustee or co-trustees need to sign the application or
authorize Matthew Singer to act on each trust's behalf. A trust certification letter from an attorney is needed because
we cannot rely on the co-trustees to say they have authority. Trustees can be removed, and therefore, a third party
attorney needs to validate authority. Sylvia Ringer needs to sign the application or authorize Matt Ringer to act on her
behalf.
200 foot notification-incomplete. No addresses provided. Neighbors were missing from list.
Mineral ownership-incomplete. Applicant needs to explain how mineral rights were researched.
Water-incomplete. No permit provided. No pump tests or water quality tests provided. Property has an existing
single family dwelling so we need proof that house and barn will have legal and adequate water. Also, sewer needs
should be analyzed in more depth. Sounds like a large group of people for 2 bathrooms. COA should be to limit the
number and require porta-potties for overflow.
Access-land survey references an "apparent access and right of way agreement." This needs to be reviewed. Was a
driveway access permit obtained?
other-parking will be an issue. A more detailed site plan would be appreciated.
