Home My WebLink About4.0 Resolution 2003-871111111 11111 111111 11111 1111 111111111111111111111111 640191 11/05/2003 03 25P 81535 P785 M ALSDORF 1 of 5 R 0.00 D 0.00 GARFIELD COUNTY CO STATE OF COLORADO )ss County of Garfield At a regular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on, Monday, the 20th day of October A.D. 2003, there were present: John Martin , Commissioner Chairman Larry McCown , Commissioner Tresi Houpt , Commissioner Don DeFord , County Attorney Mildred Alsdorf , Clerk of the Board Ed Green , County Manager when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 2003-87 A RESOLUTION APPROVING A FLOODPLAIN SPECIAL USE PERMIT FOR THE CONSTRUCTION OF A SINGLE FAMILY RESIDENCE AND CONSTRUCTION IMPROVEMENTS FOR HARRY AND COLLEEN COLBORN WHEREAS, the Board of County Commissioners of Garfield County, Colorado, received an application from Harry and Colleen Colborn for Floodplain Special Use Permit for development within the 100 year floodplain of the Helmer Gulch for the construction of a single family residence and construction improvements, including rehabilitation and rock lining of the Helmer Gulch channel, pond / driveway / trail construction, overlot grading, vegetation management and installation of a rock retaining wall; and WHEREAS, the entire property, 27.54 acres, is located within the delineated 100 -year floodplain area of the Helmer Gulch and requires a Floodplain Special Use Permit; and WHEREAS, the owner has demonstrated compliance with all required review criteria and / or standards for the Floodplain Special Use Permit; and WHEREAS, the Board of County Commissioners of Garfield County, Colorado, held a public hearing on the 20d' day of October, 2003, upon the question of whether the above described Floodplain Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions concerning the approval the aforementioned requests; and 1111111 11111 111E11 11111 Illi ..,i 11111111 111 11111 1111 111 640191 11/05/2003 03 25P B1535 P766 M ALSDORF 2 of 5 R 0.00 D 0.00 GARFIELD COUNTY CO WHEREAS, the Board of County Commissioners of Garfield County, Colorado, on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact as listed below: 1. That proper posting and public notice was provided as required for the hearing before the Board of County Commissioners. 2. That the meeting before the Board of County Commissioners was extensive and complete, that alI pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That for the above stated and other reasons, the proposed special use permit has been determined to be in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. 4. That the application has met the requirements of Sections 6.08.01 and 9:03 the Garfield County Zoning Resolution of 1978, as amended. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Floodplain Special Use Permit request is hereby approved subject to compliance with all of the following specific conditions: 1. All representations of the Applicant, either within the application or stated at the hearing before the Board of County Commissioners, shall be considered conditions of approval, unless specifically altered by the Board. 2. The Applicant shall provide to the County written consent or agreement from the Loesch & Crann Ditch Company allowing the piping of the portion of the Last Chance Ditch along the northeast boundary of the subject property should the Applicant pipe the Ditch. 3. Prior to the issuance of the actual Special Use Permit, the Applicant shall provide written documentation from the Army Corps of Engineers showing that the concerns raised in the Corp's letter dated September 12, 2003, have been addressed to the satisfactory of the Corps.. 4. Prior to the issuance of the actual Special Use Permit, the Applicant shall provide an approved Outside City Water Service permit from the City of Rifle granting permission for the primary residence to connect to the City of Rifle water main that traverses the property. 5. The Applicant shall adhere to the performance standards in Section 6.09.02 of the Zoning Resolution applicable at the time of approval of this Special Use Permit for development in the Flood Fringe and Flood Prone Areas. 2 111.111111111111111111111111 I:. Noxious Weeds i. Inventory and mapping: The Applicant shall map and inventory the property for County listed noxious weeds_ The wetland delineation report does not mention noxious weeds. A visual inspection from the county road by the Garfield County Vegetation Manager indicated that Russian olives may be on the northern end of the property although it was difficult to tell the property boundary from that distance. All ditches and waterways on the property must be mapped also. ii. Weed Management: The Applicant shall submit a weed management plan for the inventoried noxious weeds, including removal and treatment of the aforementioned Russian olives. B. Revegetation The revised Revegetation Guidelines from the Garfield County Weed Management Plan calls for the following: i. Plant material list. ii. Planting schedule. iii. A map of the areas impacted by soil disturbances (outside of the building envelopes). iv. A revegetation security shall be provided prior to the issuance of the Special Use Permit. The Applicant has provided the plant material list and planting schedule. The Applicant shall quantify the area, in terms of acres, to be disturbed and subsequently reseeded on road cut and utility disturbances. This information will help determine the amount of security that will held for revegetation. Any straw used as a mulch shall be certified as weed -free straw. The security shall be held by Garfield County until vegetation has been successfully reestablished according to the Garfield County Weed Management Plan Reclamation Standards. Soil Plan The Revegetation Guidelines also request that the Applicant provide a Soil Management Plan that includes: i. Provisions for salvaging on-site topsoil. ii. A timetable for eliminating topsoil and/or aggregate piles. iii. A plan that provides for soil cover if any disturbances or stockpiles will sit exposed for a period of 90 days or more 7. The Applicant shall comply with the recommendation of the Colorado Division of Wildlife (letter date October 16, 2003) which include the following: A. During excavation and landscaping activities, care shall be taken to avoid disturbing existing dens and /or nests. B. Mature cottonwoods exist in areas which provide nesting habitat for various birds. Every effort shall be made to avoid removal of cottonwoods and other beneficial species. C. Weed suppression shall be provided for the proposed development to contain the spread of noxious weeds in Garfield County. Many weeds in Garfield County are prone to be spread through road base gravel products imported from gravel pits. As part of the landscaping plan, importation of gravel products, including road base, from weed -free pits would be beneficial to the County. Dated this 3rd day of November , A.D. 2003 .
