Use Permit application has been deemed technically complete.
II. PROCEDURAL REQU!REMENTS
(The following steps outline how the Special Use Permit Application review process works in
Garfield County.)
1. Submit this completed application form, base fee, and all supplemental information to the
Garfield County Planning Department. lt will be received and given to a Staff Planner who
will review the application for technical completeness.
2. Once the application is deemed technically complete, the Staff Planner will send you a
letter indicating the application is complete. ln addition, Staff will also send you a "Public
Notice Form(s)" indicating the time and date of your hearing before the Board of County
Commissioners. Prior to the public hearing, Staff will provide you with a Staff Memorandum
regarding your requested Special Use. (lf Staff determines you application to be deficient,
a letter will be sent to you indicating that additional information is needed to deem your
application com plete. )
3. lt is solely the Applicant's responsibility to ensure proper noticing occurs regarding the
requested Special Use and the public hearing. lf proper notice has not occurred, the
public hearing wil! not occur. Notice requirements are as follows:
fi**e by publication, including the name of the applicant, description of the subject-v lot, a description of the proposed special use and nature of the hearing, and the
date, time and place for the hearing shall be given once in a newspaper of general
circulation in that portion of the County in which the subject property is located at
least thirty (30) but not more than sixty (60) days prior to the date of such hearing,
and proof of publication shall be presented at hearing by the applicant.

The posting must take place at least thirty (30) but not more than sixty (60) days
prior to the hearing date and is the sole responsibility of the applicant to post the
notice, and ensure that it remains posted until and during the date of the hearing.
The Applicant is required to appear before the Board of County Commissioners at the time
and date of the public hearing at which time the Board will consider the request. ln addition,
the Applicant shall provide proof, at the hearing, that proper notice was provided.
Once the Board makes a decision regarding the Special Use request, Staff will provide the
Applicant with a signed resolution memorializing the action taken by the Board. Following
the Board's approval, this office will issue the Special Use Permit to the applicant. lf the
Board's approval includes specific conditions of approval to be met, this office will not issue
the Official Special Use Permit certificate until the applicant has satisfied all conditions of
approval. The Special Use Permit approval is not finalized until this office has issued the
Official Special Use Permit certificate signed by the Chairman of the Board of County
Commissioners.

2. APPLICANT understands and agrees that Garfield County Resolution No.
establishes a fee schedule for each type ofsubdivision or land use review applications, and'
administration of the fee structure.
3. APPLICANT and COLINTY agree that because of the size, nature or scope of the proposed
project, it is not possible at this time to ascertain the full extent of the costs involved in processing the
ffiication. APPLICANT agrees to make payment of the Base Fee, established for the PROJECT, and to
thereafter permit additional costs to be billed to APPLICANT. APPLICANT agrees to make additional
payments upon notification by the COUNTY when they are necessary as costs are incurred.
4. The Base Fee shall be in addition to and exclusive of any cost for publication or cost of
consulting service determined nbcessary by the Board of County Commissioners for the consideration of an
application or additional COLINTY staff time or expense not covered by the Base Fee. If actual recorded costs
exceed the initial Base Fee, APPLICANT shall pay additional billings to COLINTY to reimburse the COUNTY
for the processing of the PROJECT mentioned above. APPLICANT acknowledges that all billing shall be paid
prior to the final consideration by the COLTNTY of any land use permit, zoning amendment, or subdivision plan.

This Special Use Permit application is to qualiff an existing 850 sq.ft. guest cabin as an
Accessory Dwelling Unit, to allow the permiuing and building of a primary residence on
the same parcel of land.

The existing guest cabin was constructed in 200112002 as a Recreational Cabin, meeting ^ ,,^.t

In 2003 the owners contracted a different builder to construct another Recreational Cabin fu61
As a primary dwelling on this parcel. After some inquires with the Garfield County I
Building & Planning Dept. it was discovered that only one Recreational Cabin per parcel I
T:Xs chose to have the existing Recreational cabin converted to a Single Family W{F
Dwelling Unit. This was completed in Dec. 2003 after obtaining a building permit, final t/' ^^,/
inspectiJn and certificate of occupancy from the Garfield County Building-& Planning I ffPru{Oept. ll
The guest cabin does meet the standards of an Accessory Dwelling Unit. The approval of
the Special Use Permit will allow the owners to designate the guest cabin as an
Accessory Dwelling Unit and be able to permit and build a primary residence on this
parcel.
This Special Use Permit is for an Accessory Dwelling Unit only, there is no commercial
purpose intended.
The property is primarily used late spring through thll as a summer home / ranch by the
retired couple who are the owners of the property.
The owners and their occasional guests will use the property for leisure and the many
recreational activities that the area offers, some of which will be: hiking, fishing, hunting,
horseback riding, wildlife viewing and access to public lands.
The hours of operation and number of vehicles accessing the property will be typical of
the needs of a private ranch this size and will blend right into the character of the
community.
Currently on the property there are three existing buildings.
1. The guest cabin, which will become an Accessory Dwelling Unit, consists of 850 sq.
ft. of living area and approximately 1340 sq. ft. of deck area.
2. The barn: consists of 525 sq. ft. of interior space and6l2 sq. ft. of attached shed roof
areas.
3. The storage / work shop log building: consists of 344 sq. ft. and has 95 sq. ft. of
covered porch.
Their locations are addressed on the site plan.
The site of the proposed primary residence is located on the site plan. The size of this
building will be addressed when the building permit is applied for.
Electric?l power to the guest cabin and to the proposed building site of the primary
residence is in place and has been inspected and approved by state electrical inspector.

Due to the remote location, size of the property and the adjacent parcels, the proposed use
will have minimal impact and be consistent with the character of the established
neighborhood.
The location of the guest cabin and the proposed primary residence is in a large park area
on the property with adequate acreage and slope for building sites. See topo map.

necessary to obtain our primary dwelling permit. Bob will design and install the septic.
