4. An impact statement on the proposed use where required by Sections
5.03-5.03.12 of the Zoning Regulations.
5. Notice, including the name of the applicant, description of the
subject lot, a description of the proposed special use and the time
and place for the hearing, shall be given in the newspaper of general
circulation in that portion of the County at least fifteen (15) days
prior to such hearing time. The applicant shall bear the cost of
advertising.
6. A copy of Assessor'smap showing property; and a listing of all
adjoining property owners of said property. Notice, containing
information described under paragraph 5, shall be mailed to all owners
of record of these lots, at least 5 days prior to the hearing, by
certified, return receipt mail, and the receipts shall be presented at
the hearing by the applicant.
7. A fee of $500.00 shall be charged for each application and shall be
submitted with the application.
8. Attach copy of proof of ownership (deed; title insurance).
This Special Use permit is in compliance with Sections 5.03 and 9.03 of
the Garfield County Zoning Resolution and as per application.
List all adjoining property owners of said property Attached.
Attach map showing all improvements (present and proposed) and all
pertinent distances and area. Show all improvements on your property and
adjoining property.

between Glenwood Springs and Carbondale. The existing retail space
is currently occupied by the Bump Shop, an auto repair facility.
In addition to the proposed gas sales and market, a
manager's/caretaker's residence is proposed for the building. ^.c'

This matter has been scheduled for a public hearing before the
Board of County Commissioners at their May 21, 1990 meeting.

This letter is to transmit an application for a Special Use Permit on behalf of Mr.
Patrick Groom. The requested special use is for a retail gasoline sales and
convenience store with an upstairs apartment for employee housing. The subject
property is an existing commercial park owned by Pat Groom, located adjacent to
Highway 82. The following information is submitted for your review:
1. Special Use Permit application form.

9. Letter of Approval from the Colorado Department of Highways for the
existing access onto Highway 82.
10. A letter from Pat Groom authorizing Peter Belau of Enartech, Inc. to act of
his behalf to obtain the requested Special Use Permit.
The subject property is located adjacent to Highway 82, 1/4 mile north of the Cattle
Creek exit. Existing improvements on the property include two commercial
buildings and a propane storage tank. The proposed improvements associated with
this Special Use Permit application include three gasoline pumps, underground
gasoline storage tanks and a canopy as shown on the enclosed plan. Plans and
specifications for the construction of the proposed improvements are not available.
Construction will be in conformance with all applicable County, State and Federal
regulations. The proposed improvements are located within the front yard setback
of the property; a variance from the setback requirements is hereby requested if
necessary to construct the proposed improvements within this setback.
The convenience store and retail gasoline sales will be located in the north end of
the southernmost of the two existing buildings (see enclosed map). This space
currently houses the Bump Shop auto body repair, which will not continue operating
at this location. There are two bathrooms in this space for public sanitary facilities.
A residential apartment with a separate access is located upstairs.
Water service is currently provided by the Cattle Creek Water Company. Sewer
service is provided by on-site sewage disposal systems for each of the buildings. The
proposed improvements do not include any additional water use fixtures, and it is
assumed that the existing water and sewer facilities are sufficient for current uses
and for the proposed uses. The proposed uses will not place any significant
additional demands on the existing water and sewer facilities.
Access to the property is from northbound Highway 82 and from an existing access
roadway from the intersection of Highway 82 and Cattle Creek Road (County Road
No. 113) into the southwest corner of the subject property. The property is bounded
by County Road 110 on the east but cannot access directly onto this County Road
due to a steep hillside. Access directly to and from southbound Highway 82 to the
property is not available because of a median in the Highway. Access across the
median onto Highway 82 with acceleration/deceleration lanes is not feasible due to
grade differences between the northbound and southbound lanes of Highway 82.
Southbound traffic on Highway 82 must use the Cattle Creek exit to access the
property. This exit has acceleration/deceleration lanes.

feet; thence 88.88 feet along the arc of a 364.52 foot radius curve to
the right which arc subtends a chord bearing N 07° 36' 30" W 28.66
feet; thence N 00° 37' 23" W 62.13 feet; thence 27.08 feet along the
arc of a 70.00 foot radius curve to the left which arc subtends a
chord bearing N 11° 42' 17" t4 26.91 feet; thence N 22° 47' 11" W 83.61
feet; thence 65.39 feet along the arc of a 235.00 foot radius curve
to the right which arc subtends a chord bearing N 14° 48' 54" W 65.18
feet; thence N 06° 50' 37" W 212.63 feet; thence 176.73 teet along the
arc of a 141.24 foot radius curve to the right which arc subtends a chord
bearing N 29° 00' 11" E 165.43 feet; thence N 64° 50' 59" E 63.99 feet;
thence 67.77 feet along the arc of a 321.58 foot radius curve to the
right which arc subtends a chord bearing N 70° 53' 14" E 67.65 feet to
a point on the boundary line of a tract of land described in Document
-No. 260508 of the records of the Clerk and Recorder of Garfield County,
Colorado thence along said boundary line the following courses: N 10°
45' 04" W 129.20 feet; thence t, 89° 13' 30" W 384.83 feet; thence S 00°
36' 37" W 541.95 feet to the easterly right-of-way line of Colorado
State Highway No. 82; thence S C6° 03' 10" E 395.29 feet along said
easterly right-of-way line; thence east 283.76 feet to the point or
beginning containing 5.84 acres more or less.

Dear Mr. Groom:
This is a Letter of Approval to pave existing driveway to a maximum of
35 feet driving surface and also to restore drainage under the driveway.
This driveway was built by the Department of Highways in 1967 for access
to this property, which is 1500 feet North of Cattle Creek on Highway 82.
The construction signing will conform to the Uniform Traffic Control
Manual, Section VI.

obtain a Special Use Permit for a gas station (retail sale) on my property located on
a portion of Lot 15, Section 7, T.7S., R.88 W. in Garfield County. The subject
property is located on the east side of Highway 82, 1/4 mile north of the Cattle
Creek intersection.
