A RESOLUTION OF THE BOARD OF ADJUSTMENT OF GARFIELD COUNTY
APPROVING A VARIANCE FROM THE FRONT YARD SETBACK OF 30', FOR A
PROPERTY LOCATED AT 263 RIVERBEND DRIVE, LOT 2, BLOCK 3, AMENDED
RIVERBEND SUBDIVISION, NEW CASTLE, COLORADO, GARFIELD COUNTY
PARCEL NO# 2123-344-05-002
Recitals
A. Kirk and Melissa Leintz made an application to the Board of Adjustment of Garfield
County, Colorado, (the "Board") requesting the Board grant a variance from the Unified Land
Use Resolution of 2008, as amended. Specifically, Kirk and Melissa Leintz requested a variance
to the setback required as per the Amended Riverbend Subdivision, Filing No. 2 plat, Reception
No. 299710. This plat specifies a minimum front yard setback requirement of thirty (30) feet
from property lines.
B. Kirk and Melissa Leintz are the owners of real property identified as Lot 2, Block 3,
Amended Riverbend Subdivision, Filing No. 2, more practically described as 263 Riverbend
Drive and encompassing an area of .52 -acres ("Leintz Property").
C. The subject property is contained within a Planned Unit Development and issuance of
the requested variance will not affect compliance with the other zone district standards contained
within the Unified Land Use Resolution of 2008, as amended (ULUR).
D. Kirk and Melissa Leintz specifically request the Board grant a variance from
Amended. Riverbend Subdivision, Filing No. 2 plat, Reception No. 299710 which requires a
minimum front yard setback of thirty feet (30') from the front property line to 22.66 feet as
indicated on the site plan attached as Exhibits A and B.
E. Garfield County is a legal and political subdivision of the State of Colorado, for which
the Board of County Commissioners is authorized to act.
F. The Board of County Commissioners of Garfield County has appointed the Garfield
County Board of Adjustment.
H. Pursuant to C.R.S. § 30-28-117, the Board of Adjustment conducted a public hearing
on July 26, 2010, upon the question of whether the requested variance should be approved,
denied, or whether any action should be taken on this matter.

I. The Board on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following determinations of fact:
1. That proper posting and public notice were provided as required for the meeting
before the Board of Adjustment.
2. The meeting before the Board of Adjustment was extensive and complete, that all
pertinent facts, matters and issues were submitted and that all interested parties were
heard at that meeting.
3. That for the above stated and other reasons made on the record, the proposed
Variance has been determined to be in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of Garfield County.
4. The application has met the standards and requirements for Variance pursuant to
Article 4, Division 3 of the Garfield County Unified Land Use Resolution of 2008, as
amended.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment, Garfield County,
Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the resolution.
B. The Variance from Amended Riverbend Subdivision, Filing No. 2 plat, Reception No.
299710 Front Setback in the Planned Unit Development on the Leintz Property shall be
reduced to 22.66 feet, and is hereby approved subject to compliance with the site plan
attached as Exhibits A and B.
