DIRECTOR DETERMINATION
Accessory Dwelling Unit at Lot2, Ranch at Coulter Creek

Dear Mr. Stewart,
This letter is provided to you as the authorized representative for the owner /
applicants of Lot 2, Ranch at Coulter Creek. A request for an Administrative
Permit for an Accessory Dwelling Unit has been reviewed and a Director
Determination is issued approving the permit subject to the following conditions:
1. All representations of the applicant within the application shall be
considered conditions of approval unless otherwise modified by the
Determination of the Dlrector.
All lighting associated with the ADU shall be the minimum amount
necessary. All exterior lighting shal! be shielded to prevent tight trespass
on any adjoining property and be downward facing towards the structure.
The Applicant shall meet all requirements of the Garfield County Unified
Land Use Resolution of 2008 and shall meet all building code
requirements.
The accessory dwelling unit shall not be conveyed as a separate interest
but may be leased.
Adjacent property owners may request reconsideration of this
determination within 10 days. The Board of County Commissioners may
call-up the application for review within 14 calendar days. The timeframe
commences from the date of determination. The Administrative Permit will
be issued upon expiration of that time if no request for further
consideration is received.

GENERAL ADMINISTRATIVE PERMIT REQUEST
1. REQUEST
LaBaron 4Bars, LLC (John and Linda Moore) request a permit for an Ac.cessory Dwelling unit
(ADU) on Lot 2, Ranch at coulter creek. rnis pircel is 9.785-acres, with water provided via a
central system r"ring the subdivision of Ranch at Coulter Creek. An lndividual Sewage
Disposal'system has-been designed to accommodate this use.
2. DESGRIPTION OF THE PROPOSAL
TheapplicantrequffiermittoallowforanAccessoryDwellingUnit(ADU)on
Lot 2, Ranch at coulter creek. The ADU is aftached to the main structure, located above a
garage. The ADU contains less than 1,500 square feet of finished floor area and the minimum lot
size requirement has been met.
3. APPLICABLE REGULATIOIIS
The Land Use Table contained in Article lll designates an ADU as a Use Permitted Subject to
Administrative Review. section 3-304 stipulates iequirements that must be met in orderto apply
for the General Administrative permit. Those requirements include a minimum lot size of 2 acres
or twice the minimum lot size in zone districts where the minimum lot size is less than 2 acres'
The subject property is g.785 acres therefore comptiant with this requirement. ln addition, the
maximum ,qr"r" iottage for an ADU in the rural zone district is 1,500 square feet which is not
exceeded in the current request.
Section 4-,104 stipulates the Administrative Review Process and Section 7-801 provides
additional standards applicable to an ADU. All requirements have been met, including the
requirement for notice to trt" adjacent properties which the applicant has completed, submitting
certified return receipts for that notice.
4. RECOMMENDATION
Staff finds that thfiro-ed ADU is in compliance with $3-304, and S4-104, 54-501 and-S7-801
of the Garfield d*ty unified Land Use Resolution of 2ooa and recommends that the Director
approve the Generalhdministrative Permit to allow an ADU on a property legally described as
Loi 2, Ranch at Coulter Creek, with the following conditions:
1. All representations of the applicantwithin the application shallbe considered conditions of
approval unless otherwise modified by the Determination of the Director.
2. Alllighting associated with theADU shallbethe minimum amount necessary. Allexterior
lighting shall be shielded to prevent Iight trespass on any adjoining property and be
downward facing towards the structure'
3. The Applicant Jhall meet all requiremelll of the Garfield Gounty Unified Land Use
Resolution of 2008 and shall meet all building code requirements.
