HomeMy WebLinkAbout4.0 Resolution 95-079483882 B-954 P-857 10/04/95 12:OOP PG 1 OF 6 RFC DOC NOT 0.00 MIIDRED ALSDORF GARFIELD COUNTY CLERK AND RECORDER STATE OF COLORADO ) )ss County of Garfield ) At a regular hearing of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday , the 2nd of October A.D. 1995 , there were present: Marian I., Smith Arnold Mackley Elmer (Buckev) Arbaney Don 1?eFo rd Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 95 0.79 A RESOLUTION CONCERNED WITH THE APPROVAL OF A SPECIAL USE PERMIT APPLICATION FOR SNYDER OIL CORPORATION. WIIEREAS, the Board of County Commissioners of Garfield County, Colorado, has received application from Snyder Oil Corporation for construction and operation of a natural gas compressor facility on the following described tract of land: See Attached: Exhibit A (in the State of Colorado and the County of Garfield); and WHEREAS, the Board held a public hearing on the 11th day of September 1995, upon the question of whether the above-described Special Use Permit should be granted or denied, at which hearing the public and interested persons were given the opportunity to express their opinions regarding the issuance of said Special Use Permit; and WHEREAS, the Board on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determination of fact: I . That proper publication and public notice was provided as required by law for the hearing before the Board of County Commissioners. That the hearing before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the application is in compliance with the Garfield County Zoning Resolution of 1978, as amended. ?5? J 483882 B-954 P-858 10/0... J5 12:OOP PG 2 OF 6 4. For the above stated and other reasons, the proposed use is in the best interest of the health, safety, morals, convenience, order, 'prosperity and welfare of the citizens of Garfield County. NOW, Tl -HEREFORE, BE IT RESOLVED by the Board of County Commissioners of Garfield County, Colorado, that the Special Use Permit be and hereby is authorized permitting the use of the above described tract of land for the construction and operation of a natural gas compressor facility, upon the following specific conditions: 1. All proposals of the applicants shall be considered conditions of approval unless stated otherwise by the Board of County Commissioners. The operation of the facility must be consistent with the predicted amount of emissions to be generated by the facility and the operation of the facility must not exceed these amounts. 3. The amount of noise to be generated by the operation of this facility be consistent with the predicted decibels (dB) as indicated above. The predicted amounts will be used as the maximum allowable level and if sound power levels exceed these allowable limits, immediate mitigation must take place at the sole expense of the operator of the facility (SOCO). 4. The construction of the foundation for the engine -compressor unit be done in a manner to prevent perceptible vibration from occurring outside of the property botmdary as it exists on the Property Stuvey Map. The foundation will also be constructed with respect to the shrink - swell potential of the soil as identified by the SCS, Rifle Area book, in order to mitigate any possible problems associated with the shrink -swell potential. Furthermore, the Lincoln- Devore Soil Study be closely followed in design and construction of the site. 5. Construction at the site be done in a manner to control further erosion of the parcel, in an eff-or-t to control any further headword erosion of the washes that exist on site. 6. Reclamation and revegetation ofthe site occur when SOCO ceases operations of the facility, in a manner that returns the site to its original, preconstruction state. 7. SOCO adopt a mitigation plan in the event the liquids storage tanks are ruptured at any time during construction or operation of the engine -compressor facility to address and mitigate any potential surface or ground water pollution or fire hazards which could conceivably occur. Additionally, the local fire district receive a copy of the fire control/suppression procedure as outlined by the applicant.
